BARANGAY ORDINANCE NO. 001, SS – 2021

"ORDINANCE RESTRICTING STRAY DOGS AND OTHER ANIMALS ROAMING OR LOITERING AT PUBLIC PLACE
AND FOR OTHER PURPOSES”

Whereas, to prevent the widespread of rabies, to instill discipline


among animal owner, and to attain a more sanitary and cleaner environment
within the jurisdictional domain of the BARANGAY;

Whereas, this ordinance seeks to address incidents of animal bites,


interest of public safety, more cleaner environment, and to promote responsible
animal owner;

Whereas, on the motion of Kagawad Mariel U. Urganay, Committee on


Health and Safety duly seconded Kagawad Anabel V. Ragsac;

Ordained, by the Sangguniang Barangay member of Barangay Minanga in


Regular Session assembled dated June 4, 2021 that;
ARTICLE I
TITLE AND SCOPE

SECTION 1. TITLE OF THE ORDINANCE. This Ordinance shall be known as the


"ORDINANCE RESTRICTING STRAY DOGS AND OTHER ANIMALS ROAMING OR
LOITERING AT PUBLIC PLACE AND FOR OTHER PURPOSES':

SECTION 2. PURPOSE AND SCOPE. Act and of with the end in view to redefine who the
impounding authorities are; imposition of stiffer fees and penalties to
violators and in so doing it will deter the proliferation of stray animals in
public places thus enabling the public to attain sanitary, public safety and
cleaner environment;
ARTICLE II
DEFINITION OF TERMS

As used in this Ordinance, the following terms or words shall mean.,

1. ANIMALS - refers to all domesticated pet animals belonging to or relating


to quadruped e.g. dogs, cats, hogs, goats, carabao;
2. FINE - to set a fine on by judgment of a court or to punish by fine under
a "no contest rule" by the impounding authorities without going to court
for purposes of litigating the offense alleged/charged by the authorities
concerned;
3. NO CONTEST RULE - means the unquestionable and the voluntary
admission of violating the ordinance by the stray animal owners when
confronted and or booked by the impounding authorities;
4. IMPOUNDING AUTHORITIES - those local government officers designated to
enforce and implement the Ordinance and their authorized representatives;
5. STRAY ANIMAL - shall be understood to mean an animal which is loose,
unrestrained and confined loitering in public place;
ARTICLE Ill
UNLAWFUL ACTS
SECTION 1. It should be unlawful for owners of quadruped or four legged animals
whether domesticated or not to allow it stray and roam around or
loitering in public places.

ARTICLE IV
IMPOUNDING OF STRAY ANIMALS
SECTION 1. Any stray animal found and caught by the impounding auo8thorities or their
authorized representatives in any public places within the barangay;

SECTION 2. IMPOSITION OF FEES. There is hereby imposed the following fees for the
impounding and/or adopti on of stray animals including the cost of feeds
or foods to wit:

1. Impounding fees for dog and cattle is Thirty pesos (P 30.00) per day.
2. All collections under this Ordinance shall form part of the funds of
the Barangay and all collected fees should be properly receipted and paid
to the Barangay.

SECTION 3. DISPOSITION OF UNCLAIMED/IMPOUNDED STRAY ANIMAL S. If there is no


one who claims ownership of the animal three (3) days from its
impounding, the Barangay Treasurer or her authorized representative
shall advertise its Adoption of the said Animals through Bulletin Boards of
this Barangay as it deems practicable and also in some other conspicuous
public places for at least three (3) days before adoption;

However, the owner may stop the adoption at anytime, during or before
the day of adoption the pound fees due and the costs incurred up to that
moment to the Barangay Treasurer conducting the same, otherwise, the
adoption shall proceed.
ARTICLE V
DESIGNATING OF A BARANGAY ANIMAL
POUND

SECTION 1. For purposes of this Ordinance, the Punong Barangay shall designate a
place as the Barangay pound where impounded animals will be kept or
deposited pending their disposition.
ARTICLE VI
IMPOUNDING AUTHOR ITIES

SECTION 1. All Barangay Officials motu propio shall cause the impounding of stray
animals in their Barangays.

SECTION 2. PENALTY: The owner of the impounded animal shall, punished by a fines:
1st Offense - P 200.00

2nd Offense - P 500.00


3rd Offense - P 1000.00

SECTI ON 3. NO CONTEST PROVISION. Provided, however, that any person, individual or entity
who is apprehended or cited for violation of said Ordinance who does
not wish to contest the violation and is willing to pay voluntarily the fine
imposed upon him/her prior to the filing of formal charges with the
proper court shall be allowed to pay said fine with the Barangay
Treasurer;.
SECTION 4. REPEALING CLAUSE. Barangay Ordinance No. 027 SS. 2011 herewith repealed,
modified or amended accordingly.

SECTION 5. SEPARABILITY CLAUSE. – If any of the sections or provisions of this Act is held
invalid, all the other provisions not affected thereby shall remain valid.

SECTION 6. EFFECTIVITY. This Ordinance shall take effect immediately upon approval.
Enacted this 4th day of June, 2021 at Barangay Minanga, Camalaniugan,
Cagayan.
