AFFIDAVIT OF CIRCUMSTANCES

I, NURJANNA ILAHIM SALASIM, of legal age, single and with


residence or postal address at GERAS Road, Sumagdang Barangay,
Isabela City, Basilan, after having been duly sworn to in accordance with
the law, do hereby depose and say that:

1. I am the owner of Handee Tailoring. My shop is located at Isabela


City Proper, Isabela City, Basilan.

2. The herein defendants are: (1) the UNIVERSAL COLLEGE


FOUNDATION OF SOUTHEAST ASIA AND THE PACIFIC Inc.,
Lamitan City, (hereinafter referred to as Universal College), (2)
Crisanto M. Orillo (hereinafter referred to as Crisanto), and (3) Jun
H. Intong (hereinafter referred to as Jun).

3. Crisanto is of legal age, Filipino and a resident of Sta. Clara,


Lamitan City, Basilan. Jun is likewise of legal age, Filipino and a
resident of Bato, Lamitan City, Basilan.

4. Sometime in October 2019 the UNIVERSAL COLLEGE


FOUNDATION OF SOUTHEAST ASIA AND THE PACIFIC Inc.,
Lamitan City, (hereinafter referred to as Universal College)
ordered from Handee Tailoring two hundred ninety-five (295) sets
of P.E. Uniforms. As agreed upon by the parties, each set of the
said uniforms costs FOUR HUNDRED PESOS (P400.00) payable
upon delivery of the said sets of P.E. Uniforms.

5. It was Crisanto and Jun, representing the Universal College, who


went to HANDEE Tailoring to make the said order. Crisanto was
the then Officer-in-Charge/ Administrator of the Universal College.
Jun was an employee of the said College.

6. The two hundred ninety-five (295) sets of P.E. uniforms were


delivered by the Handee Tailoring on three separate days:

a. 95 sets were delivered to and received by Mr. Crisanto Orillo

7. The said sets of P.E uniform were delivered on three separate


days as follows:
a. 95 sets of P.E. Uniforms were delivered to and received by
Crisanto on February 9, 2020;
b. 100 sets of P.E. Uniforms were delivered to and received by
Crisanto on February 16, 2020; and
c. 100 sets of P.E. Uniforms were delivered to and received by
Crisanto on February 9, 2020;

8. Each delivery and receipt of the said sets of Uniforms is evidenced


by an acknowledgement of receipt signed by Crisanto. The said
acknowledgements of receipt are attached herewith as ANNEX
“A1-A4”

9. On February 7, 2020, Crisanto executed a handwritten promissory


note promising to pay the full amount of P.E. Uniforms of three
hundred (300) sets which is ONE HUNDRED TWENTY
THOUSAND PESOS (P120,000.00) on March 30, 2020. The
execution of the promissory note was witnessed by the Brgy.
Chairman of Matibay, Lamitan City, Hon. Sukarno Mangkabung.

10. The promissory note is attached herewith as ANNEX “B”.

11. However, came March 30, 2020, and up to date, Universal


College failed to pay their obligation which is the amount of ONE
HUNDRED EIGHTEEN THOUSAND PESOS (P118,000.00).

12. On August 11, 2020, I sent a Letter of Last and Final Demand
to Pay to one Renato D. Francisco (hereinafter referred to as
Renato), the incumbent Officer-in-Charge/Administrator of
Universal College. The Demand Letter is attached herewith as
ANNEX “C”.

13. In response to the Demand Letter, Renato told me that the


Universal College should not be the one to pay the amount due
but Crisanto and Jun who were already terminated by the
Universal College.

14. I have lodged my complaint with the Office of the Barangay


Captain, Barangay Matibay, Lamitan City but no settlement
agreement was reached; hence, a Certificate to File Action was
issued by the said Office. The Certificate to File Action is attached
herewith as ANNEX “D”.

FURTHER AFFIANT SAYETH NAUGHT.

In witness whereof, I have hereunto set my hand this 28 th day of


January, 2021 in the City of Isabela, Philippines.
