MOTION TO CANCEL CASH BOND

The undersigned Movant, to this Honorable Court, most respectfully

states:

On June 26, 2019, Executive Judge Nannette Michote E. Lao of the

Regional Trial Court 10th Judicial Region, Branch 28 issued an Order to release
on bail the accused JOY SUCALDITO SOBREMISANA in Criminal Case No.
2465 for Reckless Imprudence Resulting to Multiple Homicide. A copy of the said
Order is attached as Annex “1.”

The bondsman of the accused is the movant as evidenced by the Official

Receipt No. 3202098C attached as Annex “2” representing the cash bond for the
accused in the amount of P60,000.00 for the above cited case.

The movant hereby moves for the cancellation of the cash bond of the
accused for the reason that he is no longer under the close supervision of the
undersigned.

The movant will surrender the accused before this Honorable Court or on
a written authority endorsed through an Undertaking, attached as Annex “3,” may
cause him to be arrested by any officer or any other person of suitable age and
discretion.

PRAYER

WHEREFORE, premises considered, it is most respectfully prayed to this

Honorable Court that the cash bond posted for the provisional liberty of the
accused in this case be cancelled.

Other reliefs just and equitable under the premises are likewise being
prayed for.

AFFIDAVIT OF UNDERTAKING AS BONDSMAN

I, ARNEL B. LONGOS, Filipino, of legal age, married and a resident of

__________________________________, after having been duly sworn to in
accordance with law, depose, and state, that:

1. I am the bondsman of the accused JOY SUCALDITO

SOBREMISANA in Criminal Case No. 2465 for Reckless Imprudence
Resulting to Multiple Homicide before the Municipal Trial Court of
Mambajao, Camiguin.
2. I filed a Motion to Cancel Cash Bond posted for the accused’
provisional liberty in the above-captioned case for the reason that he is
no longer under my close supervision.
3. In case I failed to surrender the accused before the Honorable Court, I
give authority or hereby endorse as his bondsman to cause him to be
arrested by an officer or any other person of suitable age and
discretion.
4. I am executing this affidavit for the purpose of compliance with Rule
14, Section 23 of the Rules on Criminal Procedure and for whatever
legal purpose it may serve to support my Motion to Cancel Cash Bond.
