AFFIDAVIT OF ARREST

I, PMSg Jack Ryan, of legal age, married, PNP member of Baguio City
Police Station and resident of Poblacion, D City, Benguet with law, do hereby
depose and say;

That I was assigned as Intel Operative of Baguio City Police Station with
variable tour of duty where my duties and responsibilities includes arrest
criminals, respond and investigate incident reported in our office, to conduct
surveillance and monitoring of all illegal activities in our Area of Responsibility
and to do any other function as directed by my higher officer;

That on or about 7:00 AM of July 25, 2020, while on duty, my Team

Leader PEMS Jason Bourne, instructed me to came in main office of Baguio
City Police Station to conduct follow up investigation to the alleged abandoned
tricycle loading assorted iron steels that transpired at around 2:00 AM on July
25, 2020 particularly at MMK City Mall Fishpond 1, located in New De Venecia
Road, Lucao District, Baguio City, Benguet;

That, at about 8:00 AM of July 25, 2020, we together with our Team
Leader PEMS Dispo, MMK Warehouse Club Inc., representative Carlito O.
Ocampo and Guard on Duty Jesse James conducted follow up after the
latter’s had information that they predictable the alleged owner of said
abandoned tricycle (garong);

That, at about 9:00 AM of July 25, 2020, particularly at Calarin St.,

Malued District, Baguio City, Benguet, S/G Jesse James, stated to me when
he was conducted roving patrol in his area of responsibility, he noticed Six (6)
persons taking iron and loading it in a motorized tricycle with yellow side car
and in a tricycle (garong);

That, Jesse James, further claimed that Three (3) of the Six (6) persons
immediately fled toward south direction leading to MC Arthur Highway on
board the loaded tricycle with assorted iron bars when they noticed him
coming while the three others scampered in different directions leaving the
tricycle (garong) loaded with iron;

That, Mr. Stephen James recognized the said tricycle (garong) to be

owned by Frank Marquez, a resident of Calarin St., Malued District, Baguio
City, who is engaged in a Videoke for Rent business and is being used in
loading the rented Videoke;

That, when proceeded to Sitio Calarin, Malued District, Baguio City,

Benguet with PEMS Dispo, Security Guard Jesse James and Stephen James
purposely to confront Frank Marquez about the involvement of his tricycle
(garong);

That, upon arrival at Calarin St., Malued District, this City and before
reaching the house of Frank Marquez, Security Guard Jesse James pointed to
us a parked motorized tricycle beside a house to be the same tricycle used by
the three who managed to escape;

That, we immediately alighted and saw three persons aiding one

another cutting iron sheets with the use of angle grinder just at the back of
said tricycle with yellow sidecar;

That, when we confronted a woman who was watching the three

suspects cutting the iron sheets she identified herself as Jackielou Dalioan
and admitted to be the owner of the house and tricycle with yellow sidecar that
was identified by Security Guard Jesse James as the same tricycle used in
the escape of the three suspects;

That, SG Jesse James identified the three (3) to be the same persons
who managed to elude arrest with the use of said motorized tricycle and when
asked about their identity, they identified themselves as Benedick C. Calaguin,
Rodel C. Esguerra and Vic I. Flores;

That, we were surprised to discover plenty of iron sheets of different

sizes dumped at the back of the house of Jackielou Dalioan;

That, Jackielou R. Dalioan, Benedick C. Calaguin, Rodel C. Esguerra

and Vic I. Flores were taken into our custody with the PCP 5 Personnel
composed of PCpl Zhaldy Doctololero while SG Jesse James, Mr. Stephen
James together with PEMS Bourne proceeded to the house of Frank
Marquez, the owner of abandoned tricycle (garong);

That, moment later, police mobile came with Investigator Police Staff
Sergeant Virgilio Quezon to conduct spot investigation issued confiscation
receipt as witnessed by Brgy Kgd Rogelio Z. Solomon;

That, the confiscated iron sheets and angle grinder later I marked with
GUD 07-25-2020 and two angle grinder blade later I marked with GUD 1 to
GUD 2, one motorized tricycle Motorstar STAR X155-V owned by Jackielou R.
Dalioan were brought to the Baguio City Police Station along with the seven
(7) arrested suspects;

That, during the interrogation we made on the Seven (7) arrested

suspects, Vic Flores and Benedick Calaguin led us to MJC Junkshop located
at Herrero St., Baguio City as the place where they have repeatedly sold
stolen iron sheets at the MMK compound;

That, upon arrival thereat they pointed to a woman whom they claimed
to be the person whom they sold stolen iron sheets in several occasions.

That when the woman was confronted by PEMS Bourne she readily
admitted to have bought iron sheets with more or less 200 kilos a day before
and paid it in the amount of Php 2, 000.00 which was confirmed by Vic Flores
and Benedick Calaguin;

That, the woman identified herself as Shirley Co y Nicolas, 52 years old,

married, and resident of 146 Herrero St., Baguio City, who admitted to be the
owner of the said Junkshop;
 That, Shirley Co surrendered the iron sheets she bought to us and a
corresponding confiscation receipt was issued and witnessed by Jerry T.
Perez and Federico E. Bunzo both Barangay Kagawad of Herrero-Perez,
Baguio City, Benguet;

That, we apprehended/arrested them (aforesaid suspects) and informed

the nature of their offense and apprised them of their constitutional rights in a
dialect which they fully understood then endorsed them to the Baguio City
Police Station Main Office located at AB Fernandez Ave., Poblacion, Baguio
City, Benguet after they undergone physical and medical examination for
further investigation and proper disposition of the case;

That, I am executing this affidavit to attest the truth and nothing but the
whole truth in the premise and to file the appropriate criminal charges against
the above named persons;
