MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Agreement made and entered into between:

_____________, of legal age, married, Filipino and resident of ________________,
herein after referred to as the “owner” of lot located __________________________________
-and-
_______________________, of legal age, married, Filipino and a resident of #
__________________________, herein after referred to as the “builder”.
WITNESSETH that:
WHEREAS, the owner, uncle of the builder, permits the latter to construct a house.
WHEREAS, the builder, at her own expense, has a revocable right to construct a house,
for the benefit of ________________________________.
WHEREAS, the owner has the right to revoke the builders’ right as he may deem proper.
WHEREAS, the owner, has a right of representation thru his heir,
____________________________
WHEREAS, this memorandum of agreement shall be renewed after _________________
years from the date of effectivity.
NOW, THEREFORE, for and in consideration of the foregoing premises, the owner and
the builder agree and stipulate the following:

Obligations of the Owner:

1. The owner shall allow the builder to construct a house and make use of the house
and lot for an indefinite period of time as he may deem proper.
2. The owner shall notify the builder at least a month prior to his intention to utilize
his land.
3. The owner shall not claim the house upon construction.
4. The owner shall not compel the builder to acquire the house in his favor without
any remuneration.
5. Any improvement to the land not made by the owner shall be accrued to the
benefit of the builder.
Obligations of the Builder:
1. The builder at her own expense shall construct a house.
2. The builder shall not claim, sell, dispose, encumber or mortgage the land.
3. The builder at her own expense may remove his house on the land provided there
is no damage to the same.
4. In case of damage to her property, the builder shall not be entitled to
reimbursement.
5. The builder shall anytime deliver the land to the owner upon the latter’s demand.
