1. Learned counsel for parties submit that there has been a

settlement between them, as a result of which the plaintiff is not
interested in prosecuting its suit and the defendant is not interested in
prosecuting its counter-claim.

2. Accordingly, both the plaintiff and defendant seek leave to

withdraw the suit and the counter claim, reserving their rights to re-
agitate any grievance which may survive, at any appropriate stage,
strictly in accordance with law.

3. With the said observations, the suit and the counter claim are
dismissed as withdrawn.
