COMPROMISE AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Agreement is executed on January 14, 2021 by and between the following parties:

REALYN A. AVELLANA, Filipino, resident of Brgy. Lidong, Sto. Domingo, Albay, for
herself and in representation of her daughter, KIANA MIEL A. CELESTIAL, minor, resident of the
same address, hereafter referred to as “PRIVATE COMPLAINANT”’;

And

JASON C. NOVENARIO, Filipino, resident of Brgy. Salavacion, Tabaco City, hereafter

referred to as “ACCUSED”,

WITNESSETH

WHEREAS, the Private Complainant and the Accused wish to reach the full and final
settlement of the action and all matters arising from Criminal Case No. FC-20-3317 for Reckless
Imprudence Resulting in Serious Physical Injuries and Less Serious Physical Injuries pending
before Regional Trial Court, Branch 8, Legazpi City (RTC-Br. 8);

WHEREAS, the Accused has already paid to the Private Complainant the amount of
Seventy Thousand Pesos (P70,000.00) as partial payment for the civil indemnity in the
instant case; receipt of which is hereby acknowledged by the Private Complainant;

THEREFORE, in consideration of the mutual promises set forth, the parties agree to the
following:

1. That Accused shall pay the amount of Thirty Thousand Pesos (P30,000.00) as full
and final settlement of the civil damages for the instant case and hereby releases the
Accused from any damages as a result of the incident subject matter of the case;
