SECTION 01060 – CODES, STANDARDS, GOVERNMENTAL AGENCIES, AND

REGULATORY REQUIREMENTS

01060-1 GANERAL
1.1 Summary

A. This section lists codes standards, governmental agencies with jurisdiction over this
Contract, and regulatory requirements applicable to the Contract. The section
includes the following:

1. International Codes and Standards.

2. Thai Standards.

3. Thai Government Agencies.

4. Technical Literature
1.2 Related Sections
1. Section 01070 Abbreviations.

2. Conditions of Contract.

3. Other Technical Specifications.


1.3 International Codes and Standards
A. The Contractor shall comply with all codes, regulations, specifications and standards
referred to throughout the Contract Documents. If discrepancies occur between
Contract Documents, local codes, local utility requirements, international standards
or codes, the most stringent requirements shall apply.

B. The Contractor shall notify the Employer’s Representative of conflicts between


referenced standards and specified requirements in Specifications or indicated on
Drawings before proceeding with the work. Standards for specifying materials or
testing which are cited in the Specifications by reference shall have the same force
and effect as if included in the Contract physically.

C. No provision of referenced standard specifications, manuals or codes (whether or not


specifically incorporated by reference in Contract Documents) shall change the
duties and responsibilities of the Employer, the Contractor or their consultants,
agents and employees from the responsibilities set forth in the Contract Documents,
nor shall any provision assign to the Employer or the Employer’s Representative,
their agents and/or employees any duty or authority to supervise or direct furnishing
or performance of Work, or any duty or authority to undertake responsibilities
contrary to the provisions of the Contract.

D. All reference to codes, regulations, specifications and standards referred to in the


Contract Documents shall mean, and are intended to be, the latest edition,

amendment or revision of such reference or standard in effect as of the date of the


Contract. The Contractor shall maintain a copy of the latest edition of all codes,
standards and technical literature referenced in the Contract Documents on Site, in
good order and available to the Employer’s Representative at all times.
E. Tolerance may vary from standards of different Sections of the Specifications. The
Contractor shall make adjustments necessary to ensure proper fitting of different
elements. Tolerances may be plus or minus as indicated but in sum shall be
compensating, not cumulative.
F. Whenever the Contract Documents require that a product complies with Federal
Specification, British Standard, ASTM Designation, ANSI Specification or other
association, standards and the like the Contractor shall present an affidavit from the
manufacturer certifying that the product complies therewith. Where requested or
specified, the Contractor shall submit supporting test data to substantiate compliance.

G. Where a reference standard referred to herein is in the form of a recommendation or


suggestion, such recommendation or suggestion shall be deemed to be mandatory
under this Contract unless conflicting with particular specifications contained herein.

H. Where Specifications contain any reference to any particular standards or codes of


practice and where there is no specific provision otherwise, the relevant Thai
Industrial Standards (TIS) and the relevant standards and codes of the organizations
listed below will be also acceptable to the Employer as substitutes. The onus of
demonstrating that the materials, products and the like the Contractor wishes to
propose as substitutes have been manufactured or produced, tested and certified to
one of these standards or codes and are equal to or better than those specified shall
rest with the Contractor.

I. Should the Contractor wish to propose materials, product and the like certified to any
other standard or code, then the Contractor mush demonstrate to the satisfaction of
the Employer’s Representative that the proposed standard or code is equal to or better
than that specified in the specifications or that of any one of the Organizations listed
above. Where no standard or code is specified or exists, as for example in the case of
patented or special materials, products or the like, all such materials, products or the
like and the workmanship shall be of the best quality, and full details thereof
including the tests to which they are subjected to shall be submitted to the
Employer’s Representative for approval.

1.4 Thai Standards

A. The Contractor shall comply with the standards of, as a minimum, the following Thai
institutions:
EIT The Engineering Institute of Thailand.
MEA The Metropolitan Electricity Authority.
MWA The Metropolitan Waterworks Authority.
TIS Thai Industrial Standard.
TOT Telephone Organization of Thailand.
TSES Thai Standards of Electrical Safety.
DOH Department of Highways.

A. The following list of Government Agencies is not intended to be exhaustive and the
Contractor shall carry out all works in strict accordance with current Codes and
Regulations of all Government Agencies whether listed hereunder or not.

1.6 Technical Literature

A. The Contractor shall provide the Employer’s Representative with one complete,
latest edition copy of all standard specifications referred to in these documents and
one copy of all manufacturer’s catalogues and the like dealing with proprietary
products specified or proposed as substitutes. The Contractor shall make such
submissions within three months of the Commencement Date or, in the case of
substitute materials, as soon thereafter as is reasonably practicable.
