ಕಾನೂನು ಮೂಲಕ ಸ್ಥಾಪಿತ ವಾಗಿರುವ , ಭಾರತದ ಸಂವಿಧಾನಕ್ಕೆ ಸತ್ಯ , ಶ್ರದ್ಧೆ , ನಿಷ್ಠೆ ಯನ್ನು ಹೊಂದಿರುತೇನೆ .

ಭಾರತದ ಸಾರ್ವಭೌಮತ್ವವನ್ನು ಹಾಗು ಅಖಂಡತೆಯನ್ನು ಯೇತಿಹಿಡಿಯುತೇನೆ ಯಂದು ಶ್ರದ್ಧಾ ಪೂರ್ವಕವಾಗಿ

Honourable madam speaker with the prior permission of yours I take this opportunity to
highly acknowledge for the immense contribution of the respected members of the house
and for having served me with the opportunity to come up with a true and fundamental
faces concerning the domain of these crimes . under this worthy ministry of law and justice
propose is negation of certain practices which end up being derogatory on part of certain
individuals that contradicts the basic essence of equality and fairness that stands
established by the law of the land , prime reason for this is to curb the menace and disorder
that these practices might create over passage of time . madam speaker the problems the
domain of law faces in India is that we develop in society but the societal regulatory force
fails to match up with the growing pace . the provisions that seek to morally police the
personal marital decisions has continued without any progressive amendments since it was
drafted in 1860 lord Macaulay.

Madam speaker with immense grief I have been forced to state that what our system
witnesses is the tantamount subordination of women to the so called patriarchal system .
अदर्निय्या अध्याक्ष मोह्योदा हम महिला और नारी सशक्तिकरण की बात करते हैं परंतु मुड्डा की बात ये है की हम पितृत्त्वमकट की है घुन से अब
तक निजात नही पी। हम आसा के सद्दासन को बाटाना चहते हैं की हूरी सरकार परम मेहतवा विक्तिवा के एक मूक को देती है और प्रत्यायक
विक्ति के कल्याण को परम धरती है।

What we witness is that under the ambit of law the conceptual element concerning the
person’s the individuality has been sidelined and ignored the same gets strongly linked with
marital rape. What it is is that it is simply a social morality clause saturated with patriarchal
ideas of subordination of women with the resultant inequality and constitutional
immorality. Sidelining the fundamental right of a women’s dignity the stage we have
reached is that the women have been made to a simple property in the hand of her husband
eliminating all probable causes of individuality and of consent, the exception that section
375 carries with itself has contradicted the brutality of the heinous crime which has been
derogatory to societal norms . this section stands in contradiction with the other sections of
penal code under which no specific characterisation of husband has been made as a
defence, one such offence being the offence of sexual harassment.

The brutality of the offence of rape can not be compromised and be ignored. The deterrent
effect of the punishment concerning this offence has to be the prime consideration and
based on the deterrence theory we focus on preventing the commission of this offence by
making it brutal.

Moreover when offence of adultery falls in question that stands out to be a matter of
privacy in which combining it with the ambit of betrayal and abuse to the institution of
marriage always proposes our constricted and underdeveloped psychology. Under this the
individuality stands respected and the matter of consensual act propagates the essence of
liberty as conferred in the Constitution of India.

As far as the punishment of rape is concerned the sanction of death penalty must stand
established as on what grounds are we intending to confer human right on those offenders
who are themselves not humans.
