Juvenile
- A person who has not reached adulthood or age of majority.
- Regarded as Immature
Delinquent person
- A person , of whatever age, whose attitude toward other individuals, toward the community,
toward lawful authority is such that it may lead him into breaking the law.
Juvenile delinquency
- Refers to an anti-social acts or behavior committed by minors which deviates from the normal
patterns of rules and regulations, custom and culture which society does not accept and which
therefore, justifies some kind of admonishment, punishment or corrective measures in the
public interest.
Bail
- refers to the security given for the release of the person in custody of the law, furnished by him/
her appearance before any court.
- Apprehension or taking into custody of a child in conflict with the law by law enforcement
officers or private citizen.
- refers to a system dealing with children at risk and children in conflict with the law, which
provides child-appropriate proceedings.
- refers to the totality of the circumstances and conditions which are most congenial to the
survival, protection and feelings of security of the child and most encouraging to the child's
physical, psychological and emotional development. It also means the least detrimental
available alternative for safeguarding the growth and development of the child.
Status offenses
- Refers to offenses which discriminate only against a child, which an adult does not suffer any
penalty for committing similar acts.
Child At Risk
- refers to a child who is vulnerable to and at the risk of committing criminal offenses because of
personal, family and social circumstances, such as, but not limited to, the following:
(1) being abused by any person through sexual, physical, psychological, mental, economic or any
other means and the parents or guardian refuse, are unwilling, or unable to provide protection for the
child;
(3) being abandoned or neglected, and after diligent search and inquiry, the parent or guardian cannot
be found;
- refers to a child who is alleged as, accused of, or adjudged as, having committed an offense
under Philippine laws.
Community-based Programs
- Refers to the programs provided in a community setting developed for purposes of intervention
and diversion, as well as rehabilitation of the child in conflict with the law for reintegration into
his/her family and/or community
Deprivation of liberty
Victimless crimes
- providing short-term residential care for children in conflict with the law who are awaiting court
disposition of their cases or transfer to other agencies or jurisdiction.
- provides care, treatment and rehabilitation services for children in conflict with the law.
AGENCIES
- oordinate the implementation of the juvenile intervention programs and activities by national
government agencies and other activities.
- Call the attention of the departments and agencies concerned to perform their respective duties
and responsibilities
- Mobilize resources and call upon government agencies to provide resource assistance to
support the implementation of the act.
1. Search by an officer of the opposite sex- Shall not be search by law enforcement officer of the
opposite sex.
2. Vulgar language- The law enforcement officer shall refrain from using profane words.
3. Harassment and abuse- Shall refrain from sexually harassing or abusing or making sexual advances on
the CICL
4. Display and use of instruments of force or restraint- Shall refrain from subjecting the child in CICL to
greater restraint that is necessary for apprehension.
- Counseling
- Life skills training and education
- Provision of support services to the family; ex: livelihood programs
- Referral to other agencies for appropriate services; ex: education, health, skills training
- Access to child and youth organizations
Community-based rehabilitation
Expenses
- Care and maintenance of a CICL under institutional care, either in Youth homes or Youth
centers, shall be borne by his/her parents or those persons liable to support him/her.
- In case the parents of the CICL cannot pay all or part of the said expenses, the government shall
shoulder it.
- Given to CICL for at least 6 months whose cases have been dismissed by the court because of
good behavior.
