What is Master Plumber?
According to Revised National Plumbing Code of
the Philippines (RNPCP)
A person technically and legally qualified and licensed to
practice the profession of Master Plumbing without limitations
in accordance with Republic Act 1378, having passed the
examinations conducted by the Professional Regulation
Commission has received a Certificate of Registration from
the Board of Master Plumbing and possess the current license
to practice.
What is Plumbing?
Plumbing is the art and techniques of installing
pipes, fixtures and other apparatuses in
buildings for bringing in the Supply, liquids,
substances and/or ingredients and removing them and

such water, liquid and other carried Wastes


hazardous to health, sanitation, life, property, also the

What is Law

According to Business Dictionary:

The binding rules of conduct meant to enforce justice


and prescribe duty or obligation, and derived largely
from custom or formal enactment by a ruler or
legislature. These laws carry with them the power and
authority of the enactor, and associated penalties for
failure or refusal to obey. Law derives its legitimacy
ultimately from universally accepted principles such as
the essential justness of the rules, or the sovereign
power of a parliament to enact them.
What is Special Law

According to Merriam Webster:

a law that applies to a particular place or especially to a


particular member or members of a class of persons or
things in the same situation but not to the entire class
and that is unconstitutional if the classification made is
arbitrary or without a reasonable or legitimate
justification or basis.

SECTION 2 (a)

The practice of plumbing within the meaning and intent of this Act shall
embrace services in the form of consultations, designing, preparation
of plans, specifications, estimate, installation and supervision of
plumbing work including the inspection and alteration of all pipings to
fixtures, appliances, and appurtenances in connection with any of the
following: storm and sanitary drainage, facilities of buildings, the
sanitary venting of fixtures, hot or cold water supply systems
within or adjacent to any building, storm drains, sewerage systems
of any premises and/or connection with any public disposal or any
acceptable terminal. The enumeration in this paragraph shall not be
construed as excluding any other work requiring plumbing knowledge
and application”

Section 5
The President of the Philippines is hereby authorized to issue
rules and regulations to carry into effect the objectives of this Act,
upon recommendation of the Board of Examiners for Master
Plumber and in consultations with a duly registered national
association of master plumbers, in accordance with the following
basic principles, except in cases where it may prove oppressive or
excessively burdensome to those without sufficient means and to
such buildings, structures or constructions valued at five thousand
pesos or less:

a. All premises intended for human habitation, occupancy, or use shall be
provided with a supply of pure and wholesome water, neither connected with
unsafe water supplies nor subject to the hazards of backflow or back
siphonage.

b. Plumbing fixtures, devices all appurtenances shall be supplied with water


in sufficient volume and at pressures adequate to enable them to function
satisfactory and without undue noise under all normal conditions of use.

c. Plumbing shall be designed and adjusted to use the minimum quantity of


water consistent with proper performance and cleaning.

d. Devices for heating and storing water shall be so designed and installed as
to prevent dangers from explosions through overheating.

e. Every building having plumbing fixtures installed and intended for
human habitation, occupancy, or use on premises abutting on a street,
alley, or easement in which there is a public sewer shall have a connection
with the sewer.

f. Each family dwelling unit on premises abutting on sewer or with a


private sewerage-disposal system shall have, at least, one water closet and
one kitchen-type sink. It is further recommended that a lavatory and
bathtub or shower shall be installed to meet the basic requirements of
sanitation and personal hygiene. All other structures for human occupancy
or use on premises abutting on a sewer or with a private sewage-disposal
system shall have adequate sanitary facilities but in a no case less than one
water closet and one other fixture for cleansing purposes.

g. Plumbing fixtures shall be made of smooth non–absorbent material, and


shall be free from concealed fouling surface.

h. The drainage system shall be designed, constructed, and maintained so


as to guard against fouling, deposit of solids, and clogging, and with
adequate cleanouts so arranged that the pipes may be readily cleaned.

i. The piping of the plumbing system shall be of durable materials, free
from defective workmanship and so designed and constructed as to give
satisfactory from service for its reasonable expected life.

j. Each fixture directly connected to the drainage system shall be


equipped with a water-seal trap.

k. The drainage system shall be designed to provide an adequate


circulation of air in pipes with no danger of siphonage, aspiration, or
forcing of trap seals under condition of ordinary use.

l. Each terminal shall extend to the outer air and be so installed as to


minimize the possibilities of clogging and the return of foul air to the
building.

m. The plumbing system shall be subjected to such tests as will


effectively disclose all leaks and defects in the work.

n. No substance will clog the pipes, produce explosive mixtures,
destroy the pipes or their joints, or interfere unduly with the sewage
disposal process shall be allowed to enter the building drainage system.

O. Proper protection shall be provided to prevent contamination of


food, water, sterile goods, and similar materials by backflow of
sewage. When necessary, the fixture, device, or appliance shall be
connected indirectly with the building drainage system.

p. No water closets nor urinal shall be located in a room or


compartment which is not properly lighted and ventilated.

q. If water closet or other plumbing fixtures are installed in buildings


where there is no sewer within a reasonable distance, suitable
provision shall be made for disposing of the building sewage by some
accepted method of sewage treatment and disposal.

r. Where a plumbing drainage system may be subjected to backflow


of sewage, suitable provision shall be made to prevent its overflow in
the building.

s. Plumbing system shall be maintained in a sanitary and serviceable


condition.

u. Plumbing shall be installed with due regard to preservation of the


strength of structural members and prevention of damage to walls
and other surfaces through fixture usage.

v. Sewage or other waste from the plumbing system which may be


deleterious to surface or subsurface waters shall not be discharged
into the ground or into any waterway unless it has first been rendered
innocuous through subjection to some acceptable form of treatment.

Section 2. Definition of Terms.- The practice of sanitary engineering
within the meaning and intent of this Act shall embrace
the following activities:
Sanitary surveys, reports, design, direction, management,
consultation, and investigation of:

a.Water purification plants, water collection and distribution systems,


reservoirs, drainage and sewer systems, sewage treatment plants,
malaria control structures, sewage disposal tanks, and other
structures for public health and welfare.

b.Projects relating to stream pollution, insect and vermin control or


eradication, rural and camp sanitation, and milk and food sanitation.

c.Systems for the prevention of atmospheric pollution or the control of


indoor air, especially the air of working spaces in industrial
establishments (industrial hygiene engineering).

WHY THERE IS A CONFLICT?
On February 19, 1977, President Ferdinand
Marcos promulgated PD 1096 otherwise
known as the National Building Code.

WHY THERE IS A CONFLICT?
Within the same year, the 1977 Implementing Rules and
Regulation of the said National Building Code (P.D. 1096)
also known as the 1977 IRR-NBC or Old IRR-NBC was
promulgated. Rule I, Section 3.2.2.2 on Sanitary/Plumbing
of said Old IRR-NBC, however, empowered sanitary
engineers to sign and seal application for “new sanitary
installation with more than twenty (20) units plumbing
installation, water supply, storm drainage ” thereby
effectively removing the exclusive authority of master
plumber to do plumbing works and authorizing sanitary
engineers to practice actions

SECTION 102. Declaration of Policy


It is hereby declared to be the policy of the State to safeguard
life, health, property, and public welfare, consistent with the
principles of sound environmental management and control; and

buildings and structures, a framework of minimum standards and
requirements to regulate and control their location, site, design,
quality of materials, construction, use, occupancy, and
maintenance

RULE 1 – Building Permit Applications
Sec 3.2.2.2 SANITARY/PLUMBING
a. For new sanitary installation with more than twenty (20) units of plumbing
installation, water supply, storm drainage, water purification and sewage
treatment plant, applications shall be accompanied by sanitary plans and
specifications signed and sealed by a duly licensed Sanitary Engineer containing
the following:
1. Sanitary plan, lay-outs and details.
2. Isometric drawings of roughing-ins of sanitary drainage, ventilation lines,
hot and/or cold distribution/supplies to plumbing fixtures and
equipment.
3. Detail drawings of Imhoff tanks/septic tanks in the absence of disposal to
the street sanitary sewer, sewage treatment plant.
4.Riser diagram of drainage including details of miscellaneous appurtenances
such as manholes, junction boxes, catch basins, water/sewer/storm
drainage connections.
5. Designs analysis, technical specifications.
6. Estimate of cost (for statistical purposes only).
7. Detail drawings of deep well water source and water treatment device in
the absence of municipal water system.

b. For additional and/or alteration of existing sanitary installation involving
more than twenty (20) units of plumbing installations, water supply, storm
drainage, water purification and sewage treatment plant, application shall be
accompanied by sanitary plans and specifications signed and sealed by a duly
licensed Sanitary Engineer, containing the following:
1. Design analysis and plans of the original installation.
2. Plans and detail drawings of additional installation.
3. Estimated cost of additional/altered installation (for statistical purposes only).

c. For new sanitary installation with more than twenty (20) units of plumbing
installations and water supply, the Engineering Documents signed and sealed
by a duly licensed Master Plumber who is also registered Engineer or a Master
Plumber who has been issued a Certificate of Recognition as a Designer by the
Board of Master Plumbers shall include the following:
1. Sanitary plan, layouts and details.
2. Isometric drawings of roughing-ins of ventilation lines, hot and/or cold
distribution/ supplies to plumbing fixtures and equipment.
3. Design analysis, technical specifications.
4. Estimate of cost (for statistical purposes only).

NAMPAP contested the validity of the above-
mentioned provision of the Old IRR-NBC through
Civil Case No. 97-84998 which it filed with the
regional Trial Court of Manila, Branch 38 but the
Court ruled in favor of the validity of the mentioned
provision in an Order dated April 13, 1998.

. Appeal was DISMISSED on the ground of being a wrong mode of appeal


because the issues are pure questions of Law which must directly brought
to the Supreme Court.
Upon denial of their motion for reconsideration herein respondents-
appellants ( DPWH , NAMPAP ) elevated the matter to the Supreme Court
via a petition for review on certiorari docketed as G.R.No. 229953
On March 20, 2017, the Supreme Court issued a resolution remanding the
appealed case to the court of appeals for adjudication on the merits, with
a directive to resolve the same with dispatch.
The case is REINSTATED and submitted for decision anew.

Revised National Plumbing Code
Revised National Plumbing Code (RNPC) was passed
and took effect on April 30, 2000 after its publication in
the Official Gazette. The RNPC was proposed by
NAMPAP and adopted into a resolution by the Board of
Master Plumbers (BOMP) as Board of Master Plumbers
Resolution No. 4, series of 1999 pursuant to Section. 4
and 5 of the National Plumbing Code (R.A. 1378) An Act
to Regulate the Trade of Master Plumber). The same was
approved by the Professional Regulation Commission
(PRC) and the President of the Republic of the
Philippines on September 30, 1999

Section 101 – TO WHOM PERMITS MAY BE ISSUED


No permit shall be issued to any person, firm or corporation, to do or
cause to be done any installation of plumbing work regulated by
this Code, except to Registered and Licensed Master Plumber, holding
a valid, unexpired and unrevoked certificate of registration as required
by Republic Act No. 1378, as amended.

Section 102.2
Plans and Specifications – all plumbing plans, drawings,
diagrams, design analyses/computations as required, technical
specification, bills of materials and other required documents for all types
of occupancy shall be prepared, signed and sealed by a Registered
and Licensed Master Plumber, without limitations, pursuant to Republic
Act 1378, as amended, and shall be submitted in six (6) sets of the
aforementioned requirements with each application for a permit

The RNPC by virtue of the above quoted provisions clearly removed from
sanitary engineers the right to practice master plumbing previously granted
to them under the Old IRR-NBC77. Thus, the Philippines Society of Sanitary
Engineers (PSSE) challenged the validity of these provisions of the RNPC
in the same civil case NAMPAP earlier filed before the RTC-Manila (Civil
Case No. 97-84998) by asking for the issuance of a Temporary Restraining
Order against NAMPAP. PSSE sought to enjoin NAMPAP from
implementing Sections 101, 102, and 102.2 of the RNPC on the ground
that it is contrary to Rule I, Section 3.2.2.2 of the Old IRR-NBC77 and the
Order of said Court which upheld the validity of said provision.

The Court, however, denied PSSE’s application stating that is has no


jurisdiction over the issue presented by PSSE in an Order it issued on
August 24, 2000. In ruling as such, the Court stated:

“While this Court declared as valid the provision of the
said Implementing Rules and Regulating vesting only on duly
licensed sanitary engineers the right to install more than 20 units
of plumbing Installation, limiting licensed master plumbers’ work and
function to installation of 20 or less units of plumbing installations
,such Court ruling does not operate to limit the rule-making
power of the agency of the government in which the
same is vested as to preclude it from adopting rules that will
provide otherwise. The Court does not legislate. Its mandate is to
interpret and apply laws.

The Court notes that under the previous law


specifically under Republic Act No. 1378 (the Plumbing
Code), the licensed master plumbers were authorized to put up
more than 20 units of plumbing installation, a right reverted
to them by the Revised Plumbing Code being questioned by
defendant PSSE”

Effectively, as of this date, there is nothing that prevents the


implementation of the Revised National Plumbing Code
(RNPC).

In Filipino Pipes and Foundry Corporation vs. Total 2000


Corporation (G.R. No. 141465,January 23, 2002) the
Supreme Court ruled that the Revised Plumbing Code of the
Philippines after it was published in the Official Gazette is in
force and effect.
Revised National Plumbing Code

Even before the effectivity of the RNPC and the now


repealed Old IRR-NBC77, there were already various
prohibitions provided for by law (which are still in effect) for
practice of master plumbing by persons other that
duly licensed and registered master plumber. The said
prohibitions are specifically contained in Sections 20 and
22 of National Plumbing Code (which state:

Section 20. Any person who shall engage in plumbing in the Philippines
without being registered in accordance with the provision of this Act, or
any person presenting or attempting to use as his own the certificate of
registration of a registered master plumber, or any person who shall give
any false or forged evidence of any king to the Board, or any person who
shall impersonate any registered master plumber, or any person who
shall attempt to use a revoked or suspended certificate ofregistration, or
any person who shall use in connection with his name or otherwise
assume, use, or advertise any title or description tending to convey
the impression that he is a registered master plumber, without holding a
valid certificate of registration, or any person who shall violate any of
the provisions of this Act shall be guilty of a misdemeanor and
shall, upon conviction, be sentenced to a fine of not less than five
hundred pesos nor more than two thousand pesos, or to
suffer imprisonment for a period of not less than six months nor more
than one year, or both, in the discretion of the court.

Section 22. As soon as this Act shall take effect, any person
desiring to practice the trade of master plumber, shall be required
to obtain a certificate of registration in the manner and under the
conditions, herein provided. All master plumber duly registered and
examined under
the provisions of the city ordinances in force one year prior to the
effectivity of this Act and all persons with at least five years of
continuous practice as plumber and certified to as capable to practice
the trade by the Board of Examiners, within one year after the
effectivity of this Act, shall be automatically registered under the
provisions hereof. Certificates of registration held by such person
in good standing shall have the same force and effect as though the
same had been issued under the provisions of this Act

Also section 33 of Sanitary Engineering Law (R.A.
1364) Provides:
Section 33. Act Not Affecting Other Provision
and/or Trades.- This Act shall not be construed to
affect or prevent the practice it any other
legally recognized profession, and/or trade
nor shall it be construed to diminish the fields
of practice already embrace by civil engineers
duly registered under the Civil Engineering Law,
Republic Act Numbered Five hundred and forty
four, or of those by duly licensed master plumber
under existing law.
Current Practice
Despite, the foregoing prohibitions and Section 33 of
their own enabling law [Sanitary Engineering Law (R.A.
1364)]. Sanitary engineers still persist and are being
allowed to practice master plumbing by some Building
Officials by allowing them to prepare and sign plumbing
documents required under the National Building Code
and doing plumbing installation within or adjacent to
buildings. They are also allowed to assume position in
the office of the Building Official, which deals on
plumbing.

ensure and support, among other things, the preservation and
enrichment of culture, promote health and safety, enhance the
right of the people to a balanced ecology, encourage and support
the development of appropriate and self-reliant scientific and
technological capabilities, improve public morals, enhance
economic prosperity and social justice, promote full employment
among their residents, maintain peace and order, and preserve the
comfort and convenience of their inhabitants.

Section 17 Basic Services and Facilities.


(a) Local government units shall endeavor to be self-reliant and
shall continue exercising the powers and discharging the
duties and functions currently vested upon them. They shall
also discharge the functions and responsibilities of national
agencies and offices devolved to them pursuant to this Code.
Local government units shall likewise exercise such other
powers and discharge such other functions and
responsibilities as are necessary, appropriate, or incidental to
efficient and effective provisions of the basic services and
facilities enumerated herein.

and estimates of drainage, soil and water conservation and
management systems and facilities agricultural and
biosystems power and machinery, agricultural and biosystems
buildings and structures, renewable/bio-energy systems and
farm electrification agricultural and biological waste utilization
and management, agricultural and bio-automation and
instrumentation system.”

Sub-Section 27.5
under the Draft IRR of PABE Act, which states that “All drawings,
plans and other documents and reports which an Agricultural and
Biosystems Engineer shall sign and seal include but not limited to
the following: a) Perspective; b) Location and Vicinity Plan; c)
Site/Farm Development Plan; d) Detailed Engineering Design; e)
Plans/details of structural elements/components and its accessory
facilities; f) Technical Specifications; g) Inspection, Test, and/or
Evaluation Reports.”, have similarities on the scopes of practice of
various technical professionals, particularly on the signing and
sealing of plans and related documents as part of the documentary
requirements in the application of Building Permit under Section 302
(4) to (10) of the Revised IRR of the National Building Code of the
Philippines (P.D. 1096).

AN ACT REGULATING THE PRACTICE OF MECHANICAL
ENGINEERING IN THE PHILIPPINES
“Philippine Mechanical Engineering Act of 1998”
Section 35. Preparation of Plans and Supervision of
Construction by Licensed Engineers Required
It shall be unlawful for any person to order or
otherwise cause the fabrication, construction,
erection, installation or alteration of any mechanical
equipment, machinery or process for any mechanical
works, projects, or plants, unless the designs, plans,
layouts or specifications have been prepared by or
under the responsible charge of, and duly signed and
sealed by a Professional Mechanical Engineer.
Section 35. Preparation of Plans and Supervision of
Construction by Licensed Engineers Required.

Likewise, proposals and quotations for the supply


and fabrication of mechanical equipment, works,
projects, plants, mechanical pollution abatement
systems, mechanical fire protection systems,
pressurized pipes with a working pressure of not
less than 70 kpa., shall be duly signed and
sealed by a Professional Mechanical Engineer.

Section 46. Repealing Clause. – Commonwealth Act


No. 294, as amended by Republic Act No. 5336, is
hereby repealed and all other laws, parts of law,
orders, ordinances, or regulations relative to the

Section 7. Legal Recognition of Electronic Documents -


Electronic documents shall have the legal effect,
validity or enforceability as any other document or

and reliability and can be authenticated so as to be
usable for subsequent reference, in that -
