Max Lionel Realty was founded in 2008 by property developer Max Lionel. The company

currently employs approximately 100 people, 80 of whom are licensed real estate agents. Through its

client agents, the organisation manages property sales rentals on behalf of a range of clients. The

organisation also separately engages in investment activities, such as property and land development.

Max Lionel Realty has been a member of the Real Estate Institute of Victoria (REIV) since 2008 and

proudly follows the REIV Code of Conduct.

There was an oily substance on the emergency exit stairwell that is quite hazardous and brought

about the risk of the client breaking her wrist. The substance posed a threat to the safety of the clients and

agents of Max Lionel Realty (MLR). The client who fell over the stairwell must have most likely stepped

on the oily substance. The oily substance must have been there for a longer time because normally the

main exit is used to leave the premises; unlike in this case where the client opted to leave in a hurry

through the emergency exit and fell. The cleaning staff must have been negligent because of the presence

of oil on the floor. Whether or not that the oily substance had been there for a while, it meant that the

floor attendant had not carried out their duty. The oil could cause a bigger risk and thus the floor should

be cleaned and inspected regularly to avoid any future accidents.

 Not realizing what had happened, or the seriousness of the accident, the agent criticized the
Client’s high heels, implying that such a thing would never happen to a man. ‘Any sensible woman
Would take the lift’.

 The client was taken to the Royal Women’s Hospital by ambulance.

As soon as the incident was caused, the management of the company got involved to
investigate the whole act. It was important at that time to highlight whether the injury
caused to the client was because of the company or not. The investigation reports stated that
a strange odour and an oily substance on the stairwell which lead to slippery and caused this
incident. Therefore, the company is liable to compensate the client for her injury.
