COMMENT
(ON THE MOTION FOR REDUCTION OF BAIL BOND WIH MOTION FOR
CORRECTION OF MIDDLE NAME OF ACCUSED)

The undersigned prosecutor, unto this Honorable Court, respectfully interposes


her objection to the reduction of bail from P200,000.00 to P50,000.00. Under
Administrative Circular no. 38-2020, the accused must be arraigned before reduction of
bail may be granted. Based on the evidence available, accused was only committed on
May 5, 2020, and was not yet arraigned. The provision is hereby quoted as follows:

“For indigent PDLs who have not yet been arraigned, they must first be arraigned
before being granted bail or recognizance...”

Under the same administrative circular, under paragraph 1, the circular reads:

“for those charged with a crime punishable with the maximum period of
reclusion temporal or twelve (12) years and one (1) day to twenty (20) years, the bail
shall be computed by getting the medium period multiplied by Three Thousand Pesos
(P3,000.00) for every year of imprisonment”

However, prior to arraignment, the undersigned is amenable for the reduction of


half the recommended bail, or from P200,000.00 to P100,000.00, as customary been
requested.

With respect to the correction of the middle name of he accused, finding the
motion supported with evidence, the undersigned does not interpose to the correction.
