WHEREAS, the DICT Bids and Awards Committee - 1 (DICTBAC-1) posted the
Invitation to Bid for the “SUPPLY, AND DELIVERY OF FIBER OPTIC CABLE
(FOC) IN NATIONAL CAPITAL REGION FOC MAINTENANCE” at the
Philippine Government Electronic Procurement System (PhilGEPS) and at the DICT
Website on 22 October 2020. The said Invitation to Bid was also posted at conspicuous
places within the premises of the DICT from 22 October 2020 to 18 November 2020;

WHEREAS, on 03 November 2020, a Pre-Bid Conference was held followed by a

Bid Submission and Opening on 18 November 2020;

WHEREAS, during the Bid Submission and Opening, the DICTBAC - 1 received
bids from the following bidders:

1. Exprotech Marketing (Exprotech); and

2. Fastel Services, Inc. (Fastel).;

WHEREAS, upon opening the bids, the aforementioned bidders were declared
“FAILED” due to the following reasons, as shown in the attached Abstract of Bids as
Read (attached as Annex “A”):

Bidder Reason of Failure

Exprotech Non submission of Tax Clearance
Fastel Non submission of Net Financial Contracting Capacity (NFCC)

WHEREAS, Section 35.1 (b) of the Revised IRR of RA No. 9184 provides, “The BAC
shall declare the bidding a failure when:

c) All prospective bidders are declared ineligible;”

 WHEREAS, as a result of the failure of bids, the end user is instructed to
conduct a mandatory review and evaluation of the terms, conditions, and
specifications in the bidding documents pursuant to Section 35.2 of the Revised IRR
of RA9184.

NOW, THEREFORE, FOR AND IN CONSIDERATION OF THE

FOREGOING, the members of the DICTBAC-1 hereby resolve to declare First Failure
of Bidding for the Supply, and Delivery of Fiber Optic Cable (FOC) in National
Capital Region FOC Maintenance.

RESOLVED, at the Department of Information and Communications Technology this
