Subject Creation of DOE-VFO Mini-BAG and its proposed Composition

I. INTRODUCTION

1. This memorandum pertains to the request for the creation of the Mini-BAG in
the Visayas Field Office (VFO)

II. MANDATE

2. The Visayas Field Office implements regional policies, plans, programs and
regulations of the department relating to energy resource exploration and
development, judicious and efficient utilization of energy resources, ensures
adequate, efficient and reliable supply of electricity, and monitors
development in the downstream oil industry with due regard to the
environment and sustainable energy development in the Visayas.

III. FACTS

3. Section 11.1.1 and Section 11.1.2, RULE V (Bids and Awards Committee) of
the 2016 Revised Implementing Rules and Regulations of Republic Act 9184,
 otherwise known as the Government Reform Procurement Act, provides, to
wit:

11.1.1. Each Procuring Entity sha'l establish in its head office a single BAC to
undertake the functions specified in Section 12 of this IRR in order to facilitate
professionalization and harmonization of procedures and standards. In line
with the standardization of procurement procedures and the thrust towards
strengthening the procurement function to increase operational efficiency and
effectiveness, Heads of Procuring Entities shall aim to consolidate or unify all
procurement activities of the organization, whether locally-funded or foreign-
assisted, and whether pertaining to Goods, Infrastructure Projects or
Consulting Services.

11.1.2. However, to expedite the procurement process for practical intents

and purposes, the HoPE may create separate BACs where the number and
complexity of the items to be procured shall so warrant. The BACs may be
organized either according to: (a) geographical location of PMO or end-user
or implementing units of the Procuring Entity; or (b) nature of procurement.
Similar committees for decentralized and lower level offices may also be
formed when deemed necessary by the HoPE.

4. With the mandatory retirement of the former Director Antonio E. Labios of the
Visayas Field Office last 08 November 2017, the VFO has not successfully
created the "VFO Mini-BAC" due to the absence of the Head of the Procuring
Entity (HoPE).

5. On 24 January 2020, I assumed office as the Director of the VFO. As the

Director, I would be the Head of the Procuring Entity (HoPE) for the VFO's
Mini-BAC.
