n° 2702021AICES007 regarding the medical evaluation of his child Vicky Esther

AGUIRRE CARBALLO, and
WHEREAS, article 3 of Law 26790, Social Security Modernization Act on the Health
Scheme (ESSALUD) sets forth that the insured’s children who are of legal age and
totally or permanently disabled are entitled to receive the services of ESSALUD as
beneficiaries, provided they are not compulsorily insured.
WHEREAS the total and permanent disability of the insured's adult child is
determined by Peru´s Social Security as per article 30 of the Supreme Decree 009-97-
SA, Regulation of Law 26790.
WHEREAS the filiation between the pensioner and Vicky Esther AGUIRRE
CARBALLO is confirmed by means of birth certificate n° 411, issued by the Provincial
Municipality of Chiclayo.
WHEREAS, in the opinion the Commission on Disabilities, Vicky Esther AGUIRRE
CARBALLO was assessed and diagnosed with Moderate mental retardation F71.1
and Spastic hemiparesis, predominantly crural G81.1. Consequently, Vicky
Esther AGUIRRE CARBALLO has been declared as a person with total and
permanent disability to work and that there is NO need to carry out further
evaluations by the Commission on this matter.
In the use of the powers vested in me,
Be it therefore RESOLVED:
1 TO DECLARE that Vicky Esther AGUIRRE CARBALLO, daughter of
Santiago D. AGUIRRE CACERES, is a person with total and permanent
disability. NO further evaluations by the Commission are required on this
matter.
Let this be recorded and communicated.
