Why Parking has to be Managed??

to increase parking facilities is not a
solution
 Parking is a major cost to a society
 It affects accessibility to a destination
 A typical automobile is parked for 23 hours a
day and uses several parking spaces a week
 Improper management hinders development
of other transport infrastructure
Bye-Laws to Regulate Parking
Existing Legal Provision
Local Government owns the public street (GPMC Act,1949)
Parking management and enforcement require priority of ULB
The enforcement of parking in the city area is managed by Traffic Police (BPMC Act)

Gujarat Provincial Municipalities Act , 1949


Section 63: Matters to be provided for by the Corporation
Section 230: Prohibition of deposit, etc. of things on street
Section 231: Commissioner may, without notice, remove anything erected, deposited or hawked or
exposed for sale in contravention of Act.
Section 236a: Power to require demolition or alteration of lawfully constructed huts or sheds infringing
rules or bye-laws
The Motor Vehicles Act , 1988
Section 117: Determining parking areas within the city.
Section 122: Towing away of vehicles by the police.
Section 127: Towing away unattended or illegally parked vehicles.
Section 177: Specifies fine amount for first time and repetitive offences.
Section 201: Empowers police to charge vehicles obstructing traffic flow.
Gujarat Motor Vehicle Rules, 1989 (Amended up to December 2006)
Section 190: Empowers police to move a stationary or unattended vehicle
Parking Bye-Laws Under Section 458 of GPMC Act
SMC to enforce the parking in the city. Following procedures will be adopted

Demarcate public parking spaces, Appoint adequately trained Traffic


and ‘no-parking’ spots Enforcement Officers (TEO)

Main Provisions under Parking Bye-Laws

• Municipal Commissioner shall determine where parking is permitted and


where it is not permitted
• Any vehicle left in any public space in a manner that obstructs other road
users, cause safety issues shall be towed/ clamped and fined
• The fines and penalties will be as finalized by Municipal Commissioner
• A Traffic Cell shall be formed within SMC by Municipal Commissioner
• The Director (Traffic) within Traffic Cell shall appoint “Traffic Enforcement
Officers” (TEOs)
– TEOs will conduct frequent surveys in SMC area
– TEOs will tow away/ clamp vehicles that violate parking norms
– Towed vehicles will be taken to nearest impound lot
– Director (Traffic) can appoint private agencies for towing vehicles through
transparent and competitive bidding
• The following standards shall be followed
– Designing on-street parking spaces as per IRC:SP12 (2015)
– Road markings and signage as per IRC:35-1997 and IRC:67-2001

The overarching principle for parking in Surat is “to progressively reduce the demand for
parking and facilitate organized parking for all types of vehicles”.

• To reduce private vehicle usage and dependency through “Travel Demand Management
(TDM)” strategies
• To support public transport use wherever possible.
• To manage demand through pricing and other means

Enforcing Parking

SMC shall enforce parking in Surat


• Legal provision to be made:
– Under sub section 36 of section 458 of GPMC Act, 1949
• Formation of Traffic Cell within SMC headed by
Director (Traffic) of rank of Exec. Engineer or Dy.
MC
• Team of Traffic Enforcement Officers (TEO) to
enforce
– Fine or clamp/ tow away
• 10% of all parking space – off street or on street –
shall be reserved for senior citizens and people
with disabilities

• Sanctioned by General Board of SMC on Dt. 13/10/2017

• Government of Gujarat Sanctioned on 05/12/2018 through Gazette


Notification.

• SMC published notification in newspaper on 21/12/2018 for


implementation.

• Total 20 roads in the city are identified in first phase for On Street
Parking .

• Parking Committee Constituted with 05(five) Deputy Municipal


Commissioners to take decisions about critical issues.

/infrastructures are prepared for Implementation...
• Each road marked for “Parking ” and “No Parking ” White marking is for
“Parking ” & Yellow marking is for “ No- Parking ”.
• Clamps / Locks are purchased by SMC for to lock the wheels of Vehicles Parked
in “ No Parking” area.
Rate for unlocking,
Four Wheelers (4-W) – Rs.100
Three Wheelers (3-W) – Rs.50
Two Wheelers (2-W) – Rs. 25
• Citizens were informed about the implementation one month in advance
through newspaper.
• One month kept free for all vehicles on the designed on street parking on roads
for awareness.
• Training imparted to all concerned staff through meetings and on field.
• All adjoining roads along Multilevel Parking designated as “ No- Parking ”.

• Signage/Notifications on Roads and Other Infrastructure are prepared for


Implementation.

• Dt. 21/02/2019– Implementation of “ Parking Policy & Byelaws “ started on the


designated roads.

• Notifications issued for Assistant Municipal Commissioner as designated officer


for the concern zone and the staff as Traffic Enforcement Officers.
• Marshalls were allotted to zones ( 15 each zone) for enforcement.

• Initially manual receipts are issued. (First 30 minutes kept free)


• ETM are procured with application at front – end and back end by GPS based SIM
Card
• Gradual implementation to other roads as well.
