We refer to our Target Schedule dated 26th September 2011 submitted through
email dated 26.09.2011.
The base line schedule previously submitted showing a completion date of 6th April
2012 was revised to show a target completion date of 23rd March 2012 based on
ESG’s request to Yamani to endeavor to complete prior to the contractual Time for
Completion of 8 months. We request you to kindly formally return the schedules,
with comments if any, so that the base line schedule and target schedule can be
formally established.
For the sake of good order we wish to record that we have not been issued till
date any drawings for any buildings with which we can start any permanent
construction works. Our works till date has been limited to mobilization and
earthworks. Due to the lack of approved and issued for construction drawings for
Building C, we are currently proceeding with backfilling works in between the
foundation trenches in an effort to mitigate the delays even though this out-of-
sequence work may result in rework requirement due to damaged earth
embankments during RCC works.
The commencement of the construction of the Ware house C, Building A and A1,
Guard House, Substation and Pump room, compound wall etc., are all already
delayed or are definitely going to be delayed due to the time required for ESG to
obtain the necessary approvals from the Authorities. For information that has been
supplied to us, design cross-verifiWATion is in progress; however the submittal
and approvals can be only through the Authority approved Engineer and this is a
factor outside Yamani’s control.

We refer to ESG’s response to our Request For Variation RFV 01 dated 3 rd October 2011
(copy attached for ready reference).
The RFV was submitted by us to formally record our contractual right to be compensated
for the differences between subcontract drawings and subsequently issued drawings.
As you are aware, Yamani’s subcontract is based on clearly identified items in the BOQ and
the related subcontract drawings. The following are very clear and undisputable variations
to Yamani’s scope of works, as you would no doubt agree:-
- Any revisions to the drawings on the basis of which the subcontract agreement was
entered into and
ESG’s response is not clear to us. Kindly confirm that the item conveyed through the
above RFV is a variation in principle. The actual amount of variation shall be submitted in
due course when all associated details and information are clearly known.

Further to approval of 27 footings for building C1, all arrangements were ready for the
casting of these footings by 4.00PM on 23.10.2011. You have instructed us to hold casting
of these footings till further instruction and clearance from your end.
Please note that holding of above activities from your side is directly delaying progress of
the project. Also planning and scheduling for the next pour has affected negatively. We
await your clearance at the earliest possible. Delays caused in this regard will not be in
our account.

Dear Sirs,
Please find attached the relevant extracts from (i) our design consultant’s
recommendations regarding the backfilling below the warehouse grade slab (ii) soil test
report and (iii) extract from specifications
As you can see from the highlighted tables in the attachments, the recommended material
for backfilling is the same as the ‘Type A’ material as per the soil test report. Hence we
confirm that there is no requirement for a road base layer below the grade slab. The
required parameters for the backfilling to suit the intended purposes of the works can be
achieved through the use of the backfill material available at site, if the works are carried
out as per the designer’s recommendations.
Based on the above we consider the road base layer to be a superfluous item for the
project.

Dear Sirs,
Subject: Notice of Delay Due to late handing over of Work front and Information
With reference to the above mentioned subject and the attached schedule update as of
11th Nov-11 for the project we wish to highlight our grave concerns and apprehensions
regarding the work progress and overall impact on the completion of the project.
Initially, based on ESG’s request, and our willingness to complete the works early we had
agreed to follow a target programme which shall be 15 days shorter from the original
baseline finish date of 6th April-2012. The date for completion based on ESG’s request falls
on 23rd March-2012 which was based on the assumption of getting all the available work
area and information to suit commencement and progress of the works, but due to
reasons unknown to us we have not been handed over the works area as below:
It is very obvious from the schedule updates that we are lagging behind the original start
and completion date for the above mentioned areas due to delay in handing over of the
said area which is driving the schedule and impacting the overall completion of the
schedule. Moreover, we have mobilized our resources accordingly but we are not being
delivered the entire work front to works as per the programme.

At site discussions and meetings we are being told to complete the works as per the
original target dates which is not possible due to the ongoing delays in handing over of the
area which is affecting the overall schedule completion of the project. Please note that we
require a minimum duration as agreed in the baseline programme in order to work within
the parameters of time, cost and quality and any further request for completing the
project before the impacted schedule finish date shall deem us to prepare a recovery
programme by means of acceleration or fast tracking which means engaging extra
resources and working extra time than the originally planned baseline programme which
will ask for a separate accelerate/recovery programme to be followed.
In view of the above fact, we request you to review and suggest us on the acceleration
programme so that we can prepare the same and submit to you for your review along with
the associated cost impact.
Also pursuant to conditions of the Contract, we hereby notify you that we are suffering
from a delay of 57 days from the Target programme (as per the request of Client) and 43
days from the original submitted baseline programme due to delay in handing over of the
entire construction area as per the baseline programme. As the delay is ongoing it is
impossible to advise the effects of this further delay at present but we shall keep you
updated with the status.
