RE: RESOLUTION OF THE ADMINISTRATIVE CONFISCATION PROCEEDINGS


PERTAINING TO THE APPREHENSION OF FIFTEEN (15) PIECES OF ABANDONED
LOGBOLTS OF NATURAL GROWN TREE SPECIES (BONOL, BAGRAS,
MALACOPA AND ULAYAN) WITH AN AGGREGATE VOLUME OF 15.91 CUBIC
METERS / 6,745.84 BOARD FEET WITH A CORRESPONDING MARKET VALUE OF
PHP 79,550.00 FOUND AT SITIO MAMUANGOT, BARANGAY TALIAN,
MARAGUSAN, DAVAO DE ORO PROVINCE.

That, on May 21, 2021 around 9:00 am Maragusan Patrol Sector conducted site visit visit and
geo-tagging of ENGP projects, but apparently noticed a stockpiled of natural grown species in log
bolts form concealed in a shrubby area alongalong Maragusan – Caragan Valley road. Instantly,
they called this office for assistance in the conduct of apprehension.

THAT, on May 22, 2021 Enforcement team of this office immediately proceeded to the said
area for verification, identification and scaling of said forest forest products. The team
coordinated with the Barangay Captain of Talian, Maragusan Hon. Berlito Estorco. That upon
identification and scaling the team team disclosed a total of fifteen (15) pieces of natural grown
species namely Bagras, Bonol, Malacopa and Ulayan with an aggregate volume of 15.91
cubiccubic meters / 6,745.84 board feet located at Sitio Mamuangot, Talian, Maragusan,
Davao de Oro Province.

THAT, the said forest products were abandoned considering that there is no claimclaimant or
interested party came or present in the area and was deposited at DENR Forest Products
Monitoring Station at Maragusan, Davao de Oro under the protective custody of FT I Jomar L.
Villarta.

THAT, on June 07, 2021, administrative proceeding was conducted at DENR-CENRO,


Monkayo office and the presence of probable cause for violation of Section 77 of PD 705
(Forestry Code of The Philippines) was established. Premises considered be it.

‘’RESOLVE FINALLY, that the apprehended/seized forest product consisting of fifteen (15)
pieces of abandoned logbolts of natural grown tree species (Bonol, Bagras, Malacopa and
Ulayan) with an aggregate volume of 15.91 cubic meters / 6,745.84 board feet are
presumed illegally cut therefore recommended for confiscation in favor of the
Government.’’

SO RESOLVE. This 7th day of June 2021 at Province of Davao De Oro


Municipality of Monkayo, Philippines.
