PICKLE HEALTHY DELIVERY CORPORATION, a corporation duly organized and existing in accordance
with laws of the Republic of the Philippines, with principal office at 230 Narra Street, Marikina Heights,
Marikina City, represented in this act by its President, Karen Dorothy David, hereinafter referred to as
the EMPLOYER;
-AND-
CZARINA NICOLLE Y. LAZARO, of legal age, Filipino and a resident of Yakal St., Casimiro Westville Homes,
Bacoor, Cavite herein referred to as the NUTRITIONIST-DIETICIAN
WITNESSETH: THAT –
WHEREAS, the EMPLOYER is engaged in food production, meal delivery, and catering services.
WHEREAS, NUTRITIONIST-DIETICIAN manifests and guarantees that she possesses the requisite qualities
and competencies needed by the EMPLOYER in the conduct and course of its business;
APPOINTMENT
1. COMPENSATION
NUTRITIONIST-DIETICIAN will receive a net monthly rate of Eighteen Thousand Pesos only (PHP
18,000.00). EMPLOYER may at its discretion provide performance and incentive bonuses equal to
NUTRITIONIST-DIETICIAN’s monthly fee. Annual and incremental salary adjustments and merit increases
may be affected on a case-to-case basis and upon the recommendation of the immediate manager and
upon approval of management.
NUTRITIONIST-DIETICIAN shall perform the duties and responsibilities that her position or job
necessarily entails, as may be contained in her job description or as may be reasonably assigned to her
by the EMPLOYER from time to time. The NUTRITIONIST-DIETICIAN acknowledges to have read and
understood the duties and responsibilities below:
1. Evaluates, adjusts, and finalizes recipes from all of Pickle Healthy Delivery SKUs (Signature,
Lean and Clean, and Performance) to ensure macronutrient and calorie balance in all of
Pickle Healthy Delivery’s weekly meal plans.
2. Develop a full meal plan guide to transition Pickle Healthy Delivery’s Lean and Clean meal
plan to a certified DASH / Therapeutic diet meal plan.
3. Develop innovative snack recipes to assist in balancing the macronutrient requirements of
all meal plans.
4. Develop guide for ingredient to avoid, substitutions, and snack alternatives for clients with
common health concerns (diabetes, hypertension) or allergens.
5. Provides consultation to select clients with unusual health concerns to help Pickle Healthy
Delivery customer care assess if client can be served with minor alterations or if client is to
be declined.
6. Write 4 nutrition driven feature articles for website and social media content monthly (1 a
week).
7. Proofread nutritional information of Pickle Healthy Delivery’s other feature articles and posts.
8. Represent Pickle Healthy Delivery in select events, media appearances.
9. Collaborates with the Executive Chef for new product line development.
3. PLACE OF WORK
NUTRITIONIST-DIETICIAN’s primary place of work shall be remote but will be required to report to the
EMPLOYER’s office in Marikina City (2) days a month. NUTRITIONIST-DIETICIAN agrees that EMPLOYER
may transfer or send him to any other location as may be required by the exigencies of the business, the
organizational requirements of the EMPLOYER and the responsibilities of NUTRITIONIST-DIETICIAN’s
position. NUTRITIONIST-DIETICIAN may be required to travel from time to time.
4. HOURS OF WORK
It is understood that NUTRITIONIST-DIETICIAN is being employed with a level of confidence and degree
of responsibility that may further require her to render work beyond normal business hours or days.
5. DECORUM
NUTRITIONIST-DIETICIAN shall observe and comply with all EMPLOYER rules and regulations written or
otherwise. NUTRITIONIST-DIETICIAN shall devote her entire working time to the EMPLOYER and shall
have no direct or indirect interest in any firm or entity, whether for profit or not, directly in competition
with or offering the same services as EMPLOYER nor shall NUTRITIONIST-DIETICIAN take any interest
that is conflicting or inimical to EMPLOYER.
7. INTELLECTUAL PROPERTY
The EMPLOYER shall be entitled to sole ownership of any intellectual property rights including but not
limited to software programs, hardware specifications, artworks, creative concepts, and other property
rights created, developed and discovered by NUTRITIONIST-DIETICIAN while in the course of her
employment with the EMPLOYER, including all registrations for the same.
8. NON-DISCLOSURE
NUTRITIONIST-DIETICIAN acknowledges and confirms that this contract must remain confidential.
Except as may be legally required by competent authority or applicable statutes, the parties hereto shall
not make any unauthorized disclosures of the terms and conditions embodied in this contract.
9. CONFIDENTIALITY
In order to safeguard the EMPLOYER’s interest and the confidentiality of its business and affairs,
NUTRITIONIST-DIETICIAN agrees that during the term of her employment and from and after the actual
cessation of her employment he shall maintain strict confidentiality and shall not disclose any technical,
business, financial or commercial information, methods, processes, inventions (whether covered by
intellectual property protection or not or whether marked confidential or not) including but not limited
to: customers, customer lists or requirements, price lists, pricing structures, marketing and sales
information, business plans or dealings, suppliers, talents, shareholders, directors, officers, or
employees, financial information, product lines, research activities, plans, designs and formula, whether
authored by NUTRITIONIST-DIETICIAN or otherwise.
Failure to comply with this confidentiality undertaking shall be construed and considered as Gross
Misconduct and shall be deemed a ground for the termination of her employment and shall be charged
accordingly and settle the amount of P250,000.00 for damages plus the cost of Litigation Fees
amounting to 30% of the damages.
10. UNDERTAKING
NUTRITIONIST-DIETICIAN shall work exclusively for the benefit of the EMPLOYER. NUTRITIONIST-DIETICIAN
warrants that he shall comply with all her undertakings and obligations set forth in this Contract and shall
indemnify EMPLOYER of any actual losses, damages, costs and expenses, including attorneys’ fees incurred as
a result of the breach of this Agreement or her willful act, omission, fraud or negligence.
11. TERMINATION
EMPLOYER reserves the right to terminate or cancel this Contract after observing due process for just or
valid causes. Termination may be due to any but not necessarily limited to the following:
• Inefficiency;
• Incompetence;
• Habitual Tardiness;
• Insubordination;
• Breach of confidentiality and non-disclosure
• Violation of EMPLOYER’s intellectual property rights
• Just and authorized causes enumerated in Article 282. 283. And 284 of the Philippine Labor Code;
• Other causes provided in the EMPLOYER Rules and Regulations; and
• Other analogous causes.
NUTRITIONIST-DIETICIAN’s affixing of her signature on the herein Employment contract means that:
1. NUTRITIONIST-DIETICIAN has read and fully understood the terms and conditions hereof and
accepts the same;
2. The terms and conditions for the regularization of her employment have been clearly
communicated to and accepted by him/her at the time of her engagement.
