NOTICE UNDER SUB-SECTION (1) AND CLAUSE (B)(II) OF SUB

SECTION 4 OF THE PUBLIC PREMISES (EVICTION OF
UNAUTHORIZED OCCUPANTS) ACT-1971.

To,

D.A. Flats, Delhi – 110007

Whereas, I, the undersigned, am of the opinion on the grounds

specified below, that you are in unauthorized occupation of public
premises mentioned in the schedule below and that you should be
evicted from the said premises.

GROUNDS

The above said Govt. Accommodation i.e. Flat No. 2063, Type-
IV, Gulabi Bagh, Delhi Administration Flats, Delhi was allotted to
you. It has been reported that original allottee of the Govt.
Accommodation has been imposed a penalty of dismissal from
service by Order No. F.DPCC/1(3)/Admn./94/15930-15932 dated
21.01.2013 by the Chairman DPCC/Disciplinary Authority received
from Delhi Pollution Control Committee, Dept. of Environment, Govt.
of NCT of Delhi, 5th Floor, ISBT Building Kashmere Gate, Delhi –
110006. The Delhi Govt. Employee could have retained the Govt.
Accommodation for a limited period on payment of prescribed
licence fee and only with the approval of competent authority
allowing him for this retention. It has been reported that the said
Govt. Accommodation has not been vacated till date.

Now, therefore, in pursuance of sub-section (1) of section 4 of

the Act, I hereby call upon you to show cause on or before the
undersigned why such an order of eviction should not be made.

And in pursuance of clause (b) (ii) of sub-section (2) of section

4, I also call upon you to appear before me in person or through a
duly authorized representative capable to answer all material
questions connected with the matter along the evidence which you
intend to produce in support of the cause shown, on 24.05.2013 at
11.00 AM for personal hearing. In case, you fail to appear on the
said date and time, the case will be decided ex parte.

ORDER

Following Delhi Government Residential flats at Gulabi Bagh,

Delhi are to be Evicted on 13.01/2014 at 11.00 AM as the allottee/
kins is residing unauthorizedly even after issue of eviction order and
the occupant has not yet surrendered the house to PWD. The
eviction team will evict the occupant from the said flat on
13.01.2014.

Subject : Regarding retention of Flat no. 2063, Delhi Admin Flats,

Gulabi Bag, Delhi -7

Sir,

With reference to above, it is submitted that consequent to an order

passed by Secretary Environment Cum Chairman, Delhi Pollution
Control Committee for dismissal of the undersigned from post of
Senior Environmental Engineer, DPCC, Deptt of Environment,
GNCTD, the estate officer, PWD has issued a show cause notice
under subsection (1) and clause (B)(II) of subsection 4 of PP Act
1971 vide notice dated 15.5.2013 delivered to my wife on 23.5.13 at
about 4.30 PM in my absence. In my absence, my wife attended the
hearing before Estate Officer on 24.5.13 at 11 am to seek some other
date for me to present before estate officer.

She was obviously not aware of details of the case and rules under
PP Act 1971.

There is a very likely hood of some injustice meted out to me as

consequence of said notice.

Sir, in above context, I crave indulgence for your favour in view of

the position being faced by me and I would be grateful if my request
for permission to retain the above accommodation is acceded to by
you.

Sir, I have been a victim of departmental indiscretion in termination

of my services on findings on preponderance of probability without
any rhyme and reason. I have challenged the decision before Hon’ble
High Court in WP( C ) 2347/2013 and the Hon’ble Court is pleased
to admit the petition and posted for completion of proceedings before
6.7.13. A copy of order is enclosed for your king perusal. I am quite
hopeful that I will be exonerated with full honour.

Sir, I am nearly 59 year old and my children are still studying in

college. Very short period of my service is left as such for securing
justice. I have applied for allotment of a flat which is assured to be
ready by March 2014.

Under the circumstances, may I seek your benign favour of

permission to occupy the said govt accommodation in Gulabi Bag till
March 2014 under the rules applicable to retiring persons. Sir, I
would not have encroach upon your valuable time but for the
pitiable condition in which I have been placed after serving the
department with utmost sincerity and devotion to work when I am
placed under scanner for no known reason.

May I therefore request you to kindly extend my period of stay in the

allotted flat for which I am ready to pay standard/market rent as
applicable.
