for
Consultancy Services for updating Feasibility Study, Detail Engineering Design, Bidding Services
and Construction Supervision and Services during Defect Liability Period for “Construction of
Double Line Track in Khulna-Darsana Junction Section of Bangladesh Railway”

1. Background
Khulna-Darsana Junction is a single line section in Dhaka-Khulna Corridor. The section is common to
Khulna-Dhaka, Khulna-Chilahati and Khulna-Rajshahi route. All these routes are of vital importance
to BR; the first being the lifeline for goods transportation and regional connectivity.The line capacityof
the section has long been saturated. Growth of railway transport in the Dhaka-Khulna corridor is
being greatly impeded due to this capacity bottleneck. The project aims at constructing a second
railway track (126.25 route-km) between Khulna and Darsana Junction for double line operation of
train services in the section. This will improve efficiency and quality of train service and will enable
BR to cope with the increasing demand for railway transport.

There exists shortage of electricity in the country and demand of electricity has been increasing
every year. Economic development cannot be ensured without adequate supply of electricity. The
Government of Bangladesh has taken initiative to install oil-based power plant through quick rental
and picking power plant by Bangladesh Power Development Board at which BR is to transport
different types of fuel. These power plants are located at Harian, Bheramara, Shantahar,
Bangabandhu West Station, Amnura, Faridpur, Thakurgaon, Rangpur in the Western Zone of
Bangladesh Railway. Additionally, there has been enhanced demand of fuel supply at Bheramara
Power Plant. Bangladesh Railway also transports fuel to meet the irrigation & other demand at
Rajshahi, Natore, Rangpur, Parbatipur and Saidpur. The consumption of fuel for many purposes is
increasing everyday and everywhere of the country.

Presently, the Chittagong Port, the main seaport of the country is handling majority of the Export
and Import Cargos. For easing, the Congestion in Chittagong port and balanced development of the
country the Mongla Port needs to be improved as well. For transportation of containers and bulk
cargos Mongla Port needs to be connected with railway network. A project named “Construction of
Khulna-Mongla Port Rail Line with Feasibility Study” through which 53 KM new BG track are on going
and connectivity shall be attained with existing railway network. After execution of this project
neighboring Land Lock countries Like Nepal & Bhutan will be able to utilize Mongla Port facilities.
Industries of Uttara EPZ, Niphamari&Ishurdi EPZ will also use Mongla Port facilities for importing raw
materials and exporting their products by railway. Besides, import and export of commodities via
Mongla port using railway connectivity would increase in the coming years.

Bangladesh Railway is not in a position to cater aforesaid present and future demand because of
existence of single line track. To meet up all the enhanced demand, construction of double line track
in between Khulna and Darsana Junction would be a formidable solution.

2. Objectives of the consultancy services


The objective of the consultancy services is to conductupdating feasibility study, prepare detailed
design of all structures like bridges, railway embankment, track, stations & yards, signaling system,
including preparation of estimates, drawings, specification and tender documents. The consultancy

service also includes the construction supervision & management of the project. Specifically the
Consultancy services will perform the following tasks but not limited to:
Ø Conduct detail topographic & hydrographic survey; prepare for the project.
Ø Identify the possible alternative alignments & recommend the best suitable alignment for
the project.
Ø Find out whether the project will be technically, economically, financially, environmentally
and socially viable.
Ø Prepare Initial Environment Examination report, Environmental Impact Assessment,
Environmental Management Plan & Environmental Monitoring Plan etc. Prepare Land
Acquisition Plan and Resettlement Plan.
Ø Conduct detailed engineering survey including sub-soil investigation along the alignment, at
bridge locations. Conduct hydrological & morphological survey for major bridges.
Ø Prepare detailed engineering design and drawings of all infrastructures including bridges,
embankment, railway track, stations, signaling and all other facilities.
Ø Prepare detailed cost estimate on the basis of the detail design and drawing and verify the
same with the DPP. Also prepare the RDPP if required.
Ø Prepare tender documents following the governing law of Bangladesh and as per terms and
conditions of loan agreement.
Ø Provide tendering services of all sorts including preparation of RFP, selecting contractor, bid
evaluation, award of contract, contract negotiation and finalizing the contract documents.
Ø Assist the Project Director for expeditious acquisition of land required for the project;
Ø Provide resettlement implementation services comprising payment of resettlement
Compensation to EPs, Property Valuation and Grievance mitigation etc;
Ø Implement resettlement plan.
Ø Employ sub-consultancy services with necessary approval from employer/ client.
Ø Assist in clearance of Construction Right of Way (CRoW) so that site can be handed over
timely to the Contractor as per site access plan;
Ø Assist in relocation of various utilities and keep liaison with utility service providing agencies;
Ø Review of Investigation, Survey, Detailed Working Design, drawings and design calculations
for construction works submitted by the Contractor and recommend and ultimately submit
to Employer's Representative for approval;
Ø Provide technical support associated with approval of contractor submissions, proposal for
design modifications as well as for overall testing and inspection of the Works;
Ø Review of detailed methodology, quality assurance plan, detailed work schedule,
environmental management plan, safety assurance plan etc. submitted by the Contractor
and recommend and ultimately submit to Employer's Representative for approval;
Ø Supervision of all Construction Works following the conditions of contract;
Ø Consultant shall monitor, inspect construction works and ensure proper implementation of
Construction Works following the working design, methodology and quality assurance plan
approved by Employer's Representative;
Ø Supervision of all Construction Works ensuring safety of train operation following the Codes,
Rules, Regulations and manuals of BR specially in existing railway lines;
Ø Review of IPC submitted by the Contractor and recommend and ultimately submit to
Employer's Representative for approval and further necessary actions;
Ø Consultant shall monitor and ensure proper implementation of safety assurance plan;
Ø Consultant shall monitor and ensure construction works is done following detailed work
schedule and if needed take necessary action to revise the detailed work schedule;
Ø Preparation of Progress Report(s);

Ø Provide technical support associated with approval of contractor submissions, proposal for
working design, design modifications, specifications as well as for manufacturer's inspection,
overall testing, installation and commissioning of Signaling and Telecommunication Works;
Ø Arrange weekly coordination meeting at site and monthly progress review meeting at the
office of Employer's representative;
Ø Arrange training for Transfer of Technology related to the construction, operation and
maintenance of the new structures, facilities and carriages;
Ø Organize Overseas Training/Study tour;
Ø Prepare necessary documents and drawings for application for GIBR approval;
Ø Forecast the disbursement of construction and consultancy package to prepare annual
budget, revised budget, 3 years projected budget form MTBF etc;
Ø Provide technical and management support to PIU including defect liability period.
Ø Assess the requirement of new rolling stocks on the basis of traffic forecast and phasing of
procurement along with cost estimates.
Ø Prepare operational procedure for the new railway track following the guidelines of
Bangladesh Railway.
Ø Plan to meet 75% Indian content requirement.
Ø Any other tasks required and assigned by the employer for smooth and successful
implementation of the project.

3. Detailed Scope of Consulting Services


The following will be undertaken for each phase of the project
3.1. Phase I : Updating Feasibility Study, Detailed Engineering Design and Tendering
Services:
3.1.1. Updating Feasibility Study:
Updating Feasibility study of the project will include all sorts of physical surveys and determination
of the viability of the project. The study in detail shall cover the following tasks but not limited to:

(i) Detail Topographic Survey:

• Conduct Detail Topographic survey using latest technology and equipments (e.g. RTK- GPS, DGPS,
Total Station etc.) along the project area to identify suitable alignment;
• Processing and analysis of collected data according to the requirement;

• Propose possible alternative alignments for the project;


• In identifying alignment safety of the running train, roadway vehicle, passengers, pedestrians,
surrounding infrastructures should be carefully considered;

• Create a video document along the alignment showing surroundings. Image of the alignment
should also be taken;
• Producing map showing important details. Scale of the map should be such that all the required
information is clearly visible;
• Produce strip map for both sides of the possible alignments for a distance 100 m (One hundred
metre). Strip map should show buildings (including type of buildings), road, bridge/culvert,
electric pole, mazar, grave yard, playing field, cultivable land, fallow, pond, canal, river or

whatever fixed or semi fixed structures that needed to be shown on the map for informed
decision;

• Recommendation for best suitable alignment duly considering the topography, land formation,
commercial aspects, economical and safeguard considerations, existing infrastructures of the
area, ongoing and future development plan and schemes of both the Government of Bangladesh
and Private sectors in the area;
(ii) Hydrographic Survey for Hydrological &Morphological Studies:
• Collecting bank line/ bathymetry/ cross-section and sediment data of the major rivers to be
crossed by the proposed rail line;

• Collect water level and measure discharge of the major rivers adjacent to the proposed rail track
and other hydrographic survey if needed;
• Survey (both topographic and hydrographic) should be conducted in close collaboration with the
consultant to be appointed forupdating feasibility study & detail design.

• Processing and analysis of collected data and assessment of existing hydrological and hydraulic
conditions of the project area;
• Collect available hydrologic and hydrographic data and maps and satellite images of the project
area (from secondary sources);
• Selection of location of bridges;

• Developing two-dimensional morphological model for large rivers to be crossed by the rail line
to facilitate construction of required bridges (bridge length more than 100m) with hydraulic
design parameters;
• Identifying possible threats on the bridges due to hydro-morphological processes of the rivers
including river bed and bank erosion;
• Identifying mitigation measures to be taken for the proposed rail bridges to counteract
anticipated adverse situation; and
• Reporting.

(iii)Traffic forecast:

• Conduct detail traffic survey and collect both primary and secondary data to find out actual
demand of transportation facilities in the section. Analyze the existing traffic (Both Passenger &
Goods) of various modes of transports. Identify possible traffic forecast duly considering various
development activities of the government and private entities;
• Find out what portion of the traffic demand can be met by existing railway infrastructures and
after implementation of ongoing projects;

• Find out what portion of traffic can be attracted by proposed double line between Khulna-
Darsana section;

(iv)Economic and Financial Feasibility:

• Economic and Financial analysis for the project is to be prepared in accordance with the
international standard practice and according to the guidelines of planning commission for
considering the project viable. Provide all analysis and calculations of costs and benefits of the
project to the executing agency. Prepare sensitivity and risk analysis in relation to changes in key
parameters.
• Assess the need and justifications of the proposed projects. Assess probable effects upon project
implementation including direct and indirect effects. Assess benefits of the proposed project,
not only in terms of financial or economical, but also in terms of safety, environmental impacts,
less transportation costs, poverty reduction, enhancement of trade and commercial activities
likely to be created as an outcome of the projects.

(v) Environmental Considerations:

• The project will have to be screened for its environmental impacts compliance according to the
Government’s Guidelines. The consultant will have to prepare Initial Environmental Examination
(IEE), Environment Impact Assessment (EIA) and Environment Management Plan (EMP) report
etc., as applicable for the project. All the documents will have to be inconformity with the
requirements of Department of Environment (DoE) and the consultants will also help BR in
getting clearance from DoE.
• The Environmental Impact Assessment (EIA) report shall cover but not limit to the following
major environmental and social issues:

Ø Human Interest
Ø Terrestrial Ecology
Ø Aquatic Ecology
Ø Physio-Chemical

• The EIA report will clearly identify the environmental parameters/resources to be impacted by
the project, make a quantitative or qualitative assessment of magnitude of each impact and
devise mitigation measures to eliminate or reduce adverse environmental impacts as well as
enhancement measures for the improvement of environment. The report will also contain a
monitoring program for continuous evaluation of situation during implementation and operation
of the project.
• The EIA Report must contain the following with others :
Ø Delineation of impact area
Ø Environmental Issues & Impact Analysis with sufficient explanations
Ø Quantitative assessment of environmental and social impacts (qualitative evaluation is
acceptable where quantitative evaluation is not possible)
Ø Mitigation measures/ plan for adverse impacts with provisions for environmental
enhancement

Ø Monitoring Plan/ Program


Ø Quantification of impact in each field should be supported by sufficient reasons and
calculations.

(vi) Social and Resettlement Services:

• Conduct social assessment and analysis according to GOB’s Guideline & international best
practices.It is to be noted that NGO will be engaged as a part of sub consultancy with prior
permission of competent authority (GOB).

• The objective of the Social Impact Assessment (SIA) study is to develop a Resettlement Plan (RP)
for the Project Affected People (PAP)and the social structure in the local area and the region.
• The Social Impact Assessment (SIA) study should be based on 100% census which covers a
complete enumeration of all Project Affected People (PAPs), their affected assets and income
restoration program etc. The study will reflect the existing socioeconomic profiles of the PAPs
through identification of the baseline social dimensions of the people and formulate plans to
restore the quality of life after implementation of the project. The study will develop database
for current situation and record of the probable impacts of the intervention as perceived by the
people themselves. The study will also identify all the possible impacts of a proposed project in
advance so that the required actions could be started well before the implementation begins.
The following broad items of work will be included in the SIA:
Ø Land acquisition survey
Ø Census
Ø Baseline socio-economic survey
Ø Propose compensation and budget for implementation of the RP.

• The output of SIA will include followings among others:


Ø Assessment of the existing socio-economic profiles of the people of the area.
Ø Assessment of the adverse socio economic impacts for the construction of the railway line.
Ø Assessment of the social dimensions needed to formulate plans to restore the quality of life
of the Project Affected Persons (PAPs).
Ø Submission of a Land Acquisition and Resettlement Plan (RP) for PAPs.

(vii) Socio-economic survey:

• The baseline socio-economic survey is to be designed to capture information on the PAPs’


(Project Affected Persons) resources, employment, and vulnerability. Define categories for
impact and eligibility of affected people for compensation and prepare a matrix of entitlements
covering compensation and other assistance for all types of impacts to fully replace lost assets,
income, and livelihood. Assess whether the compensation standards for all types of assets,
crops, and trees are based on replacement value and discuss in detail the valuation methodology
used. Identify specific measures for severely affected poor people, ethnic minorities, or other
vulnerable households. The survey data will lead to the development of management

information system (MIS) that will help consultation process and assist in planning and
implementation of any mitigation plan, if required to be taken into account against the affect.

• A benchmark video recording of the physical situation of the dwellings and belongings as well as
community assets will be conducted.

(viii) Project Location Map:


A project location map shall be prepared showing the RoWs of the proposed rail line,
surrounding areas likely to be environmentally and socially affected due to the project
interventions and topographic contours. The map, apart from delineation or international,
district and upazila boundaries, will depict physical features like major surface waters, roads,
railways, town centers, parks and reserves etc. The map will be prepared to appropriate scale
with necessary legends using computer program and the same be printed in A-3size paper for
incorporation in the reports.
(ix) Land Use Map:
A land use map shall be prepared illustrating existing land use including industrial, residential,
commercial, institutional and agricultural development in the project area. The map will he
prepared to suitable scale with appropriate legends using computer program and the same be
printed in A-3 size paper for incorporation in the reports.
(x) Land Acquisition Plan (LAP):
Prepare a Land Acquisition Plan (LAP) with cost that is acceptable to the Government in
compliance with the Requisition of Immovable Property Ordinance (1982) of Bangladesh and
relevant laws and regulations related to land acquisition and resettlement. Collect CS, RS (Mouza)
Maps & other documents and scan & digitize those maps, transfer them to an electronic
database and submit to the project authority on tracing cloth duly traced showing the rail route
plotted on it and minimum amount of land to be acquired. A mouza maps showing the proposed
alignment including acquisition and requisition boundaries, plot number, labels of mouza,
upazila and districts homesteads, angle at change of direction of alignment, and other physical
features shall be prepared using CAD program to suitable scale with appropriate legends for
incorporation in the RP report. The map will constitute a basis for calculation of land acquisition
and requisition areas of the affected plots at the pre-project condition.

3.1.2. Detailed Engineering Design &Estimation

This will include all sorts of physical investigations, preparation of detail engineering design &
estimate of the project, revising the DPP if required. It shall cover the following tasks but not limited
to:
(a) Conduct detailed soil investigation along the alignment.

i. Soil Investigation along the centre line of the final alignment will be carried out by Percussion
Method at the interval of 200 m up to the depth of minimum 20m. GPS ordinates of each bore hole
will have to be recorded and submitted along with the report. Laboratory tests for the bore hole at
every 500 m to be carried out are as follows:
§ Liquid Limit, Plastic Limit
§ Grain Size Analysis
§ Consolidation test to obtain Cc, Cv, K
§ Permeability Test

§ Unconfined Compression Test


§ UU Tri-axial Test
§ CD/CU Tri-axial Test
§ Other tests as required

Noted that at every 500 m interval above mentioned laboratory tests shall be carried out. However,
bore holes at other intermediate locations at the interval of each 100 m, liquid limit, plastic limit and
grain size distribution shall be carried out for identification of soil layers. Bore logs shall be prepared
based on visual observation at site and revised after performing laboratory tests.
At least 4 (four) seismic CPT with pore pressure dissipation test shall be done for the whole project
at SPT locations.

ii. Bore Hole at Culvert/ Minor Bridge:


Minimum 1 (one) bore hole along with respective Bore Log up to the minimum depth of 20 m at
proposed site of each culvert and Minor Bridge to be made. If the ‘N’ value and other guiding
parameters for design of foundation at the bore hole within 20m are found not to be
acceptable/satisfactory (i.e N < 12), then further 10m bore log to be made. GPS Ordinates of each
bore hole will have to be recorded for future reference and record.
iii. Bore Hole at Overpass/Underpass:
Minimum 1 (one) no. bore holes up to the minimum depth of 30 m at each abutment and pier of
proposed Overpass/underpass to be made. If the ‘N’ value and other guiding parameters for design
of foundation at the bore hole within 30m are found not to be acceptable/satisfactory (i.e N< 12),
then further 10m bore log to be made. GPS Ordinates of each bore hole will have to be recorded for
future reference and submitted with the report. Recommendations for type of foundation, depth of
foundation for the structure to be mentioned in the report.

iv. Bore Hole at Major bridge(s):


§ For Major Bridge(s) such as bridge over the river Korotoa and Ichamati 1 (one) no. Bore
Log(s) by Rotary Method at each abutment and 1 (one) no. for each pier up to depth of 60-
70 m (below river bed) could be done taking into consideration the full brim width at SHWL.
§ However if sand layer of minimum 5m thick and consecutive 3 (three) ‘N’ values equal to or
more than (≥) 50 are not found within first 30m depth, then Bore log of next further 30m
could be recorded.
§ But if the stated sand layer of minimum 5m thick and consecutive 3 (three) ‘N’ values equal
to or more than (≥) 50 are observed within the first OR second 30 m depth, then further
boring could be discontinued by discussion with the concerned Geo-Technical Engineer,
Bridge Engineer and the Structural Engineer.
§ At least 2 (two) seismic CPT shall be done up to 30m at one abutment and at one pier.
§ In case of other Major Bridge(s) same procedure and methods to be maintained. GPS
Ordinates of each bore hole will have to be recorded for ready reference and future record.

v. Bore Hole at Station Premises:

For Station premises, Inspection & Maintenance Shed Area, Wash Pit Area, and Platform area
number of Bore Hole by Percussion Method will be minimum 1 (one) No. up to minimum depth of
20m or as required for each 200 Sqm area. GPS Ordinates of each bore log will have to be recorded.
Tests as mentioned in Clause 1.2.(a) (i) above will have to be carried out.
vi. Bore Hole at Foot Over Bridges (FOB) Area:
(b) Deployment of experienced Soil Investigation firm:
Professional Soil Investigation Firm/organization having sufficient tools & equipment along with
sufficient logistic supports will have to be engaged for the assignment of Soil Test. If required,
discussion might be made with Project Director in connection with engagement of well experienced
Soil Investigation Firm/Organization.

(c) Detail Design of all the structures. This will include design of embankment, railway track, bridge,
viaduct, stations and yards, water supply system, signaling and telecom, facilities for rolling stocks
(carriages, Locomotive, BFCT etc), residential & functional buildings, other facilities and electrical
design of station building and other infrastructures.

(d) Dynamic analysis of the main bridges, viaducts & other structures should be performed where
applicable according to the international best practices.
(e) Stability of all the structures should also be checked against earthquake & wind loads where
applicable according to the international best practices.
(f) Prepare detail cost estimates for the proposed project, showing foreign exchange, local
currency, tax and duty elements etc. Cost estimates will be conducted keeping in view of the
international trends in price fluctuation and exchange rates, international shipping rates and
steel prices, which are undergoing rapid changes.
(g) Economic and Financial Analysis of the project based on the cost of detail design.
(h) Assist Project Director in revising the Development Project Proforma (DPP) based on the
detailed cost estimate, if required.
(i) Preparation of construction work plan in detailed.
(j) Preparation of list of man-power required for operation and maintenance of the infrastructure
to be developed under the project.
(k) Preparation of the list of tools & equipment including modern equipment as well for smooth and
easy maintenance of track to be developed under the project. Also to design and
recommendation about the requirement of P.Way maintenance Workshop and its man-power
along with formulation of organogram.
(l) Multiple Power Point Presentation on the potential Final alignment, Detail Design to be
organized in presence of BR high officials to get feedback and incorporate their comments
accordingly for finalization of alignment and detail design.

Note: Noted that reasonable and suitable modification(s) or correction(s) of any design made by
the Consultant if required or unavoidable as a result of site requirement during construction phase
will have to be carried out without making delay in work by the Consultant as per instruction and
approval of the Client without any further financial claim.
(m) Revise the Development Project Proforma (DPP) based on the detailed cost estimate if required.
(n) Preparation of construction work plan in detailed.
(o) Incorporate comments from client and finalize report.

3.1.3. Preparation of Bid Documents and provide bidding services

Tasks under this sub-clause shall cover the followings, but not limited to:
a) Preparation of bid documents for International competitive bidding based on the
format of Standard Tender Document, prepared and published by CPTU, Bangladesh,
governing law of Bangladesh; and terms & condition of loan agreement (LOC-3) and
as per direction of the executing agency (Project Director). Bid documents shall be
based on international competitive bid (ICB) procedure under the guidelines of
standard Tender Document of CPTU and as per direction of the executing agency.
b) Prepare bills of quantities (BOQ) of all designed components based on detailed cost
estimate prepared on the basis of rate analysis. Bill of quantities and tender estimate
would be determined accordingly.
c) Incorporate the recommendation of Environmental Mitigation Plan (EMP) and Social
Impact Assessment (SIA) and SMP in the tender documents, if required Assist Project
Authority in submission of prepared land acquisition Plan (LAP) to respective Deputy
Commissioner office (Khulna, Jashore, Chuadanga) along with all relevant documents.

d) Provide bidding evaluation assistance services like Pre Bid Meeting, Bid Evaluation,
Award of Contract, Contract Negotiation and Finalizing the contract documents in
order to select contractor.

e) The scope of the services provided by the Consultant shall include all the services
required from the Employer's Representative and the services that would be outlined
and defined in the Conditions of Contract Document (CCD).

3.1.4. Transfer of Technology

Foreign Study Tour is a specific component of this assignment. The details of Foreign Study Tour are
Organize Study Tour in connection with transfer of Technology related to the construction,
operation and maintenance of new structures, facilities and carriages as stated below:
3. Technology Transfer by Foreign Study Tour:
H. Components of Foreign Study Tour:
a) The Consultant will arrange Foreign Study Tour in India or any other suitable
alternative(s) (to be decided by discussion with PD )
b) The Consultant will arrange orientation and physical site visit(s) on Grade Separation
(i.e overpass, underpass to construct L-xing free railway line), along with brief on design
& construction technique of Grade Separation.
c) Study Tour will also include orientation and physical site visit(s) with demonstration in
connection with construct modern station building and modernization of different
railway stations with ‘Pay Zone’ and ‘Non Pay Zone’ area and other modern concept
and passenger friendly facilities.

d) The Foreign Study Tour will include orientation and physical site visit(s) with
demonstration on modernization of safe, wide, spacious and comfortable platform
arrangement for crossing of tracks by the passengers (i.e movement
arrangements/facilities for passengers from one platform to another platform in safe,
convenient and comfortable means). That means safe, suitable and comfortable
alternative of FOB in the station area (i.e inbuilt FOB facility in the station building).
e) The Study Tour will also include orientation on LONG LOOP (iffoundfeasible) concept
including site visits and physical demonstration so that if possible the concept,
knowledge and technology gained could be implemented/ incorporated in the project
design work.
f) Orientation and physical site visit(s) to railway bridges constructed with state of art
having spectacular aesthetic view and design of beauty.
g) Orientation with CTC operation, positioning of trains by GIS or GPS including physical
demonstration and site visit(s).
h) Orientation with modern carriages (coaches with wide paned windows, swivel chair
seats, modern bio toilet system, Speed Monitor and other modern passenger facilities
in the coach) etc.
i) Orientation with electric traction and their different types including briefing on
feasibility for use in BR.
j) Orientation and physical demonstration on -
1) Modern track maintenance,
2) Track maintenance equipment in addition to tamping machine such as Ballast
Regulator/ Profiling Machine (with broom or without broom), Rail Mounted JCB, Rail
&Tyre Mounted Sleeper Replacement Machine and other similar type machines
frequently used in modern track maintenance work.
3) Physical demonstration on maintenance of the stated equipment and their
maintenance facilities (workshop, organ gram etc).
4) Orientation and Familiarization with advanced technologies in bridge maintenance
and Bridge Maintenance Facilities (workshop etc) with organogram etc,

B. Schedule of Foreign Study Tour:


Study Tour programme will be scheduled upon discussion preferably during Design
Phase(Phase-I) for suitable minimum 15-20 days or as suitably decided on discussion.
Reasons and justifications for such schedule are that knowledge and technology along with
potential output gained through the intended Study Tour are likely to be utilized in the
design of the project work.
C. Engineers, Officials to participate in the Study Tour (10 Nos. or 2x5 Nos. arrangement):
Project Engineers/officials, BR Engineers/officials, Representative from MOR & other
relevant Ministries, Technical Personnel involved in the project structure etc.

D. Duration of Study Tour : 15-20 days ( for 2 groups, each comprising of 5 personnel)

E. Venue of Study Tour:


Preferably in any India or any other Suitable alternative(s) place to be decided by discussion
with Project Director where the proposed components of the study tour stated in Clause-A
(a) to (j) could be covered with effective output.
Noted that, the Consultant shall discuss in detail with Project Director regarding stated
Study Tour Programme and arrange the programme accordingly.
F. Accommodation, Food & Transport Arrangements:
The Consultant will arrange standard-I type accommodation of the personnel.
Economy/Executive class air passage based on the grade of officials, Minimum 2-tier AC
berth or equivalent transport facilities. Food will be standard type as per individual’s food
habit.
G. Pocket Expenses:
The Consultant shall pay to each trainee pocket expenses per day at the rate of standard
rate during the tenure of the stay in the host country for Study Tour.

4. Local Training and Workshop:


The Consultant will also arrange following local training and Conduct workshops:
a) Arrange on-job local training to 10 (Ten) BR Engineers/officials for minimum 10 (ten)
working days on-
1) Modern Track & Bridge Maintenance and relevant Maintenance Equipment,
2) Orientation with Modern Track having level crossing free facilities (underpass,
overpass);
3) Maintenance of Major Bridges having steel superstructure with ‘H’ beam,
wooden sleeper and ballasted track.
4) Maintenance of track on embankment with weak subsoil.
b) Conduct at least 2 (two) workshops, to acknowledge design output to share and facilitate
transfer of knowledge, skills, and technologies in association with national and
international experts/institutions from home and abroad before finalization of FINAL
DESIGN REPORT.

However the Consultant will also arrange periodic presentations on gradual design development
in presence of Project officials and BR officials as in practice.

3.2. Phase II : Construction Supervision (Phase-II):


The scope of the services to be provided by the Consultant shall include all the services
required from the Employer's Representative (Project Director) and the services that would be
outlined and defined in the Condition of Contract Document (CCD). The services to be
provided by the Engineer shall cover the following categories, but not limited to:

3.2.3 Review of working detailed design and other technical support;

3.2.8 Post Construction Service.

However before starting and during carrying out the tasks stated above following issues and
pre-work to be taken in to account and accomplished accordingly

1. Developing systems and procedures to administer the construction contracts and ensure
that the contractual requirements, with respect to both quality and quantity of work in
accordance with the provisions of the construction contract. The consultant shall finalize
these JOB preferably in Phase-I or latest within 30 days of inception of construction
contract. This includes job related to proper accountable of the material both supplied by
the contractor and the old released one
2. Nominating TL as `Engineer’s Representative’ who will be full time in-charge in the field
for the Project. The consultant shall provide competent staff in full complement.
3. Contract Management, Administration and Planning of Construction work(s) grouped
under different packages
4. Supervision of Land Acquisition and Site Clearance including removal of structures, utility
shifting and installation of Temporary Demarcation Pillar to be maintained in well
planned and synchronized sequence so that full length or at least substantial length of
acquired land could be cleared well ahead of starting of Construction work (in connection
with fixing ‘Commencement Date’ of the Construction packages to avoid any contractual
obligation from the contractor’s end).
Noted that, successful site clearance simultaneous with /just after having land acquisition
completed is one of the strong preconditions to declare ‘Commencement Date’ of the
construction contracts. As such these important and sequentially integrated work
components to be planned, implemented and monitored meticulously.
5. Making all engineering decisions required for the successful and timely implementation
of the construction contract with intimation to/approval of the Project Director, as the
case may be.
However the consultant shall share and discuss with the Project Director regarding
updates of site work, especially any important/urgent issue if concerned.

6. Updating, adjustment of alignment and profile, location etc of embankment, track, bridge
& culverts by joint survey (i.e during confirmatory survey to be carried out by the
contractor) along with the contractor.
7. Updating of design & drawing of other different work components with respect to site
requirement, if required.
8. Ensuring compliance to all safety requirements while the work is in progress and to
ensure the safety measure taken by the contractor.
3.2.1. Contract Management, Administration and Planning:

The management, administration and planning of the Works shall be under the direction of
the Project Director and shall be carried out by qualified engineering specialists and office
support staff. The tasks shall consist of the following but not limited to:
i. Assist the contractor to evolve a system of Quality Assurance Plan (QAP), Control and
approval of the QAP and Procedure/methodology prepared by the Contractor, based on
the Contractor's schedule, as well as establishment of a detailed and computerized
Construction Scheduling and Cost Control System;
ii. Initial preparation of a detailed project schedule in bar chart form and critical path
showing all of the major activities and the critical links with the activities for the
implementation of the whole Project;
iii. Verify project schedule and detailed work plan submitted by the Contractor, Identify
critical path and ensure timely completion of project by re-scheduling the work plan, if
required;
iv. Periodic and regular updating of the work schedule to monitor the actual vs. planned
progress of the work and the inclusion of these updated schedules in the monthly reports;
v. Advising the Client(Project Director) on possible ways to accelerate the scheduled
completion of the Work and/or reduce costs where appropriate; and in a manner
consistent with the overall contractual arrangement between the parties, to provide the
same type of advice to the Contractor;
vi. Establishment and monitoring the implementation of guidelines for the appropriate
environmental protection measures and procedures to be undertaken by the Contractor
in accordance with the requirements as set out in Condition of Contract Documents (CCD);
vii. Convening of weekly/fortnightly coordination meetings at site with the Contractor,
Consultant and Employer's Representative (Project Director/ his representative) which
shall include the personnel of Contractor, Consultant and PIU. These meetings will be
held to discuss the day-to-day construction activities, to review the progress of the Work,
and to resolve any problems, including changes to the work plan, supply of materials,
quality control and compliance with the Specifications. The consultant shall prepare
minutes of the meetings and with the approval of Employer's Representative(Project
Director) provide copies to all concerns;
viii. Convening of monthly progress review meeting in Main Office with the Contractor,
Employer's Representative(Project Director/ his representative), PIU and Management
Support consultant, if any. The consultant shall prepare minutes of the meetings and with

the approval of Employer's Representative(Project Director) provide copies to all


concerns;
ix. Attend and/or prepare documents for Employer's Representative (Project Director) for
any periodic meetings such as meetings of Project Steering Committee, Project
Implementation committee, Financing Agencies, ERD and others;
x. Provision of timely notification and documentation of any changes or conditions that
may have an impact on the project schedule and/or budget, and including
recommendations on the relevant measures that could be taken to mitigate any negative
impact;
xi. Reviewing and processing for submission to the Client for his approval, all contract
documentation with respect to interim and final payment certificates;
xii. Preparation of the Certificate of Completion for the Work or any significant part or parts
thereof as provided for under CCD;
xiii. Management and coordination of the takeover, review and turnover of operations and
maintenance manuals submitted by the Contractor and/or individual suppliers;
xiv. Prepare project brief, status paper, power point presentation time to time as per
requirement of the Employer's Representative (Project Director) or donor agencies or
any other government agencies, as the case may be;
xv. Provide technical and management support to PIU during the construction supervision
period and the Post construction period.;
xvi. Preparation of detailed monthly reports, including charts, describing the construction
activity, progress of the work including the supply of materials being manufactured or
produced, current costs and cost projection to completion, problems solved and current
problems that remain unresolved, and any matters of an urgent nature requiring a
decision by the Employer's Representative(Project Director), Government of Bangladesh
and/or Financing Agencies;
xvii. Providing timely notification to the Employer's Representative(Project Director) of any
necessary actions with regards to the duties and obligation in relation to permits,
customs arrangements, approvals, relations with other agencies, coordination of
commonly used facilities, provision of the Site and associated facilities, and any
contractual commitment on the part of the Client to the Contractor under the terms of
the Contract;
xviii. Advise the Client about the adequacy of the Contractor's insurance policies, performance
bonds, indemnities, and ownership or rights to construction plant and equipment
required for the Contract;
xix. Maintain close coordination with the Contractor, Employer and consulting team
regarding railway operation management during linking new track with the existing one;
xx. Monitoring the Contractor's activities to ensure that there is full compliance with the
overall contract requirements for protection of the environment, including waste
management, and to maintain a proper record of such activity for inclusion in the
monthly reports. ;

xxi. Handling of construction disputes under the terms of the Contract;


xxii. Provide assistance in preparing revised DPP, if required;
xxiii. Forecast the disbursement of construction and consultancy package to prepare annual
budget, revised budget, 3 years projected budget form MTBF etc.;
xxiv. Carrying out any other duties required under CCD and as instructed by Employer's
Representative(Project Director);
xxv. Review and approval of "as built drawings" developed by the contractor.
xxvi. Prepare necessary documents and drawings for application for GIBR approvals;
xxvii. Maintain an archive of all the project documents, design, drawings, test results,
corresponds, minutes of meetings and photographs both hard copy and softcopy,
animation, videos, AutoCAD drawings etc. and handover to BR at the end of the project
or when requested;
xxviii. Commissioning of the Works.

3.2.2. Land Acquisition and Site Clearance


The scope of the work includes but not limited to:
i. Assist in keeping liaison with respective agencies for obtaining necessary clearance and
approvals towards acquisition of land following GOB’s existing rules and manuals;
ii. Assist in arranging meeting of different statuary committee as well as other committee
formed by GOB time to time relating land acquisition and assist preparing working papers
for the said meetings;
iii. The consultant will actively liaise on behalf of the Client (BR represented by the Project
Director) with other Govt. & non-Govt. bodies to hand over required land for this project,
if required;
iv. Assist in keeping liaison with DC offices to expedite Land Hand Over to BR;
v. Assist and supervision of installation of temporary land boundary after land handed over
by DC and section wise installation of permanent land boundary after section wise
completion of construction work;
vi. Assist in performing other tasks as given time to time by the client in the matter of Land
acquisition;
vii. Include present status of CCL in the Monthly Progress Reports;
viii. Arrange site visit and meetings, brief and status papers regarding implementation of
Land Acquisition Activities;
ix. Expedite site clearance for handed over lands of other Govt. and non-Govt. bodies and
newly acquired lands so that BR can provide site access to the Contractor as per site access
plan;
x. Assist in motivating affected persons and assist in clearance of Construction Right of Way
(CRoW) after land acquisition so that site can be handed over timely to the Contractor as
per site access plan;

xi. Provide all sorts of services required for utility shifting along the alignment;

3.2.3. Review of working detailed design and other technical support

The consultant shall provide sufficient qualified staff to carry out the necessary technical support for
working design review and proper execution of Condition of Contract Document (CCD). The staff
shall be under the direction of the Employer's Representative (Project Director) and the tasks to be
carried out shall include the following but not limited to:
i. Keep liaison with concern contractors of the project;
ii. Review of detailed construction methodology, project procedure manual including erection
procedures and sequences, quality assurance plan, detailed work schedule, safety assurance
plan etc. submitted by the Contractor and submit the recommendation to the Employer's
Representative for approval;
iii. Review of Investigation, Survey, Detailed Working Design, drawings and design calculations for
construction works submitted by the Contractor and recommend and submit the
recommendation to the Employer's Representative (Project Director) for approval;
iv. Review of working detail designs, drawings and design calculations along with methodology
and detailed work schedule submitted by the Contractor and recommend and submit the
recommendation to the Employer's Representative for approval;
v. Take advance action where GIBR (Government Inspector of Bangladesh Railway) approval is
required;
vi. Review of Contractor’s proposed quantity and cost the for items under Provisional Sum as per
CCD based on joint pre-construction survey with the Contractor and recommend and submit
the recommendation to the Employer's Representative (Project Director) for approval;
vii. Review of Contractor’s proposed design modifications of any work including related
specifications, detailed calculations and justification for modifications along with methodology
and work plan. Assess the impact of such modification on project schedule and budget.
Consultant shall identify the relevant measures that could be taken to mitigate any negative
impact and check whether the proposed modification is technically sound and viable. These
modifications are to be timely notified to the Employer's Representative for prior approval.
viii. Review of detailed design, drawings and methodology of signaling and interlocking system
submitted by the Contractor and the proposal will have to be submitted with recommendation
to the Client for approval. Timely notify to the client if any modification is required in the
design of signaling and interlocking system and the impact of such modification on the project
schedule and/or budget. Such modifications will require prior approval of Employer's
Representative (Project Director);
ix. Providing necessary technical input with respect to the consultant's review on various test
results, both on and off the site;
x. Monitoring the site conditions and providing the necessary technical input with respect to any
changed conditions;
xi. Ensure the safety of train operation in existing railway line with top priority;

xii. Ensure coordination among site construction works for overall implementation of the project
timely ensuring quality, cost control and safety;
xiii. Making recommendations to the Client with respect to design changes or modifications which
could accelerate the completion of the work and/or result in cost savings;
xiv. Provide the necessary technical input with respect to the consult's review of the O&M
manuals submitted by the Contractor and Others;
xv. Provide the necessary technical input with respect to testing and commissioning of the work;
and
xvi. Provide technical evaluation of the project after completion of Construction work .

3.2.4. Construction Supervision, Testing & Inspection

The Consultant shall engage necessary supervisory Personnel as per scheduled Man-Power including
resident engineers, Inspectors, field staff and office support staff for the supervision of construction
work of the Contractor following the conditions of contract. The Consultant will also arrange all
required field and laboratory testing and site inspection for maintaining the quality of the
construction work. The resident staff shall be under the direction of the Resident Engineer and
overall monitored by the Project Manager and report to Employer's Representative (Project
Director).

The tasks of supervision consultants to be carried out shall include the following but not limited to:
i. Act as the representative of "the Employer's Representative " to execute construction
supervision and contract administration services as per conditions of contract;
ii. Monitor, inspect construction works and ensure proper implementation of Construction Works
following the working design, methodology and quality assurance plan approved by
Employer's Representative (Project Director);
iii. Supervision of all Construction Works ensuring safety of train operation following the Codes,
Rules, Regulations and manuals of BR specially in existing railway lines;
iv. Establish basic survey control and carrying out of all necessary control and check surveys, carry
out joint pre-construction survey with the Contractor for quantity determination of different
BOQ Items, Provisional Sum items under the terms of the CCD;
v. Supervision of all site investigations undertaken by the Contractor, either as required under
the Terms of the CCD or as otherwise necessitated for the proper execution of the Works;
vi. Monitor and ensure proper implementation of safety assurance plan;
vii. Monitor and ensure construction works is done following detailed work schedule and if
needed take necessary action to revise the detailed work schedule;
viii. To issue instructions and notices as appropriate to the Contractor on behalf of Employer's
Representative (Project Director) with copy to the Project Director;
ix. To regularly monitor physical and financial progress, and take appropriate action to expedite
progress if necessary, so that the time for completion set forth in the contract will be duly
respected by the Contractor;

x. Carrying out of all necessary inspection and testing of materials utilized directly and/or
manufactured for use in the temporary or permanent Works and supplied
materials/equipments;
xi. Inspect the work or test as requested by the Contractor through RFI (request for Inspection)
but the Consultant’s visit to site shall not be limited within RFIs. Failure of timely submission of
RFI does not make the Consultant free from his supervision duty;
xii. Review of test results done by the Contractor and execution of random independent testing (if
necessary) to ensure satisfactory performance of the Contractor and the execution of the
Project in accordance with the CCD and sound engineering practices;
xiii. Checking and testing of sources of materials and machinery proposed for use in the temporary
and permanent Works;
xiv. Supervision and monitoring of the Contractor's implementation of Environmental
Management Plan as of the CCD;
xv. Assist in relocation of various utilities and keep liaison with utility service providing agencies;
xvi. Issuing of all necessary instructions to the Contractor as required under the terms of the CCD;
xvii. Issuing of all necessary instructions with respect to emergency measures and protection of the
Works as well as BR’s installations;
xviii. Acceptance or rejection of the work or any part thereof as constructed by the Contractor in
accordance with CCD ;
xix. Detailed recording of all construction activities including photograph and video and test results;
xx. Maintain close coordination with the Contractor, the Client, operation related officials of BR
and consulting team regarding railway operation management during upgradation of existing
line and linking new track with the existing one;
xxi. To provide assistance to BR/PIU concerning variations and claims which are to be
ordered/issued at the initiative of BR/PIU; To advise BR/PIU on resolution of any dispute with
the Contractor;
xxii. Preparation and submission of Project Completion Report along with completion drawing
within 3(three) months of the completion of the Works;
xxiii. Carrying out of all necessary inspection and testing of signaling materials/equipments in
regard to ensure the quality of equipment, materials , along with installation and Testing
Commissioning ;
xxiv. Check and certify as-built drawings and operation and maintenance manuals submitted for
the works constructed in the Project;
xxv. To perform the inspection of the works, including Test on Completion, and to issue certificates
on behalf of Engineer's Representative such as the Taking-Over Certificate, Performance
Certificate as specified in the contract;
xxvi. To supervise commissioning.

Note:Noted that reasonable and suitable modification(s) or correction(s) of any design made by the
Consultant if required or unavoidable as a result of site requirement during construction phase

will have to be carried out without making delay in work by the Consultant as per instruction
and approval of the Client without any further financial claim.

3.2.5. Review of Interim Payment Certificate (IPC)

The scope of works under this aspect includes but not limited to:
i. The interim measurements, checking and recording of the interim measurements of quantities
of the Works completed to assess and certify appropriate interim payments in accordance
with CCD as well as to assess progress achieved;
ii. Review the payment quantity calculations, supporting documents of IPC submitted by the
Contractor and certify;
iii. Submit the certified IPC to Employer's Representative (Project Director) for approval and
further necessary actions;

iv. Monitoring of Indian content and tax waivers

3.2.6. Environmental Aspects

The scope of works under this aspect includes but not limited to:
i. Review the Environmental Impact Assessment (EIA) including the EMP approved by DoE to
understand the environmental issues and mitigation and monitoring requirements of the
project;
ii. Review the Environment Management Plan submitted by the Contractor and recommend and
take necessary action for approval of the Employer's Representative (Project Director);
iii. Prepare monitoring checklists for periodic monitoring (as necessary) of EMP implementation
by the contractor;
iv. Prepare Environmental Monitoring report/checklist as per requirement of DoE;
v. Update the EMP if there are any changes in the project sites or environmental conditions to
incorporate all new environmental issues and mitigation measures and take necessary action
for DoE approval of revised EIA/EMP;
vi. Conduct coordination cum training, workshop/meeting with participations from BR and the
contractors on the requirements and implementation of the EMP;
vii. Monitor implementation of the EMP by the contractor on a periodic basis (as necessary) and in
doing so complete the monitoring checklists;
viii. Provide onsite technical advice to the contractors where necessary during implementation of
the EMP;
ix. Monitor sample testing of air, water, soil etc. according to EMP by the contractor on a periodic
basis (as necessary) and in doing so complete the monitoring checklists;
x. Facilitate consultations between the contractor and local people or other relevant agencies
and address grievances (if necessary);
xi. Maintain a copy of all environment related test results and statutory clearances required for
implementation of the project and EMP.

xii. Monitor implementation of safety assurance plan, specially personal safety and ensure that
contractor has arranged hygienic water supply, sanitary toilets, accommodation, medical
check-up and first aid facilities for labors at camps.

3.2.7. Record Management

(i) The Consultant’s Personnel and staff will maintain site diaries which is typically a summary
of construction activities on site, elements inspected/service rendered, approvals by the
consultants, tests done, daily work done, details of plant and labor deployment, accidents
and any issues or disputes that may have arisen etc. Resident Engineer is to prepare a
summarized single page daily report based on daily records in site diaries of consultants
under his control.
(ii) Photograph and video recording of each daily activity are to be preserved along with soft
copy.
(iii) All the drafts of shop drawings, designs, design calculations and quantity calculations
submitted by the Contractor and approvals provided by the consultants are to be preserved
along with soft copy with a catalogue.
(i) Maintain site library with all documents, drawings, corresponds, test reports, photographs,
CDs/DVDs.

3.2.8. Post Construction Service

The scope of the work, subject to availability of the approved tenure of the Consultancy
service includes but not limited to:
i. Ensure clearance of site in accordance with CCD;
ii. Checking the application of the Contractor in regard to taking over certificate and
assist the Employer during taking over in accordance with CCD;

iii. Preparation and submission of Project Completion Report along with completion
drawings within 3 (three) months of the completion of the Works.
iv. Hand over the libraries and office records with catalog with all the hard copies and
soft copies.
v. Preparation of Documents for GIBR approval.

4. Required Expertise
The consultant’s qualifications with responsibility and team’s composition, expected person-
months are provided hereafter. All Key Consultants and part of Other Consultants at a senior
level and as mentioned thereof are key experts.

5. Reporting Requirements:

5.1. Phase-1: Feasibility Study, Detailed Engineering Design and Bidding Services:
5.1.1. Feasibility Study:

a) Mobilization: To be started within 7 (seven) days after Effective Date of the contract
intimated in written to the Consultant by the Project Director. Noted that Effective date of
the contract is subject to compliance of PCC clause under GCC 17.1. Also to be noted that
‘Commencement Date’ will after 15 days of Effective Date. .
(b) Inception Report (15 copies):
Inception Report to be submitted within 30 days after Commencement Dateor, 10 days
after approval of Final Feasibility Report which ever is earlier. Inception Report will focus
on the Consultant’s arrangements made for office accommodation and other logistic
supports, deployment of Personnel, work program along with methodology for fulfilling
the tasks under the contract.
(c) Interim Report (20 copies):
Interim Report has to be submitted within 60 days after Commencement Date. This
report shall contain physical progress of updating Feasibility Study, progress of Training &
Study Tour . Noted that Preparation of Land Acquisition Plan, Hydro-Morphological study
to be carried out in parallel to Feasibility Study to synchronize with the Detail Design work
in time. .

(d) Draft Feasibility Study Report (25 copies):


Draft Feasibility Report has to be submitted within 90 days after Commencement Date.
The Report shall contain all the findings of studies. It shall include topographic survey
report, geo-technical and hydrological aspects, alternative alignments and plan/profile,
conceptual design, Lay-out drawings, preliminary cost estimate, economic and financial
analysis, environmental and social impact assessments, EIA,EMP. SIA, SMP, land
acquisition proposals and environment clearance proposals along with Hydro-
Morphological study etc.
The executing agency shall comment on the report within 20 days of receiving the report.

(e) Final Feasibility Study Report (25 copies):


Final Feasibility Report will have to be submitted within 2 weeks of receipt of comments
from the Client on Draft Feasibility Study Report. It is mention worthy that Intended
Completion Period for Updating Feasibility Study is 3 (Three) months= 90 days).

Final Feasibility Report will contain Final Land Acquisition Plan, Final SIA, SMP, EIA &
EMP, Hydro-Morphological study along with all other relevant deliverables etc
incorporating the compliances of the comments of the Employer.
Both in the draft and the final report, annexes such as reports of different surveys, tests
& investigations; EIA, EMP and SIA, SMP report related to feasibility study will have to be
submitted separately along with CD/DVDs of all data.

(f) Technology Transfer:

Foreign Study Tourprogramme will have to be scheduled preferably within First 45


(forty five) days after Commencement date. Detail particulars of this training and

5.2. Phase II : Construction Supervision Service


5.2.1. Construction Supervision Service

The Consultant shall comply with the tasks as stated in Clause 3.2.4 to 3.2.8 of this TOR.

In addition the Consultant shall prepare monthly progress reports, annual summary reports
and project completion report in English. 5 copies of these reports are to be submitted to the
Project Director along with soft copy. If required, the Consultant will submit additional copies
of reports to PD (as and when required). The above reporting shall contain the following types
of information:

A. Monthly Progress Reports


i. These reports shall be as brief as possible and shall be issued within next 15 days of the end
of each month.
ii. The Consultant shall present a summary of the current status of the various construction
activities (actual progress vs. scheduled progress), as well as a brief but specific account of
any potential "problems" that could give rise to schedule delays and/or additional costs. The
report must also include the present status of land acquisition, payment of CCL, payment of
resettlement and environmental compliances.
iii. The reports shall include graphs and tables which will enable interested parties to obtain an
updated picture of the stage of completion of the project as well as the progress achieved
during the previous period. The reports will contain comparison between the Contract
Provision as per BOQ and Quantity work done as well as comparison between targeted
scope of work and actual work done. Monthly progress reports shall also highlight any actual
or contemplated major deviations from the original plans or schedules and shall outline the
reasons for the deviations.
iv. Construction costs and overall budget information shall be included in the monthly reports.
The Consultants shall assist BR to develop monthly and quarterly progress report of each
sub-project for submission to IMED.
B. Annual Summary Reports
The Consultants shall assist BR to develop an annual summary report which is required by
the Government and to the financing organizations. The Annual Summary Report shall
primarily concentrate on financial rather than technical issues.

C. Contract Completion Report


The Consultant shall submit Contract Completion Reports within 1 (one) month of the
substantial completion of the project according to the required format of the Client.

Moreover, the Consultant will prepare short status paper, working paper etc. in English
and/or Bengali and power point presentations as and when required.

6. Financial arrangement and Payment Schedule: for Phase-1

The percentage shown in the above table are the percentage of the total approved amount including
Reimbursable Expenses of Phase-I. Payment will be made upon fulfillment of the mentioned
schedule in regard to submission of deliverables, reports and compliance of other contractual
provision.
Note: It is strongly recommended that attendance of all concerned personnel under Remuneration,
Supporting staffs and relevant supporting documents against Reimbursable expenses to be recorded
for future reference and also to be submitted to the Employer (Project Director) as and when
necessary.

7. Financial arrangement for Phase-2:

(a) Advance Payment:

Advance payment against Phase-II will be made as per provision stated below.
• 5(Five) percent of the approved Phase amount (Phase-II) against Construction
Supervision (i.e. Phase-II) will be made as stated in PCC against Clause GCC 52.1. (b)
Against the submission of a Bank Guarantee in prescribed format stated therein.
• Bank Guarantee against the stated advance payment (Mobilization Advance for
Phase-II) shall remain effective initially for the period of 12 months / up to the date
the advance payment is fully recovered, which one is later. Noted that the Client
reserves the right for extension of the validity of the said Bank Guarantee up to the
secured period (date) the Advance Payment is adjusted completely ( i.e. Date of
complete adjustment of Advance payment + 28 days).
(b) Adjustment of Advance Payment:
Advance Payment will be adjusted by the Client in the following manner:
Advance payment made against Phase-II under GCC 52.1 will be recovered in equal
instalments from four (4) progressive payments or at the cumulative amount of due
payment is considerably more than the stated 5% Mobilization Advance starting from
the payment made upon submission of the 1st Monthly Progress Report of Phase-II as
stated in PCC against GCC 52.2

7.0 Payment against remuneration and reimbursable expenditure under Phase-II:


i.Remuneration:

8.1 Rate of Monthly Payment:

The Client shall pay to the Consultant based on the actual deployment in respect of the
Services, such as remuneration on the accepted rates (@ 95%; and reimburse the
expenditure as stated in Clause-8.0.B stated hereafter.

a) 5% of retained monthly pay will be released proportionately in the construction


period (up to completion of construction work) to the average financial progress of
the construction contract for which Consultant has been appointed.

b) In case of validity of contract is extended for reasons not attributed to the


consultant, the payment per month in the extended period shall be made based on
accepted man-month rates and actual deployment of staff as stated in sub clause
8.1 (i) above.
c) In case of failure of deployment of key personnel for whom CVs were submitted or
from the list approved by Bangladesh Railway, within 30 days of the request of the
client, Bangladesh Railway will be entitled to impose a penalty @ 0.50% of the
accepted monthly remuneration rate of the concern personnel per day of delay, for
the first 60 days after the notice period of 30 days. After the above 60 days period is
over, the penalty @ 1% of the accepted monthly remuneration rate per day of delay
shall be imposed.

d) In case the project being supervised is completed ahead of schedule of the original
completion date, the Monthly payment to the consultant will be restricted up to
that period at which the construction work of the project is completed. In the event
of termination of construction contract or removal of contractor, no further
payment beyond 15 days of such event shall be made to the Consultant.

8.2 Determination of Time for Remuneration:

i. .Remuneration shall be determined on the basis of qualifying time spent by the


personnel listed in the Staffing Schedule in performance of the Services after Client’s
advice. Basis of remuneration will be determined based on qualifying period with
respect to the accepted monthly man-month rate(s).

ii. Remuneration for periods of less than one month shall be calculated on a calendar
day basis for the time spent in the field for part of the month. The personnel shall
not be entitled for overtime. The Consultant’s remuneration shall be deemed to
cover these items.
However taking leave for certified sickness or any emergency issue on reasonably
justified ground by the consultant personnel shall be subject to prior approval of the
Client. The Consultant shall ensure by certification that absence for such leave will
not delay the progress and adequate supervision of the Services.

If it is observed by the client and the client is on the opinion that such absence of the
personnel will hamper the supervision work, the Consultant shall arrange the
substitute personnel for such period of absence of the personnel.

iii. The period for which the Consultant’s personnel will be on leave or absent
(Authorized/unauthorized, even for the period the personnel stays out side of site for
Visa purpose), shall not be charged on the bill, and the corresponding bill must be
accompanied with the attendance record for the period.

In addition, proportionate amount of other relevant items of the contract under


Phase-II shall also be deducted from the bills of the consultant for each day of such
absence.
It is mention worthy that the work of the personnel of the Consultants may require
when the work is in progress, to be adjusted in schedule in regard to deploy more
effort, mutual change of working day/ working schedule for the sake of proper
supervision as well as for personnel’s facility without any overtime. However such
adjustment must be intimated well in advance to the Client and his approval will be
concerned.

iv. Consultant’s Personnel can avail a weekly rest (one day per week on mutual
adjustment), National holidays and other religious holidays to be considered from the

list of religious holidays as approved by the Client, for which no deduction in their
remuneration will be made.

Maximum of Six Weekly rests can be clubbed with/without prefixing/suffixing it with


National Holiday, Religious holiday and taken together, solely at the discretion of the Project
Director. However this will only be with the prior approval of Client. Consultant if required
shall stagger/defer such weekly rest or availing National Holiday or religious holiday during
exigencies, so as to ensure uninterrupted progress of works.

8.3 Submission of Monthly Invoice:

i. Payments to be made by the Client hereunder shall be strictly subject to, and
representative of, satisfactory progress achieved by the Consultant.

ii. As soon as practicable and not later than 15 (fifteen) days after the end of each
calendar month during the period of the services, the Consultant shall submit to the
Client, in 4 copies, itemized statements, accompanied by receipted invoices, vouchers
and other appropriate supporting materials including the attendance record for the
period, of the amounts payable to the consultant for such month. Each such separate
monthly statement shall distinguish that portion of the total eligible costs which
pertains to remuneration from that portion which pertains to reimbursable expenses.

8.4 Submission of Final Bill Statement

As soon as practicable after the completion of the services or termination of the


contract, the Consultant shall submit along with retained 5% to the Client the Final
Statement of eligible costs incurred, with vouchers and other appropriate supporting
documents for such reimbursable expenditures referred to in Clause-
8.0.BReimbursable Expenses: stated hereafter. The statement shall distinguish that
portion of the total eligible costs which pertains to remuneration from that portion
which pertains to reimbursable expenses.

8.5 Acceptance of Final Bill Statement

Final payment shall be made by the Employer only after the Final Statement and the
Final Report have been submitted by the Consultant and approved as satisfactory by
the Client. The Consultant shall submit the Final Statement of cost expenditure to the
Client within 30 calendar days after the date of approval of the Final Report by the
Client .

Noted that the services shall be deemed completed and finally accepted by the Client.
The final report and final statement shall be deemed approved by the Client as
satisfactory within 60 (sixty) days after receipt of the final report and final statement
by the Client unless the client, within such 60(sixty) day period, gives written notice
to the consultant specifying in detail deficiencies in the services, final report or final

statement. The Consultant shall thereupon promptly make any necessary corrections,
and thereafter the foregoing process shall be repeated until such time as the final
report and the final statement have been approved by the Client.

All costs, including reimbursable expenses, which have not been included in the Final
Statement will not be paid or reimbursed. Should any discrepancy be found to exist
between the actual payments made by the Client and the costs authorized to be
incurred by the Consultant pursuant to this Contract, the final payment shall be
adjusted by the Client to reflect such discrepancy. The Consultant shall reimburse any
amount that the Client has paid or caused to be paid in accordance with this section
in excess of the costs actually incurred to the Client within 3 days after receipt by the
Consultant of Client’s notice thereof.

8.6 Payment of Final Bill:

Pursuant to Sub-clause 8.1, 8.2, 8.3, 8.4 & 8.5stated above, the Client shall pay to
the Consultant the final eligible amounts against consultant’s claim within next 60
(sixty) calendar days after approval of Final Statements. The Client may add to or
subtract from the final bill amount of any other payment due with Bangladesh
Railway of any amount to cover the difference, if any.

No interest on payment due to the Consultant is admissible on amounts payable by


the Client, if otherwise not agreed upon by both the consultant and the Client

Consultant of any obligations hereunder.
