‫ﺇﺗﻔﻖ ﺍﻟﻄﺮﻓﺎﻥ ﻋﻠﻰ ﺍﻟﻨﻘﺎﻁ ﺍﻟﺘﺎﻟﻴﺔ ‪:‬‬

‫‪ .1‬ﻳﻘﻮﻡ ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﺑﺘﻨﻔﻴﺬ ﺍﻟﻔﻘﺮﺍﺕ ﺍﻟﻮﺍﺭﺩﺓ ﻓﻲ ﺍﻟﻌﺮﺽ ﺍﻟﻤﺮﻓﻖ ﻭ ﺍﻟﻤﻘﺪﻡ ﻣﻦ ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ )ﺍﻟﺨﺎﺻﺔ ﺗﺠﻬﻴﺰ ﻭﻧﺼﺐ‬
‫ﻭﺗﺸﻐﻴﻞ ﻭﺗﺎﺳﻴﺲ ﺟﻤﻴﻊ ﺍﻻﻋﻤﺎﻝ ﺍﻟﻜﻬﺮﺑﺎﺋﻴﺔ ﻭﺣﺴﺐ ﺗﻮﺟﻴﻬﺎﺕ ﺍﻟﻤﻬﻨﺪﺱ ﺍﻟﻤﺸﺮﻑ ﻭﺑﻤﻮﺟﺐ ﺍﻟﻤﻮﺍﺻﻔﺎﺕ ﺍﻟﻤﺬﻛﻮﺭﺓ‬
‫ﻓﻲ ﺍﻟﻌﺮﺽ ﻭ ﺟﺪﻭﻝ ﺍﻟﻜﻤﻴﺎﺕ ‪.‬‬

‫‪ .2‬ﻳﻘﻮﻡ ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﺑﺘﻮﻓﻴﺮﺍﻟﻤﻮﺍﺩ ﺍﻟﻼﺯﻣﺔ ﻟﺘﻨﻔﻴﺬ ﺍﻟﻌﻘﺪ ﺑﻤﻮﺟﺐ ﺍﻟﻨﻮﻋﻴﺎﺕ ﻭ ﺍﻟﻤﻨﺎﺷﻲء ﺍﻟﻤﺘﻔﻖ ﻋﻠﻴﻬﺎ ﻭﺣﺴﺐ ﺍﻟﻤﻮﺍﻓﻘﺎﺕ‬
‫ﻣﻊ ﺍﻟﻄﺮﻑ ﺍﻻﻭﻝ‪.‬‬

‫‪ .3‬ﻳﻠﺰﻡ ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﺑﺎﻟﺘﺠﻬﻴﺰ ﻭﺑﺪء ﺍﻟﻌﻤﻞ ﺧﻼﻝ ﻓﺘﺮﺓ ﺗﺘﻨﺎﺳﺐ ﻣﻊ ﺟﺪﻭﻝ ﺗﻘﺪﻡ ﺍﻟﻌﻤﻞ ﻭﻣﻦ ﺗﺄﺭﻳﺦ ﺍﺳﺘﻼﻡ ﺍﻟﺪﻓﻌﺔ‬
‫ﺍﻟﻤﻘﺪﻣﺔ ﻭﺍﻟﺒﺎﻟﻐﺔ ﻣﺒﻠﻐﺎ ﻭﻗﺪﺭﻩ ‪ $50000‬ﺧﻤﺴﻮﻥ ﺍﻟﻒ ﺩﻭﻻﺭ ﺍﻣﺮﻳﻜﻲ ‪.‬‬

‫ﺛﺮ ﺳﻠﺒﺎ ً ﻋﻠﻰ ﻣﺠﺮﻳﺎﺕ ﺍﻟﻌﻤﻞ ‪ ،‬ﻓﺴﻮﻑ ﻳﺘﻢ ﺍﻷﺗﻔﺎﻕ ﺑﻴﻦ ﺍﻟﻄﺮﻓﻴﻦ ﻟﺘﺤﺪﻳﺪ‬‫‪ .4‬ﻋﻨﺪ ﺣﺪﻭﺙ ﺃﻳﺔ ﺣﺎﻟﺔ ﻁﺎﺭﺋﺔ ﻭﺍﻟﺬﻱ ﻗﺪ ﻳﺆ‬
‫ﺍﺿﺎﻓﺔ ﻣﺪﺓ ﻣﻼﺋﻤﺔ ﻋﻠﻰ ﻣﺪﺓ ﺍﻟﻌﻘﺪ ﺍﻷﺻﻠﻴﺔ‪.‬‬

‫‪ .5‬ﻳﻘﻮﻡ ﺍﻟﻄﺮﻑ ﺍﻷﻭﻝ ﺑﺘﻬﻴﺌﺔ ﺍﻟﺨﺮﺍﺋﻂ ﻭﺍﻟﻤﺨﻄﻄﺎﺕ ﺍﻟﻤﺼﺪﻗﺔ ﻣﻦ ﻗﺒﻞ ﺭﺏ ﺍﻟﻌﻤﻞ ﻟﻠﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﻭﻓﻲ ﺍﻷﻭﻗﺎﺕ ﺍﻟﻤﻨﺎﺳﺒﺔ‬
‫ﻭﺑﻌﻜﺴﻪ ﻳﻤﻨﺢ ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﻣﺪﺓ ﺍﺿﺎﻓﻴﺔ‪.‬‬

‫‪ .6‬ﻳﻠﺘﺰﻡ ﺍﻟﻄﺮﻑ ﺍﻷﻭﻝ ﺑﺪﻓﻊ ﻣﺒﻠﻎ ﺍﻟﻌﻘﺪ ﺍﻟﺒﺎﻟﻎ ﻗﺪﺭﻩ )‪ (5000-1500‬ﺩﻭﻻﺭ ﺍﻣﺮﻳﻜﻲ ﺷﻬﺮﻳﺎ ﻋﻠﻰ ﺷﻜﻞ ﺩﻓﻌﺎﺕ ﺳﻠﻒ‬
‫ﻟﻤﺴﺘﺤﻘﺎﺕ ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ‪ ,‬ﻭﺣﺴﺐ ﺍﻟﻨﺴﺐ ﺍﻟﻤﺘﻔﻖ ﻋﻠﻴﻬﺎ ﻭﺣﺴﺐ ﺟﺪﻭﻝ ﺗﻘﺪﻡ ﺍﻟﻌﻤﻞ ‪.‬‬

‫‪ .7‬ﺍﻥ ﺃﺳﻌﺎﺭ ﺟﺪﻭﻝ ﺍﻟﻜﻤﻴﺎﺕ ﻫﻲ ﺑﺎﻟﺪﻭﻻﺭ ﺍﻷﻣﺮﻳﻜﻲ ﻭﻻ ﻳﺤﻖ ﻷﻱ ﻁﺮﻑ ﺗﻐﻴﻴﺮ ﺃﻭ ﺍﻟﻤﻄﺎﻟﺒﺔ ﺑﺎﻟﺘﻌﻮﻳﻀﺎﺕ ﻓﻲ ﺣﺎﻟﺔ‬
‫ﺗﻐﻴﻴﺮ ﺳﻌﺮ ﺻﺮﻑ ﺍﻟﺪﻭﻻﺭ ﻣﻘﺎﺑﻞ ﺍﻟﺪﻳﻨﺎﺭ ﺍﻟﻌﺮﺍﻗﻲ‪.‬‬

‫‪ .8‬ﻳﻠﺰﻡ ﺍﻟﻄﺮﻑ ﺍﻻﻭﻝ ‪ ،‬ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﺑﺘﻘﺪﻳﻢ ﺿﻤﺎﻥ ﺑﺎﻻﺟﻬﺰﺓ ﻟﻤﺪﺓ ﺳﻨﺘﺎﻥ ﻋﻠﻰ ﺍﻗﻞ ﺗﺤﺪﻳﺪ ﻭﺧﻤﺲ ﺳﻨﻮﺍﺕ ﻟﻤﻮﺍﺩ‬
‫ﺍﻻﻧﺎﺭﺓ ﻣﻦ ﺗﺄﺭﻳﺦ ﺍﻻﺳﺘﻼﻡ ﺍﻻﻭﻟﻲ ﻟﻠﻤﺸﺮﻭﻉ ﻣﻦ ﻗﺒﻞ ﺭﺏ ﺍﻟﻌﻤﻞ‪.‬‬

‫‪ .9‬ﻟﺤﻞ ﺍﻟﻤﺸﺎﻛﻞ ﺑﻴﻦ ﺍﻟﻄﺮﻓﻴﻦ ﺍﻥ ﻭﺟﺪ ﺳﻴﺘﻢ ﺍﻻﻟﺘﺠﺎء ﺍﻟﻰ ﺍﻟﺸﺮﻭﻁ ﺍﻟﻌﺎﻣﺔ ﻟﻠﻤﻘﺎﻭﻻﺕ ﺍﻟﻌﺮﺍﻗﻴﺔ‪.‬‬

‫‪.10‬ﺷﺮﻭﻁ ﺍﻟﺪﻓﻊ ﺍﻟﻤﺘﻔﻖ ﻋﻠﻴﺔ ﻭﻛﻤﺎ ﻳﻠﻲ‪:‬‬


‫)‪ (50000‬ﺗﺪﻓﻊ ﻋﻨﺪ ﺗﻮﻗﻴﻊ ﺍﻟﻌﻘﺪ‪.‬‬
‫)‪ (0%‬ﺗﺪﻓﻊ ﻋﻨﺪ ﻭﺻﻮﻝ ﺍﻟﻤﻮﺍﺩ ﺍﻟﻰ ﻣﻮﻗﻊ ﺍﻟﻌﻤﻞ ‪.‬‬

‫)‪ (50000‬ﺗﺪﻓﻊ ﻋﻨﺪ ﺍﻛﺘﻤﺎﻝ ﺗﻨﺼﻴﺐ ﺍﻻﻋﻤﺎﻝ ﺍﻟﻜﻬﺮﺑﺎﺋﻴﺔ ﻭﺗﺸﻐﻴﻠﻬﺎ ﻭﺑﻌﺪ ﺍﻟﻔﺤﺺ ﻭﺍﻟﺘﺸﻐﻴﻞ ﻭﺑﺤﻀﻮﺭ ﻣﻤﺜﻞ ﻋﻦ‬
‫ﺍﻟﻄﺮﻑ ﺍﻻﻭﻝ ﺍﻭ ﻣﻦ ﻳﺨﻮﻟﻪ ﺭﺳﻤﻴﺎ‬

‫‪.11‬ﻳﺒﺪﺃ ﺍﻟﻌﻤﻞ ﻣﻦ ﺗﺎﺭﻳﺦ ﺻﺮﻑ ﺍﻟﺴﻠﻔﺔ ﺍﻷﻭﻟﻴﺔ ﺣﺴﺐ ﺍﻟﻌﻘﺪ‪.‬‬

‫‪.12‬ﻳﻠﺘﺰﻡ ﺍﻟﻄﺮﻑ ﺍﻷﻭﻝ ﺑﺘﺴﺪﻳﺪ ﻣﺴﺘﺤﻘﺎﺕ ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﺣﺴﺐ ﺷﺮﻭﻁ ﺍﻟﺪﻓﻊ ﻓﻲ ﺍﻟﻌﻘﺪ ﺿﻤﻦ ﺍﻟﻤﺪﺓ ﺍﻟﻤﺤﺪﺩﺓ ‪.‬ﺑﻐﺾ‬
‫ﺍﻟﻨﻈﺮ ﻋﻦ ﻣﻮﻗﻔﻪ ﺍﻟﻤﺎﻟﻲ ﻣﻊ ﺍﻟﺠﻬﺔ ﺍﻟﻤﺴﺘﻔﻴﺪﺓ ‪.‬‬

‫‪.13‬ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﻏﻴﺮ ﻣﺴﺌﻮﻝ ﻋﻦ ﺗﺄﺧﺮ ﺍﻟﻌﻤﻞ ﺑﺴﺒﺐ ﺍﻻﻋﻤﺎﻝ ﺍﻷﺧﺮﻯ ﻛﺎﻟﺴﻘﻮﻑ ﺍﻟﺜﺎﻧﻮﻳﺔ ‪،‬ﺃﻧﻈﻤﺔ ﺍﻟﺘﺒﺮﻳﺪ ‪....،‬ﺍﻟﺦ ‪.‬‬

‫‪ .14‬ﺍﻱ ﺗﻐﻳﺭ ﺍﺛﻧﺎء ﺍﻟﻌﻣﻝ ﻳﺟﺏ ﺗﺛﺑﻳﺗﻪ ﻋﻠﻰ ﺍﻟﺗﺻﻣﻳﻡ ﻭﻳﻛﻭﻥ ﻋﻠﻰ ﻋﺎﺗﻖ ﺍﻟﻁﺭﻑ ﺍﻟﺛﺎﻧﻲ ﻋﻣﻝ ) ‪( shop Drawing‬‬
‫‪ .15‬ﻳﺣﻖ ﻟﻠﻣﺳﺗﺛﻣﺭ ﺍﻟﻐﺎء ﺍﻱ ﻓﻘﺭﺓ ﻣﻭﺟﻭﺩﺓ ﻓﻲ ﺟﺩﻭﻝ ﺍﻟﻛﻣﻳﺎﺕ ﻗﺑﻝ ﺑﺩء ﺍﻟﻌﻣﻝ‬

‫‪ .16‬ﺟﺩﻭﻝ ﺗﻘﺩﻡ ﺍﻟﻌﻣﻝ ﻳﻘﻊ ﻋﻠﻰ ﻋﺎﺗﻖ ﺍﻟﻁﺭﻑ ﺍﻟﺛﺎﻧﻲ ﺑﻌﺩ ﺍﻟﻣﺩﺍﻭﻟﺔ ﻣﻊ ﺍﻟﻣﻬﻧﺩﺱ ﺍﻟﻣﺷﺭﻑ‬

‫‪.17‬ﺷﺭﻭﻁ ﺍﻟﺳﻼﻣﺔ ﺍﻟﻣﻬﻧﻳﺔ ﻟﻠﻛﺎﺩﺭ ﻭﺗﺎﻣﻳﻥ ﺍﻟﻛﺎﺩﺭ ﻳﻘﻊ ﻋﻠﻰ ﻋﺎﺗﻖ ﺍﻟﻁﺭﻑ ﺍﻟﺛﺎﻧﻲ‬

‫‪ .18‬ﻳﻠﺗﺯﻡ ﺍﻟﻁﺭﻑ ﺍﻟﺛﺎﻧﻲ ﺑﺎﻟﻣﻭﺍﺻﻔﺎﺕ ﺍﻟﻔﻧﻳﺔ ﻭﺍﻟﺷﺭﻭﻁ ﺍﻟﻣﺫﻛﻭﺭﺓ ﻓﻲ ﺍﻟﻛﺷﻑ ﻭﺍﻟﻣﺧﻁﻁﺎﺕ ﻭﺣﺳﺏ ﺗﻭﺟﻳﻬﺎﺕ‬

‫‪.19‬ﻛﺎﺩﺭ ﺍﻟﻌﻣﻝ ﻳﺟﺏ ﺍﻥ ﻳﻛﻭﻥ ﺫﻭ ﺧﺑﺭﺓ ﻓﻧﻳﺔ ﻭﻣﻧﻔﺫ ﻟﻣﺷﺎﺭﻳﻊ ﻣﺳﺗﺷﻔﻳﺎﺕ ﻣﻊ ﻭﺟﻭﺩ ﻓﻭﺭﻣﺎﻥ ﻭﻳﺣﻖ ﻟﻠﻣﻬﻧﺩﺱ‬
‫ﺍﻟﻣﺷﺭﻑ ﺗﻐﻳﻳﺭ ﺍﻱ ﻓﻧﻲ ﺣﺳﺏ ﻣﺎ ﺗﺗﻁﻠﺏ ﻣﺻﻠﺣﺔ ﺍﻟﻌﻣﻝ‬
