Background-

Art 360-

1. gives special status to j&k , allows to have its own consti

2. was an temporary provision, as constituent assembly of j&k was suppose to give provisions
that would nullify art.360
3. art. 360 seen as permanent as consti assembly dissolved without providing the provision
4. art. Was supposed to be removed but was left untouched due to poor management and
ind/pak war,hence left untouched
5. to apply any law except for defence, foreign affair, finance and communication parliament
needed permission from stated govt
6. except for was or external aggression no financial emergency could be declared in the state
unuder 370
7. I parli could not Inc./dec. boarder of state
8. No state list limited to only union & concurrent list.
9. Residuary power belonged to state legislature
10. Dpsp and FD not applicable to j&k

art 35a-

1. gave power to j&K to decide its permanent residents and provide the with special
privileges
