MODULE V
OVERVIEW

In this module we will study the different types of crimes


against marriage specially here in the Philippines.

There are 4 crimes according to the Revised Penal Code of


the Philippines with subsequent related penal laws:

a. Adultery
b. Concubinage
c. Bigamy
d. Marital Rape

a. Discuss the rules on crimes against marriage under Revise Penal Code of the Phil.
b. Recognize the crimes that may commit against marriage

Crimes against Marriage


Indifidelity in marriage may constitute any of the following which are punishable under
the Act. No. 3851 also known as the Revised Penal Code of the Philippines with subsequently
related penal laws:

1. Adultery – the carnal relation between a married


woman and a man who is not her husband, the latter knowing her to
be married, even if the marriage be subsequently declared void (Article
333)

2. Concubinage – it is commited by any husband who


shall keep a mistress in the conjugal dwelling, or shall have sexual
intercourse, under scandalous circumstances, with a woman who is
not his wife, or shall cohabit with her in any other places (Article 334)

3. Bigamy – the contracting of a subsequent marriage


before the former marriage has been legally dissolved, or before the
absent spouse has been declared presumptively dead by means of a
judgment rendered in the proper proceedings (Article 349).

4. Marital Rape – aside from the crimes of


infidelity, Philippine law now recognize unlawful sexual acts of
the husband against the will of the wife in the revise and
expanded definition of rape under Republic Act No. 8353 known
as the Anti-Rape Law on 1997 signed inlo law on September
30, 1997 citing:

In case it is the legal husband who is the offender, the subsequent forgiveness by the wife as
the offended party shall extinguish the criminal action or the penalty…”

Spouse Abuse, An Offense to God


When husbands and wives are angry or frustrated, they sometimes allow their behavior
to become abusive and destructive. Spouses should never abuse one another in any way.
Abuse violates the commandments of God.
Spouse abuse can be physical, emotional or sexual.
 Emotional abuse includes actions of yelling, cursing, making insulting or
demeaning remarks, acting in a dictatorial way, humiliating a spouse. And
ignoring or minimizing spouse’s feelings.
 Physical abuse includes pushing, shaking, hitting, slapping, coercing and
withholding resources.
 Sexual abuse may be either emotional or physical. It includes sexual
harassment, inflicting pain, and persisting in doing things during times of intimacy
that are unpleasant or displeasing.

b. Interview 3 couples/married and ask them how they support, love each other.
c. Create some article about crime against marriage.
