1. Summarize the process and the requirements in undertaking
researches on (Indigenous Knowledge Systems and Practices (IKSPs ) as
provided and spelled out in the NCIP Administrative Order No. 1 Series of
2012 and illustrate the same in a schematic diagram. (step by step
process illustration ).20 Points

As drawn in Schematic Diagram, there are requirements in conducting research concerning the
Indigenous People. The first requirements that I've placed was the informed consent. The
informed consent is so important because it indicates requisition and waiver. The protection of
community intellectual rights, cultural resources or treasure is one of the requirements that a
research must apply because you can't conduct a good research if you don't respect the
intellectual and cultural rights of the IPs; this is connected to culture sensitivity and privacy,
researchers must secure all the data collected. Next is the Application and Payment Fee, there
must be filing of application and paying fees before proceeding in research activities as stated in
the methodology. Overall, the most important is the application of the NCIP Law, there are
guidelines to follow, and these will make the research more secure and successful.

Moreover, there are processes and methodology. First is filing application and payment of fees.
As stated in the law, Researchers/project proponents shall file with the concerned
regional office the accomplished application form and paying therein the
required filing fee in the amount of Five Hundred Pesos. And then, the management
will review and evaluate the application. This will be done with the assistance of the
Regional Legal Officer, shall review and evaluate the application, attachments
and other supporting documents to determine the sufficiency thereof. If on the
basis of objective evaluation, the research work proposal is lacking in material
points or there is a need to revise the same to make it culturally appropriate, it
shall be communicated and remanded to the researcher for compliance. And
then the Grounds for denial, so the officer will deny the grounds on any of the following, The
research involves the intrusive and actual experimentation of human persons
that will pose an imminent threat to their life and limb; It involves the
excavation or destruction of sacred places or worship grounds or other
culturally sensitive areas restricted by tradition; Those that may violate the
rights of ICCs/IPs. The next would be IKSP Team will assist conducting the research upon
the approval of the director. After which, they proceed to transmittal, there are two ways,
either sufficient or insufficient application. So there are alternative ways. And then, after the
Transmittal, they are now ready in planning for work and financial matters. Then , they will
proceed in collecting the data through conference and disclosure. After collecting the data, next
process will be the initiative of the institutions and oragnization which includes the community
decision making, MOA preparation, negotiation and signing, contents of memorandum
agreement, submission of report, and issuance of the certification for precondition. If the they
did not reach the time frame, the management will extend their time and validate their
outputs. Afterwards, they will make a certification for validation then submit it to the director
or the institution. And last process will be the Ultimate validation where the regional offices will
validate and evaluate the output.

2. Discuss the effect of this Law to the students and Faculty Researchers, its advantage and
Disadvantages.

As with any other method in the academic field, there are various advantages and
disadvantages of this law to the students and faculty researches. A survey, evaluations and
monitoring the researches provides a method suitable for a number of topics and
specializations in different areas of knowledge. Hence, the nature of the topic and the outcome
sought decide what provides the most suitable method to collect data. Furthermore,
considering the research methods used or stated by the NCIP, as best methods to gather the
largest amount of data from participants. Using those methods and processes, researchers can
obtain different types of data such as beliefs, opinions, behaviors, and attitudes of Indigenous
People.
As its advantages to the students and faculty researchers, the Law aims researchers to have a
systematic and well-organized research activities as its methodology follows. The processes in
conducting research concerning the IPs has fully secured as it protects both the researchers and
the participants. And then, with its law operating principles, students and faculty researchers
pratice participatory, respect to IPs, respecting their custody and etc.

In the other side, the disadvantages of this law. Researchers will have difficulties in time
management because the law processes and methodology was elongated; it has too much
processes. Instead of using their time directly in doing research activities, they will first
spending their time in filing application, paying fees and making letters for approval. Yet this is
in general, it depends on the researches on how they work and manage their time.

Therefore, yet NCIP has good purpose because they strictly protect the right of IPs and
researchers. The methods will be considered as legalization and recognition to everyone.
Hence, the Law is Law, we can't deny the fact that this will be strictly implemented to maintain
peace and good management.

3. Summarize the objectives of the NCIP Administrative Order no.1

The First objectives of the law concerns with ethical standards for the conduct and
implementation of research concerning the IPs. It means that researchers must have respect
and follow the guidelines of NCIP to protect and secure the information and data of Indigenous
People. Next is, Establish a framework for the conduct, monitoring and evaluation
of researches concerning ICCs/IP. There must be a framework or supporting structure or
plans to conduct and evaluate the data, in a sense that embracing the laws. Then, set the
requirements and procedures for ensuring the free and prior informed decision
of the ICCs/IPs on any research activity affecting them. There will be free
participatory and well informed consent of IPs especially in their desicion making.
Establish a community registry and/or IP databank to safeguard products or
outcomes including derivatives. Institutionalize the sustainability of indigenous
knowledge systems and practices and customary laws. Lastly, Identify, recognize
and appropriately register the ownership of IKSPs by the ICCs/IPs or the IKSP
holders and determine the applicability of customary laws. These three least
concerns with organizational and intitutionalize basis. Researchers must ensure the security of
the researches including the evaluations, data, surveys, and also the ownerships of the IPs.

4. Recommend policies that will be adopted by ASC management to help


students and faculty researchers on IKSP in relation to this law . 10
Points.

The NCIP law have developed law in order to protect the rights of Indigenous People. And these
laws are completely adequate particularly in conducting researches. The following statements
are my recommendations regarding policies that will be adopted by Apayao State College
Management to help students and Faculty researchers:

 That each department form a working group to reflect on current practices, the values
they promote, and changes in practices that would improve education and research,
particularly with respect to the specific research conducted by members of that
department.
 That each department designate individual faculty members to serve as advisors and
informal mediators.
 The department head submit all proposed plans and procedures for inquiries into
allegations of research misconduct for approval before the process is initiated; that the
process to be followed in conducting inquiries and investigations be the responsibility
of a specially designated individual(s) in the NCIP ; that the person(s) so designated be
responsible for developing guidelines to be followed in carrying out inquiries and
investigations.
 Ensure a supportive environment for individuals who come forward with concerns
about research conduct, and that specific provisions to ensure the protection of
complainants who act in good faith be a part of the plan for conducting an inquiry into
allegations of research misconduct and be submitted to the ASC management before
the inquiry is initiated.
Therefore, I believe that the establishment of our management represents an opportunity for
the IP community to engage in discussions about the shared values it holds in the conduct of
research and in the education of students, and I recommend that the ASC management/ faculty
and administration make explicit their commitment to academic integrity and to the
establishment and maintenance not only of proper research conduct but also of an
environment in which both research and teaching can be carried out effectively.
