REPUBLIC ACT NO.

8293- AN ACT PRESCRIBING THE INTELLECTUAL


PROPERTY CODE AND ESTABLISHING THE INTELLECTUAL PROPERTY OFFICE,
PROVIDING FOR ITS POWERS AND FUNCTIONS, AND FOR OTHER PURPOSES

Provided in Sec. 2 of the said Code, the State recognizes that an effective intellectual
and industrial property system is vital to the development of domestic and creative
activity, facilitates transfer of technology, attracts foreign investments, and ensures
market access for our products. Hence, the State protects and secures the exclusive
rights of scientists, inventors, artists and other gifted citizens to their intellectual property
and creations, particularly when beneficial to the people, for such periods as provided in
this Act.

How can this affect teaching and learning in the classroom?

There are two advantages that can be sought in this law regarding to classroom setting.
First, students and teachers will be encouraged to innovate and create outstanding
materials and research. Second, students and teachers can create a bigger avenue of
learning.

On the first claim, the Philippine Council for Agriculture and Resources Research
& development (PCAARD) has 132 agricultural R & D agencies all over the
country collectively called the National Agricultural and Resources Resource and
development Network (NARRDN) as well as fourteen (14) regional consortia, in-
charge with the regional capacity for managing researches through R & D
Centers based in HEIs and conduct basic and applied research on a wide range
of economically important commodities and disciplines (Stads, Faylon & Buendia,
2007). It is for this reason that with the help of intensive R & D in agriculture, the
Philippines has become the world's leading exporter of Cavendish bananas and
the second largest producer of coconut products after Indonesia. Hence, the role
of the Higher Education sector in uplifting Research and Development in the
Philippines cannot be taken for granted. It is in the Higher Education sector that
potential sources of economically viable research outputs are generated.

For the second claim, Universities are recognized as bastions of learning that
researches are carried out to advance knowledge for public good. Thus, the
principle of “publish or perish” prevails and so the expected result of scientific
research study is the publication to disseminate results to the public so that
desired outcomes from the research are utilized. However, the challenge is to
move from this orientation to recognition that Intellectual Property (IP) is an asset
which should be maximized for the benefit of the University (Vilchez, 2008). It is a
great help not only for the students conducting the research but for the future
generation.

To sum up, RA 8293 help students and teachers to be innovative and creative
since it promise the corresponding credit they deserve.
Republic Act No. 10175- AN ACT DEFINING CYBERCRIME, PROVIDING FOR THE
PREVENTION, INVESTIGATION, SUPPRESSION AND THE IMPOSITION OF
PENALTIES THEREFOR AND FOR OTHER PURPOSES

As provided in, Sec. 2 of the said law, the State recognizes the importance of providing
an environment conducive to the development, acceleration, and rational application
and exploitation of information and communications technology (ICT) to attain free,
easy, and intelligible access to exchange and/or delivery of information; and the need to
protect and safeguard the integrity of computer, computer and communications
systems, networks, and databases, and the confidentiality, integrity, and availability of
information and data stored therein, from all forms of misuse, abuse, and illegal access
by making punishable under the law such conduct or conducts.

How can this affect teaching and learning in the classroom?

In 2016, University of Calgary where the institution allegedly handed over $20k to
cybercriminals, and malware attacks causing mass disruption – similar to the disruption
which, apparently, caused the Minnesota School District to shut down for a day while IT
professionals rebuilt the system. Educational institutions are entrusted to safeguard
their students, many of whom are minors, but a weak cybersecurity infrastructure can
put them at risk. This was made all too clear when the CCTV in several schools in
Blackpool was allegedly breached, and the footage reportedly live-streamed on the
internet.

Thus, the law against cybercrime in the Philippines is very necessary in educational
institution. In the case of higher education institutes like Universities/Colleges, they’re
often centres for research and hold valuable intellectual property.
