Change in Liability Allocation
•  “Controlling Entity” is now responsible for ensuring ground
conditions are adequate
•  Shift away from the traditional expectation that the crane company
and crane operator are solely responsible for ground conditions
•  Operator is still ultimately responsible for safe operation of the
crane

Crane Operating Company


•  While the “Controlling Entity” is responsible for ensuring ground
conditions are adequate, if conditions are questionable, the
operator must raise the issue and discuss it with the Controlling
Entity
