1. Background

1.1. Stable internet connectivity has become a paramount tool in staying


connected, ensuring business continuity and household sustainability ,
and accessing various services. There is a growing demand for
connectivity all over the country especially during the public health
emergency due to COVID-19. With this, the Telecommunications Sector
was directed by President Rodrigo Roa Duterte to upgrade and fast track
the digital infrastructure in the country to adopt in the new normal

1.2. On July 23, 2020, the ARTA -DICT-DILG-DHSUD-DPWH-CAAP-DOH-


FDA Joint Memorandum Circular (JMC) 2020-01 titled “Streamlined
Guidelines for the Issuance of Permits, Licenses, and Certificates for the
Construction of Shared Passive Telecommunications Tower
Infrastructures (PTTIs)" was issued to accelerate the rollout of
telecommunication infrastructure and service projects. The guidelines is
a response to the directives of the President on the part of the national
government to assist the telephone companies in their roles and
responsibilities.

1.3. The President has directed the Department of the Interior and Local
Government (DILG) to undertake additional measures to support the
construction of PTTIs in the country by auditing Local Government Units
(LGUs) with pending local permit applications on telecommunications
tower infrastructure, allowing telecommunication companies to

continuously work during emergencies, and to issue a Memorandum
Circular (MC) effecting separate health protocols for telecommunications
manpower. The DILG has issued an Advisory dated August 6, 2020, and
the DILG MC No. 2021-034 in response to the directive of the President.

1.4 . Following the enactment of the Republic Act (RA) No. 11494 or the
“Bayanihan to Recover as One Act", the ARTA-DICT-DILG-DHSUD-
BFP-DPWH-CAAP-NTC -DOH-FDA JMC 2021-01 was issued last June
10, 2021 titled “Revising and Expanding Joint Memorandum Circular No.
01, S. 2020 or the "Streamlined Guidelines for the Issuance of Permits,
Licenses, and Certificates for the Construction of Shared Passive
Telecommunications Tower Infrastructures (PTTIs) to harmonize the
provisions of the ARTA -DICT-DILG-DHSUD-DPWH-CAAP-DOH-FDA
JMC 2020-01 to RA 11494 , specifically on Section 4 (ii) (1), which
directs, “Temporary suspension of requirements to secure permits and
clearances for the construction of telecommunications and internet
infrastructure." The revised guidelines also expanded to cover
construction of PTTIs, whether shared or exclusive, that will be
constructed by Public Telecommunications Entities (PTEs) and
Independent Tower Companies (ITCs) duly registered with the
Department of Information and Communications Technology (DICT).

1.5. To monitor the compliance of LGUs on the foregoing premises, the


Department has developed the Telecommunication Permit Online
Monitoring System (TelPOMS) to assist in expediting the processes
and requirements for the construction of PTTIs.

2. Purpose

This issuance is intended to monitor and assess compliance of LGUs to the


standards set by above-mentioned laws and guidelines, specifically, this aims
to:

2.1. To systematically monitor the compliance of LGUs to the guidelines for


the construction of shared PTTIs nationwide.

2.2. To track the pending applications for the permits, clearances and
certifications in relation to the construction of the telecommunication
towers infrastructures.

2.3. To provide feedback to regions on the results of the survey of their


respective LGUs for technical assistance if necessary.

2.4. To encourage LGUs to be proactive in improving their services to their


constituents and clients.

3. Legal Compliance

The DILG is required to manage its policy documentation within a legislative


framework . The legislations guiding this policy are:

3.1. Republic Act 11032 also known as Ease of Doing Business and Efficient
Government Service Delivery Act of 2018.

3.2. ARTA -DICT-DILG-DHSUD-BFP-DPWH-CAAP-NTC -DOH-FDA Joint


Memorandum Circular (JMC) 2021-01 dated June 10, 2021 titled
"Revising and Expanding Joint Memorandum Circular No. 01, S. 2020 or
the "Streamlined Guidelines for the Issuance of Permits, Licenses, and
Certificates for the Construction of Shared Passive Telecommunications
Tower Infrastructures (PTTIs)”

3.3. DILG Memorandum Circular (MC) 2021-034 dated March 24, 2021 titled
“Guidelines to Accelerate the Internet Connectivity and
Telecommunication Services to Address the Need for Rapid Digital
Transformation in the New Normal"

3.4. Advisory dated August 06, 2020, titled “Compliance to ARTA-DICT-


DILG-DHSUD-DPWH-CAAP-DOH-FDA Joint Memorandum Circular No.
01 S. 2020 or the “ Streamlined Guidelines for the Issuance of Permit,
Licenses, and Certificates for the Construction of Shared Passive
Telecommunications Tower Infrastructure (PTTIs)”

4. Scope/Coverage

This guidelines covers all Local Chief Executives (LCEs), Local Administrators,
Business Permit and Licensing Officers (BPLOs), Office of the Building Officials
(OBOs) of Cities and Municipalities; DILG Regional and Provincial Directors;
DILG Field Offices and all others concerned

5. Definition of Terms

For purposes of this guidelines, the following definitions apply , unless otherwise
stated:
5.1 Approved Application - refers to application for permits, licenses, and
certificates and related clearances for the construction of PTTI that has
been approved and released by the LGU to the requesting party and
paid in full by the applicant.

5.2 Semiweekly - accomplished or produced twice a week. For the purpose


of this guidelines, twice a week shall be done every Tuesday and Friday.

5.3 Business Permit and Licensing Office (BPLO) - refers to the office
authorized to issue business permits and regulates the operations of
business activities.

5.4 Fast-tracking PTTI Application Monitoring & Evaluation (M&E)
Form 2 - refers to the monitoring tool used to monitor the compliance of
each LGU to: (i) unhampering operations of telecommunication
company, (ii) prescribed processing time for related permits, licenses,
clearances, and/or authorization of PTTI, and (iii) provision of support to
telecommunication company.

5.5 Office of the Building Official (OBO ) - refers to the Office authorized
to enforce in the field the provisions of the National Building Code of the
Philippines (NBCP) and its Implementing Rules and Regulations (IRR )
as well as the enforcement of orders and decisions made pursuant
thereto.

5.6 Passive Telecommunications Tower Infrastructure (PTTI) - refers to


all types of outdoor non-electronic telecommunications infrastructure or
civil works, including but not limited to towers, masts, poles, and other
similar infrastructure, as well as the facilities auxiliary thereto—built on
the ground or installed in buildings, walls, rooftops or other edifice—that
are utilized for purposes of mounting antennas, transmitters/receivers,
radio frequency modules, and other radio -communications systems as
macro cell sites for the rendition of ICT services in the
telecommunications network.

The term shall include: (a) the ducts , ladders, arresters, mounts, cable
entrances, and the cable trays of the PTTI; (b) the shared fiber -optic
and/or radio frequency cables or other similar equipment assemblies
that make up the fronthaul; (c) its appurtenant shelters, sheds, cabins,
cabinets or other similar house for the base-band units, radio units, and
related electronic equipment, as well as the cable entrances thereof; (d)
its power supply and back-up power management systems; and (e) all
other ancillary facilities as thereto may be necessary and pertinent for its
proper, resilient, and continuous operation as a PTTI. These auxiliary
and ancillary facilities need not necessarily have to be owned or
managed by each mobile network operator.

5.7 Pending Application refers to application for permits, licenses, and


certificates and any related clearances for the construction of PTTI that
is being processed by the LGU or is on hold due to the lack of
documentary requirements from the applicant, which includes new
applications received.

Processing time is based on the ARTA-DICT-DILG-DHSUD-BFP-
DPWH-CAAP-NTC-DOH-FDA JMC 2021-01

Applications for Building Permit , together , with the Locational


Clearance , other ancillary permits and the Fire Safety Evaluation
Clearance (FSEC ) not acted upon within seven (7) working days
from the date from receipt of the application form with complete
documentary requirements. (Section 7.2.11)

Applications for Certificate of Use , which includes applications for


Certificate of Final Electrical Inspection ( CFEI) and other related
certificates including the Fire Safety Inspection Certificate (FSIC) , not
acted upon within seven (7) working days from the date from receipt
of the application form with complete documentary requirements.
(Section 7.3.4)

Applications for Business or Mayor’s Permit not acted upon within


three ( 3) working days from receipt of the complete documents from
the OSCP. (Section 7.3.5)

5.8 Pending and Approved PTTI Application M&E Form 1 - refers to the
monitoring tool used to determine the pending and approved PTTI
application for each LGU.

5.9 Working Day - refers to a day where officers and employees are
required to render work .

6. Policy Content, Guidelines and Procedures

All Cities and Municipalities are enjoined to follow the guidelines on the
Telecommunication Permit Online Monitoring System and to provide semiweekly
data reports in monitoring the compliance of LGU with the standards set by the
National Government

6.1. Designation of a Focal Person

6.1.1. A Focal Person shall be delegated by the Local Chief Executive


(LCE) thru an Executive Order. The designated LGU Focal Person
is recommended to come from any of the offices under the Local
Administrator , i.e., BPLO, OBO, IT Office or Communications Office.

6.2. Filling-out/Accomplishing the Approved and Pending PTTI Application


M&E Form 1 and Fast-tracking PTTI Application M&E Form 2

6.2.1. Approved and Pending PTTI Application M& E Form 1

The LGU, through its BPLO and OBO, shall accomplish the Pending
and Approved PTTI Application M&E Form 1 every day and submit
thereafter to the LGU Focal Person.

6.2.2. Fast-tracking PTTI Application M&E Form 2

The LGU, through its BPLO and OBO, shall accomplish the Fast-
tracking PTTI Application M&E Form 2 to monitor the operations of
LGUs on processing the application of a telecommunication
company. The Form 2 shall be accomplished every Tuesday and
Friday and be submitted thereafter to the LGU Focal Person.

6.3. Encoding to the System

6.3.1. The LGU Focal Person shall be in charge of the collection and
consolidation of the data gathered from the annexes submitted by
the BPLO and OBO and encoding and uploading the data thereafter
to the Telecommunication Permit Online Monitoring System.

6.4. Frequency of Monitoring Reports

6.4.1. The LGU Focal Person shall submit the Pending and Approved PTTI
Application M&E Form 1 daily and Fast-tracking PTTI Application
M&E Form 2 on a semiweekly basis, every Tuesday and Friday of
the week until 3:00 PM.

7. Roles and Responsibilities

7.1. Local Government Units

7.1.1. OBO and BPLO shall ensure to accomplish the Approved and
Pending PTTI Application M&E Form 1 every day and Fast-tracking
PTTI Application M&E Form 2 semiweekly, every Tuesday and
Friday.

7.1.2. LGU Focal Person shall encode and upload the data on the
Telecommunication Permit Online Monitoring System on a
semiweekly basis.

7.1.3. LGU Focal Person shall monitor and ensure that the operations of
telecommunication companies in constructing, repairing, installing,
maintaining and other activities will not be hampered and be fully
operational.

7.1.4. The Head of Office of the Focal Person shall ensure that updated
data was encoded in the system.

7.1.5. The LCE shall ensure that OBO, BPLO and Focal Person are
compliant with guidelines set by the Memorandum Circular.

7.2. Department of the Interior and Local Government

7.2. 1 . DILG Regional and Field Offices

7.2.1.1. Oversee and ensure LGUs are compliant on the guidelines


set by the Memorandum Circular.

7.2.1.2. Monitor the regular submission of the Annexes by the


BPLO and OBO to the LGU Focal Person.

7.2.1.3. Ensure the regular encoding of data of the Focal Person to


the system.

7.2.2. Regional Information and Communications Technology Unit


(RICTU)

7.2. 2.1 . Responsible for providing users access to the online


monitoring system for their respective regions.

7.2.2.2. Provide technical assistance to LGUs on the


implementation of the online monitoring system, if
necessary.

7.2 . 3 . Information Systems and Technology Management Service


(ISTMS)

7.2.3.1. Responsible for the development and maintenance of the


online monitoring system.

7.2. 3.2 . Responsible for response to the queries of all the


stakeholders of the system which includes BLGD, Field
Offices and LGUs.

7.2.3.3. Secure a database backup for the system.

7.2. 4.1 . Initiate and lead the nationwide implementation and


advocacy of the LGU Telco Permit Online Monitoring
System.

7.2.4.2. Administer the system and protect the integrity of the data.

7.2.4.3. Monitor the compliance of LGUs thru the Telco Permit


Online Monitoring System.

7.2.4.4. Prepare a semiweekly report to be submitted to the Office


of the Secretary of the Department.

7.2.4.5. Prepare necessary reports to the Office of the Secretary


and Anti-Red Tape Authority (ARTA) on the collected data
of non-compliant LGUs on the provisions of the ARTA -
DICT-DILG-DHSUD-BFP-DPWH-CAAP-NTC-DOH-FDA
Joint Memorandum Circular (JMC) 2021-01 generated
from the system.

8. Penalties and Liabilities

LGUs shall be subject to the provisions of Sections 21, 22, and 23 of RA 11032
or Section 14 of the ARTA-DICT-DILG-DHSUD-BFP-DPWH-CAAP-NTC-DOH-
FDA JMC 2021-01, which provided penalties and liabilities for the actions in
violations with the guidelines.

11. Monitoring and Submission of Reports and other Requirements

The LGU Focal Person shall be responsible for the monitoring of the submission
of LGU reports in their respective jurisdiction, which shall be conducted
semiweekly. BLGD shall consolidate and submit the reports to the Office of the
Secretary. Electronic copies of the reports will be sent via email through
lfrdd.official@gmail.com. The monitoring unit specified herein shall be in-charge of
reviewing the requisites complied with prior to submission to the Office of the
Secretary). They shall also be responsible for notifying parties involved concerning
incidences of non-compliance and their corresponding sanctions.

12. Effectivity

This Memorandum Circular shall take effect immediately.
