LEASE AGREEMENT

THIS LEASE AGREEMENT is made at New Delhi on this 10th day of April, 2020,
Between Mr. Amit Viz,
S/o Sanjay Viz
R/o M-123,
Amar Colony, Lajpat Nagar,
New Delhi- 110024,

hereinafter called the “Lessor" of the One Part.

AND

Mr. Ajay Mishra


S/o Rohan Mishra
R/o L/34, Sukhdev Vihar,
Jamia Nagar, New Delhi- 110025,

herein called the “Lessee" for the other part.

The expression of the terms the "Lessor" and the "Lessee" wherever they occur in the
body of this deed shall mean and include them, their successors, executors,
representatives, nominees and assigns etc.
WHEREAS the lessor is the absolute and exclusive owner and in possession of
M-123, Amar Colony, Lajpat Nagar, New Delhi-110024

AND WHEREAS the lessee has approached the lessor for taking the property No. M-
123, 4th floor, Amar colony, Lajpat Nagar, New Delhi on a monthly rent of
Rs.30,000 /- (Thirty Thousand Only)
(CONSIDERATION) excluding water, electricity charges and common maintenance
charges of the building and other charges, for a period of 11 months and the lessor has
agreed to let out the aforesaid property to the lessee with necessary amenities, fixtures
and fitting etc. (hereinafter referred to as the demised premises / the said premises), on
the terms and conditions hereinafter appearing and agreed.

NOW THESE PRESENTS WITNESSETH AND IT IS HEREBY AGREED BY


AND BETWEEN THE PARTIES HERE TO AS FOLLOWS.

1. That in consideration of the rent hereby agreed and reserved and the covenants and
condition in terms hereof contained to be observed and performed by the lessee,
the lessor doth hereby grants lease strictly for the lawful residential purposes, to
have and to hold the said premises unto the Lessee for a term of eleven months,
commencing from 15/04/20 (15th April 2020) to 15/03/21 (15th March 2021),
yielding and paying therefore a monthly rent of Rs.30,000/- (Thirty Thousand
Only) to the lessor, excluding electricity, water charges and common maintenance
charges of the building and other charges etc) per month.
2. The interest free security amount shall be deposited Rs.60,000/- ( Sixty thousand
Only) by the lessee with the lessor and the said security amount, which shall be
returned/ refunded to the Lessee by the Lessor, at the time of handing over the
peaceful possession by the Lessee to the Lessor on the expiry of lease or its early
determination after deducting all the dues and demands, if any, on account of rent,
electricity, water, and damages caused to the premises or building and fixtures and
fittings such as fans, and other electric and water sanitary fittings.
3. The Lessee shall regularly pay the agreed rent to the Lessor in advance on or
before the 7th day (Seventh day) of Each English Calendar month, in respect of
which it is due.
4. That the lease period shall be for eleven months only, commencing from
15/04/2020 (15th April 2020) to 15/03/2021 (15th March 2021) and the Lessee
shall vacate and hand over the peaceful vacant physical possession of the demised
premises / the said premises to the lessor, immediately on the expiry of the lease or
its early determination. In the event of early determination of the lease by the
lessee before the expiry of the lease, in that event the lessee shall give one month's
notice to the lessor in advance for vacating the premises or pay one month's rent in
lieu thereof.
5. That there is a separate electricity connection for the said premises and the lessee
shall regularly pay the electricity consumption charges/ bills directly to the
authorities concerned and the duly paid bills (in original) will be handed over to
the Lessor within seven days of such payment.
Any penalty caused due to late payment of electricity charges as well as
restoration charges if connections are cut will be paid by the lessee to the
concerned department will be paid by the Lessee to the Lessor.

COVENANATS AND UNDERSTAKINGS OF THE LESSEE

6. THE LESSEE DOTH HEREBY COVENANT WITH THE LESSOR AS


FOLLOWS:

(a) To use the said premises by the lessee for lawful residential purpose
only for the Lessee and his family members dependent on him and the
said premises shall not be used by the lessee other than the residential.
(b) Not to make any additions or alterations in the
demised premises including that of wood and sanitary fittings and pipe
lines etc., without obtaining prior written permission of the lessor.
(c) In case the lessee alongwith his family is out of the house for more than
30 days (Thirty Days) without prior written notice to the lessor, the
lessor has got the full authority / right to enter into the above said
premises, in case of emergency.
(d) To vacate and hand over the peaceful and vacant physical possession of
the said premises to the Lessor upon the expiry of the lease period or at
its early termination in the same good condition as now being taken
over by the lessee, subject to normal wear and tear.
(e) To permit the lessor or his authorized agents to enter the premises at
reasonable hours for inspections and repairs.
(f) To keep the said premises, in clean and hygienic
conditions and shall not do or cause to be done any act which may be a
nuisance to others.
(g) To undertake day to day repairs and replacement of electrical and
sanitary fittings etc and maintenance of the electrical and sanitary
fittings and fixtures shall be done by the lessee at his own cost.
However if there is any damage to the electric wiring inside the walls
other than from overloading, the lessor will attend to the same.
(h) Not to sublet the demised premises, or part with it's possession to/ on
favour of any other person or to create any third party interest in the
demised premises.
(i) To pay regularly and punctually the rent as well other charges such as
electricity and other charges, including Resident Welfare Association
Charges.
(j) Not to obstruct the common areas and staircase of the building by
storing goods and chaining pets etc.
(k) Not to cause any nuisance or annoyance to the neighbours.

7. THE LESSEE HEREBY FURTHER COVENANT AS UNDER:


(a) At the time of execution of this lease, the said premises are in perfect state
of repairs and have been painted, polished and distempered and it is hereby
agreed between the parties that for the duration of this lease, the lessor is
discharged from any obligation for painting, polishing or maintaining the
said premises in his part.
(b) The lessee shall be entitled to park one car inside the parking area of
premises.
(c) Not to do in the said premises any act, deed, matter or thing which is a
nuisance or is obnoxious or illegal and to identify and keep indemnified the
lessor in this behalf from and against the consequences of any breach.
(d) Not to store in the said premises any objectionable goods hazardous
explosives or of combustible nature which may cause risk by fire or
explosion or materials which on account of their weight or natures, may
cause damages or endanger the safety of the building.
(e) Not to assign, or under let or sub let or part with the possession of the said
premises or any part thereof to any person without the written prior
permission of the lessor.
8. AND IT IS HEREBY FURTHER AGREED AND DECLARED BY AND
BETWEEN THE LESSOR AND THE LESSEE AS FOLLOWS:
(a) The lessor himself shall be entitled to terminate the lease without any
written notice, if at time, the rent herein above reserved, (whether formally
demanded or not), shall remain unpaid for one month, or the lessee fails to
perform any of the obligations / covenant herein above contained without
any written notice, and the lessee shall vacate the said premises forthwith.
(b) That any of the conditions as mentioned above may be modified suitably
amended and do more conditions added with the mutual written consent of
the parties.
(c) That the extension of lease period shall be sole discretion of the lessor and
in case the lease period is extended, it shall be subject to execution of
new/fresh lease deed with increase of Rs.1000/- in rent only for next year.
(d) That in case the lessee fails to vacates the premises on the expiry of the
lease or its early termination, the lessee shall pay the penalty / damage of
Rs.10,000/-(Rupees Ten thousand only) per day, (together with agreed rent)
to the lessor till the possession is handed over to the lessor by the lessee,
without prejudice to the right of the lessor to get the said premises vacated
through court of law.
(e) That the lessor can terminate the tenancy by giving one month written prior
notice to the lessee, thereupon the lessee shall vacate and handover the
peaceful vacant physical possession of the property to the lessor.
