WE, MARIA A. ESPINA md to Romeo M. Espina, RODOLFO R. ATIENZA md to
Merlita E. Atienza, HEIDE A. SARAO md to Deogracias Eugenio Sarao and ERWIN L.
ATIENZA separated from Rizalina Penaflor, theirs/son and daughter of the late Sps.
SALVADOR R. ATIENZA died on December 20, 2014 and JOVITA L. ATIENZA DIED ON
June 20, 2014, AURORA A. UNTALAN md to Pedro Untalan, ARIEL A. UNTALAN md to
Maricar P. Untalan, PAZ A. ALBANO md to Gerry G. Albano, JOSELITO R. ANDAL,
widower and JAMES LAURENCE A. ANDAL, single, husband/ son and heirs of the JUANA
ATIENZA ANDAL died on August 29, 2005, ADORACION G. ATIENZA, widow, MARYAN
A. CORTEZANO md to Mark Gil Cortezano and RACQUEL G. ATIENZA, single,
wife/daughter and heirs of late FRANCISCO R. ATIENZA died on May 14, 2000, AIDA A.
ATIENZA, widow, DALIA A. ATIENZA, DARWIN A. ATIENZA, DESERIE A. ATIENZA
and DANICA ROSE A. ATIENZA, all single, wife/daughter/son and heirs of late BENJAMIN
ATIENZA died on February 1, 2016, all of legal age, Filipinos and all with residence address at
Brgy. Mahanadiong, Taysan, Batangas.
That the above-end mentions parties are the son, daughter and grandchildren sole and
legitimate heirs of late Sps. PEDRO ATIENZA DIED ON May 11, 1992 and JOSEFA
RABANO ATIENZA, died on August 1, 2005, died WITHOUT WILL OR TESTAMENT and
no known debts whomsoever, and left one (1) parcel of land situated in Brgy. Mahanadiong,
Taysan, Batangas, particularly described as follows:
TAX DEC. NO. 29-0010-01564
“A parcel of land (Lot 576), situated in Brgy. Mahanadiong, Municipality of Taysan,
Province of Batangas, Bounded on the N., by Creek, on the S., by Brgy. Road, on the E., by
Creek-ALN-03, and on the W., by ALN-01, Brgy. Road, containing an area of Twelve Thousand
Nine Hundred Ninety Four (12,994) sq. meters, more or lessm declared in the name of
ATIENZA, PEDRO and wife.”
That the aforementioned legitimate heirs have agreed to settle the above-described parcel
of land extra-judicially under Sec 1. Rule 74 of the New Rules of Court, as we adjudicate unto
ourselves and partition our shares, undivided rights over the said parcel of land belonging to our
late father and mother, subject however to the liabilities imposed by Sec 4 of the same Rules of
Court for the period of two (2) years, and PARTITION OF SHARES as follows:
1. FOR MARIA A. ESPINA, heir md to Romeo Espina, Port of Lot 576, Area-807 sqm.
And 892 sqm.
2. FOR RODOLFO R. ATIENZA, heir md to Merlita E. Atienza, Portion of Lot 576,
Area-958 sqm and 3,592 sqm of which portion area 892 sqm, from donation of the
heirs of Francisco Atienza: Adoracion G. Atienza, MaryAn A. Cortezano and
Racquel G. Atienza; brother of the said Rodolfo Atienza;
3. FOR HEIDE A. SARAO md to Deogracias E. Sarao and ERWIN L. ATIEZA,
separated, HEIRS of late Salvador and Jovita Atienza, portion of Lot 576- Area- 892
sq meters;
4. FOR ARIEL A. UNTALAN md to Maricar P. Untalan, Protion of Lot 576-AREA-
892 sq. meters, mother and father, Aurora and Pedro Untalan; heirs of the decedent;
over
 5. FOR JOSELITO R. ANDAL, widow and JAMES LAURENCE A. ANDAL, husband
and son of the late Juana R. Atienza- heir of the decedent, Portion of Lot 576, Area-
892 sqm.
6. FOR PACENCIA ATIENZA ALBANO md to Gerry G. Albano, heir of the
decedents, portion of Lot 576, Area-892 sq meters;
7. FOR AIDA A. ATIENZA, widow of the late Benjamin R. Atienza, and son &
daughters: DALIA A. ATIENZA, DARWIN A. ATIENZA, DESERIE A. ATIENZA
and DANICA ROSE A. ATIENZA, all single, portion of Lot 576, AREA – 892 sq.
meters.
8. Road right of way- AREA-434 sq. meters, FOR RODOLFO R. ATIENZA et als.,
Further, the donors, ADORACION G. ATIENZA, MARY AN A. CORTEZANO,
RACQUEL G. ATIENZA, AURORA A. UNTALAN and PEDRO UNTALAN donated their
rights, shares and participation over the said portion parcel of a land (Lot 576) in favor of the
Donees for their love and care to the same and the Donees accept wholeheartedly to the name
and thankful for their love and kindness, and for and in consideration of the said premises, We
hereby TRANSFER and CONVEY the same parcel of land as subdivided and partition as
enumerated and described above to their successors, heirs and assign to the same.
That the true copy of the instrument has been published for three (3) consecutive weeks
of general circulation within Southern Tagalog Region,
Thus, the above-described parcel of land is not TENANTED and not covered by the
Provision of Republic Act 3844, regarding land Reform Program of the Philippines and let this
instrument be registered under Act 3344.
