ANGELINA T. PALMA, of legal age, widow, Filipino citizen, with residence address at
Brgy. East Rembo, Makati City; and
ROLINA PALMA-GRANA, of legal age, married, Filipino citizen, with residence address
at Brgy. East Rembo, Makati City
WITNESSETH:
WHEREAS, we are the legitimate heirs of the deceased ROBERTO A. PALMA, who died
on October 16, 2002 in Makati City, Philippines. A Certified True Copy of his Certificate of Death is
hereto attached and made integral part as Annex “A”;
WHEREAS, ROBERTO A. PALMA died intestate, without Will or Testament, and without
any outstanding debts in favor of any person or entity;
WHEREAS, ROBERTO A. PALMA is the absolute and registered owner of a parcel of land
with improvement located in Makati City, Philippines, covered by Original Certificate of Title No.
5040 of the Registry of Deeds of Makati City, free from all liens or encumbrances of whatsoever kind
or nature, and more particularly described as follows:
Bounded on the SE., along line 1-2 by Lot 7, on the SW., along lines 2-3-4; on the
NW., ALONG LINE 4-5, BOTH BY Road lot 19; and on the NE., along line 5-6 by Lot 11;
along line 6-1 by Lot 10, all of Block 37 of the Subdivision Plan.
Beginning at a point marked “1” on plan, being S. 70 deg. 10 E., 3468.25 m. from
BLLM No. 1, Mcadm 571-D, Makati Cadastral Mapping, thence:
This lot was surveyed in accordance with law and existing rules and regulations
promulgated thereunder, date of original survey, during 1909 and that of the Subdivision
Survey, on June 10 to Nov. 15, 1987, by Alfredo P. Muncada, Private Geodetic Engineer and
was approved on March 08, 1988.
NOW THEREFORE, pursuant to Section 1, Rule 74 of the Revised Rules of Court, and in
considerations of the foregoing premises herein, do hereby divide, and adjudicate unto themselves the
above-described real property the parcel of land described above, in PROPORTIONATE shares, that
is, SEVENTY FIVE PER CENT (75%) to ANGELINA T. PALMA; and TWENTY FIVE PER
CENT (25%) to ROLINA PALMA-GRANA.
That the parties hereby warrant that they have executed the above agreement at their own free
will, without fraud, force, intimidation or undue influence being exerted upon each of their persons,
and they hereby declare further that they have received their just and proper share and have no further
claim whatsoever against each other.
That extrajudicial settlement covers only the above-described property, and in the event that
the other properties pertaining to the estate of the herein decedent is found or discovered, the parties
hereby agree to execute a separate instruments pertaining thereto.
