ORDINANCE NO. 06-S-2022

AN ORDINANCE PROHIBITING THE PRESENCE OF ASTRAY ANIMALS IN

ALL PUBLIC PLACES WITHIN BARANGAY SAN CARLOS, VALENCIA CITY,
BUKIDNON.

EXPLANATORY NOTE

WHEREAS, it is declared policy of the State to protect and promote the right to
health of the people thus, a system for the control, prevention of the spread of animal
rabies shall be provided and the need for responsible pet ownership should be
established;

WHEREAS, it has been observed that Barangay San Carlos has many stray
dogs roaming around public places such as streets, plaza and schools that may
possess threat to public safety and health;

NOW THEREFORE, on motion of Hon. Hon. Geralyn C. Baliling duly seconded

by all Sangguniang Barangay members present;

BE IT RESOLVED AS IT IS HEREBY RESOLVED, to pass the herein

ordinance, thus,

BE IT ORDAINED by the Sangguniang Barangay of San Carlos in regular

session assembled, that;

Section 1. TITLE– This Ordinance shall be known as “AN ORDINANCE

PRESCRIBING RULES AND REGULATING THE OWNERSHIP, CARE

ORDINANCE NO. 06-S-2022 Page 1/4

 AND CUSTODY OF ANIMALS CLASSIFIED AS KENNELS (DOGS) AND
FELINES (CATS) AND IMPOSING PENALTIES FOR VIOLATIONS OF VICIOUS
STRAY ANIMALS THEREOF, AND OTHER PURPOSES”

Section 2. Scope of Application.

This ordinance shall be applying to all pet owners to exercise responsible pet
ownership, care and custody of animals classified as kennels (dogs) and felines
(cats) in Barangay San Carlos.

Section 3. Definition of Terms.

For purposes of this ordinance, the following terms are defined to wit.

(a) Rabies- means a communicable disease of both wild and domestic animal
transmittable to humans.
(b) Vicious Animals- mean any animal with known tendency to attack unprovoked
or to cause injury, or otherwise threaten the safety of human beings or other
animals, or has bitten any person.
(c) Stray Animals – means any unlicensed or licensed animal found unattached or
loose anywhere in public places.
(d) Vaccination- means inoculation of dog/cat with standard rabies vaccine.
(e) Animal Owner – means every person in possession of or harboring any
animals or who allows any such animal to remain about his premises for a
period of ten (10) days.
(f) Defecate – discharge feces from the body.

Section 4. OWNER’S DUTIES AND RESPONSIBILITIES.

a. Take Care and provide for the needs such as food, shelter and safety
including vaccination of their animals and to prevent any form of cruelty to
their animals in accordance with Republic Act 8485, other known as Animal
Welfare Act of 1998;
b. Should keep their animals within their premises;
c. To keep his animal, particularly dog, under control or physical restraint as to
prevent such animal from becoming a danger to persons or property or
from trespassing upon the property of other.
d. Prevent his/her animal, particularly dog, to run loose in public places and
must kept on leashes; otherwise, the dog will be considered a stray animal
e. Must not allow animal to defecate on another person’s property, on any
street, lane, boulevard, pathway or on any public lane;
f. Should be liable for any damage to property and/or injury to person,
including medical expenses, caused by their animal while outside their
premises.
g. Must not allow animal to cry, bark, yelp, howl or make noises frequently so
as not to disturb the peace and quiet of the neighborhood.

Failure to perform by the owner of any of the aforementioned duties and

responsibilities shall be ground for penalty under Section 5 hereof.

Section 5. PENALTIES.

The penalty for violation of any of the provisions of this ordinance shall be
penalized with:

(a) Fine of not less than P500.00 but not more than P1,000.00 on the first offense;
(b) Fine of not less than P1,000.00 but not more than P1,500.00 on the second
offense;
(c) Fine of not less than P1,500.00 but not more than P2,000.00 on the second
offense;

 Unpaid penalties mean refusal of Barangay Government to release document
such as barangay clearance needed by the violator.

Section 6. SEPARABILITY CLAUSE

If any provisions of this Ordinance are declared unconstitutional or the application

thereof to any person or circumstance is withheld, other provisions or parts
thereof not declared as such shall remain valid and enforceable.

Section 7. Effectivity Clause.

``` This Ordinance shall take effect upon its enactment and approval.
