AFFIDAVIT

I, adfasdfdfafd, Filipino Citizen, of legal age, married and a


resident of District III, Sibalom, Antique, after being duly sworn in
accordance with law, hereby deposes and state:

1. That the defendant in the above-entitled case is SIBALOM


CENTRAL ELEMENTARY SCHOOL;

2. That I, dfadfasdfasdfasdfasdfsd, am authorized to represent the


defendant by reason of my authority as the adsfasdfsdf
Coordinator or theasdfasdf and dsfasdfsdf in charge with arranging
the purchasing of books for students enrolled in EESM sections for
Grades 1 to 3 in the very same school;

3. That the parents of the said students authorized me to arrange the


purchasing of the books for the said students;

4. That complainant adfasdfsadfasdfasdfasdf, INC. as represented


by Ms. dfadfasdfasdfasdfsadf sent a demand letter dated April 24,
2017 through the law firm of Atty. Anthony T. Inventado, hereunto
attached as Annex 1;

5. That I, qwerty , as the representative of the defendant, sent a reply


dated May 13, 2017 to the earlier mentioned demand letter,
hereunto Attached as Annex 2;

6. That the said reply to the demand letter states the reason for the
delay in payments. The said reply also contains an attachment
representing a bank receipt of my deposit dated September 15,
2016 amounting to ₱10,000.00 as payment to the complainant
hereunto attached as Annex 3;

7. That on April 7, 2021, I, dfadfasdfasdfasdf exhausted all means of


communication and managed to resume negotiations with the
complainant VIBAL GROUP, INC. as represented by Ms. MARY
AVE MAHINAY, through text messages, email and a letter of
inquiry that was sent to the complainant hereunto attached as
Annex 4;

8. That the delivery of the said letter of inquiry is evidenced by a


receipt issued by LBC Express Inc. dated April 7, 2021 hereunto
attached as Annex 5;

9. That by reason of the said negotiations and as proof of my honest


desire and intention to settle my obligation, I made payments
amounting to ₱20,000 to the complainant as evidenced by a bank
receipt of my deposit dated April 8, 2021 hereunto attached as
Annex 6;
10. That the evidence presented by the complainant bearing the
Sales Invoice No. 149073, hereunto attached as Annex 7 with an
amount ₱13,898.76 should be deducted from the total amount
claimed as it is addressed to or the liability of Good Shepherd
Academy and not with the Defendant Sibalom Central Elementary
School;

11. That the total amount claimed by the complainant


amounting to P194,565.33 should be deducted with the amount of
₱10,000 as payment made in Sept. 15, 2016, ₱20,000 as payment
made last April 8, 2021 and the amount ₱13,898.76 which is the
liability of Good Shepherd Academy.

Further Affiant sayeth none.
