of 2021 entitled “An Ordinance Imposing Penalties on Acts Causing Disturbance to Peace
and Order in the Barangay”
Upon the initiative of Kagawad Santiago F. Frayres, and on his motion, duly seconded
by Kagawad ____________________, the Sangguniang Barangay, after due deliberation, agreed
that:
PREFATORY STATEMENT
WHEREAS, acts of disturbance to peace and order in the barangay have aggravated to
the detriment of the peace-loving members of the community;
WHEREAS, it is the objective of the Barangay Government to instill among the
members of the community the values of discipline and respect for others which may only be
achievable if troublemakers are aptly penalized;
BE IT, therefore, RESOLVED, as it is hereby resolved to enact the following Barangay
Ordinance, to wit:
BARANGAY ORDINANCE NO. ______, S. OF 2021 AN ORDINANCE IMPOSING PENALTIES ON
ACTS CAUSING DISTURBANCE TO PEACE AND ORDER IN THE BARANGAY BE IT
ORDAINED by the Sangguniang Barangay of Barangay Poblacion 2, Sta. Magdalena,
Sorsogon, that.
Section 1. Title – This Ordinance shall be known and cited as “Barangay Peace and Order
Ordinance of 2021”.
Section 2. In addition to sanctions that may be imposed by the court, a penalty as
determined in Section 3 hereunder shall be imposed upon any person who willingly,
intentionally or unintentionally, knowingly or unknowingly, whether alone or in conjunction
with another person, disturbs the peace and order within the jurisdiction of Barangay
Poblacion 2, Sta. Magdalena, Sorsogon through the commission of any of the following act or
acts, to wit:
A. Quarreling or fighting in public places;
B. Creating extremely distracting, annoying loud noise;
C. Causing unruly, boisterous, tumultuous stir;
D. Creating commotion; Other act or acts hindering or disquieting of another person in
the lawful and peaceable enjoyment of his right.
E. Curfew Hour Violators

Section 3. The penalties for disturbing the peace and order in the Barangay shall be as
follows; First Offense Second Offense Third or Subsequent Offense ---- fine of 4 hours’
community service ---- fine of P 500.00 or 8 hours’ community service ---- fine of P 1000.00 /
48 hours community service or to be turned over to the higher agency.
Section 4. The offender, however, with the approval of the Punong Barangay, may elect to
perform community service work under the supervision of the Punong Barangay instead of
paying the fine at the rate of four (4) hour community service work for every P 100.00 fine.
Section 5. Any person complained of for committing acts of disturbance to peace and order
as enumerated in Section 2 hereof and apprehended while under the influence of liquor may
be brought immediately to a Municipal Police Station. Any person found thereat to be under
the influence of illegal drugs shall be immediately prosecuted.
Section 6. The Punong Barangay or any member of the Sangguniang Barangay is hereby
authorized to file the necessary and appropriate case in court against any person for any
violation of existing laws or ordinance in support or independent of the offended party/ies.
Section 7. If for any reason, any section or part of this Ordinance is declared not valid by a
Court of competent jurisdiction or suspended or revoked by the Sangguniang Bayan, such
judgment shall not affect or impair the remaining sections or parts thereof which shall
remain or continue to be in full force and effect.
Section 8. All barangay ordinances, rules regulations, or parts thereof, in conflict with or
inconsistent with any provision of this Ordinance, are hereby repealed, amended or modified
accordingly. Section 9. This Ordinance shall take effect immediately after posting in at least
three conspicuous places in the Barangay. ENACTED and APPROVED by the Sangguniang
Barangay this 16th day of January, 2021 at Barangay Poblacion 2, Sta. Magdalena, Sorsogon.
