WHEREAS, Section 16 of the Local Government Code of 1991 expressly states that,
Every local government unit shall exercise the powers expressly granted, those necessarily
implied therefrom, as well as powers necessary, appropriate, or incidental for its efficient and
effective governance, and those which are essential to the promotion of the general welfare;
WHEREAS, further, Section 468 (a) (4) (v) of the same Code grants the Sangguniang
Panlalawigan the power to approve ordinances which shall ensure the efficient and effective
delivery of the basic services and facilities as well as approve measures and adopt quarantine
regulations to prevent the introduction and spread of diseases within its territiorial jurisdiction;

An Ordinance Penalizing the Dishonesty or Untruthful Declaration of any Patient in Times of Public Health Emergency or Pandemic
SECTION 1. Short Title. This Ordinance shall be known as the “Patient’s Dishonesty
Act of 2020”.
SECTION 2. Definition of Terms. For purposes of this Ordinance the words and
phrases contained herein shall be understood, as follows:
a. Patient – Any person who seeks medical attention or advice from a medical
professional, whether in confinement or out-patient. A person who is deemed a
person under monitoring (PUM) as defined under the guidelines of Department of
Health shall be considered a patient.
d. Public health emergency – A disease which poses a risk to more than one country, is
serious, unusual or unexpected and requires a coordinated international response.
SECTION 3. Duty of the Patient. Any patient, or any person acting on his behalf, who
shall be required by any medical clinic, hospital, health center or any health facility, whether
public or private, to fill-up or accomplish an information sheet, data form, declaration or any
similar document, or verbally disclose such relevant information, is hereby required to truthfully
disclose all such relevant information as may be required in the said form or document or as may
be inquired by a medical professional, such as but not limited to, physician, nurse or their
assistants.
SECTION 4. Penalties. Any such patient, or any person acting on his behalf, who is
found to have knowingly and deliberately made any material misrepresentation, committed
dishonesty or withheld relevant information from a medical professional or his assistant during a
state of public health emergency as declared by the National Government or a pandemic as
declared by the World Health Organization shall be punished by an imprisonment of one (1) year
and a fine ranging from the amount of One Thousand Pesos (P1,000.00) to Five Thousand Pesos
(P5,000.00) at the discretion of the court.
