AFFIDAVIT

I, DOLORES DANES, of legal age, Filipino, married, with residence


and postal address at Iponan, Cagayan de Oro City, after having been duly
sworn to in accordance with law, do hereby depose and state:

1. That I am one of the legal heirs of the late PABLO PANCHO, and one
of the consequent owners of a parcel of land previously registered
under the name of the said deceased;

2. That the said land, located in Macabalan, Cagayan de Oro City, and
under Transfer Certificate of Title (TCT) No. 137-2011002726 is
particularly described as:

“A parcel of land (lot 1100-B of the subdivision plan PSD-49070, being a


portion of lot 1100 of the cadastral survey of Cagayan, L.R.C. Cad. record
no. 1562), situated in the district of Macabalan, City of Cagayan de Oro,.
Bounded on the NW., along line 1-2, by lot 1100-A of the subdivision plan;
along line 2-3 by lot 1111, Cagayan Cad.; along line 3-4, by lot 1098
Cagayan cad.; and along line 4-1 by lot 1100-C of the subdivision plan.
Beginning at a point marked “1” on plan, being S.80 deg 48’E., 233.49 M.
from B.B.M. 3. Cagayan Cad.
thence N. 30 deg. 45’ E., 24.00 m. to the point of 2;
thence S. 51 deg. 16’E., 22.15 m. to the point of 3;
thence S. 28 deg. 29’W., 23.90 m. to the point of 4;
thence N.51 deg. 54’ W., 23.05 m. to the point of beginning; containing an
area of FIVE THIRTY FIVE (535) SQUARE METERS. All points referred to are
indicated on the plan and marked on the ground as follows; point 3, by old
point; and the rest, by p.l.s. cyl. conc, mons.; bearings true; date of the
original survey, Nov., 1926 – July, 1932 and that of the subdivision survey,
Aug. 30, 1956.”

3. That the said parcel of land had a CONCRETE BUILDING


(denominated as BUILDING 2) constructed thereon but was not
utilized for any purpose;

4. That on February 15, 2019, I, together with the other prior owners of
the said property, namely: CONCHITA T. DANES, ARISTOTLE T.
DANES, BENHUR T.DANES, and CHERYL DANES, as VENDORS,
executed a DEED OF ABSOLUTE SALE in favor of JOHN MARK
SANTOS, as VENDEE, on the subject property;

5. That the object of the said sale, which was for and in consideration
of Five Million Pesos (P5, 000, 000.00) was ONLY THE PARCEL OF
LAND AND DOES NOT INCLUDE THE ERECTED BUILDING
(BUILDING 2) THEREON as stated above;

6. That from the time of the execution of the said sale of the property
and until the full and final transfer of the ownership thereto, ONLY
THE ABOVE-DESCRIBED PARCEL OF LAND AND NO OTHER
IMPROVEMENTS on the said real property formed part of the
object of the said sale;

7. That I am executing this AFFIDAVIT to attest to the truth of the


foregoing facts, for the requirements of the Bureau of Internal
Revenue (BIR), and for any other cognate legal purpose that this
may serve.
