PROVIDING FOR THE CREATION OF THE BARANGAY ANTI-DRUG ABUSE


COUNCIL (BADAC) FUNCTIONALITY CITY AUDIT TEAM OF THE CITY OF
ZAMBOANGA

WHEREAS, Section 5, Article II of the 1987 Philippine Construction provides that “(T)he maintenance of
peace and order, and oeder, the protection of life, liberty, and property, and the promotion of the general
welfare are essential for the enjoyment by all the people of the blessings of democracy,”

WHEREAS, Section 17 (2) (iv) of Republic Act 7160, otherwise known as the Local Government Code of
the Philippines, provides that the services of a municipality include “(S)ocial welfare services which
includes programs and projects on child and youth welfare, family and community welfare, women’s
welfare, welfare of the elderly and disabled persons; community-based rehabilitation programs for vagrants,
beggars, street children scavengers, juvenile deliquents, and victims of drug abuse; livelihood and other
pro-poor projects; nutrition services; and family planning services;”

WHEREAS, Article, 359 and 360 of Civil Code of the Philippines provides that the government shall
establish Councils for Protection of Children;

WHEREAS, Section 17 (4), supra, provides that the services of the city include “(A)ll the services and
facilities of the municipality and province;”

WHEREAS, Section 51 of Republic Act 9165 otherwise known as the Dangerous Drugs Act of 2002,
provides that Local Government Units shall “appropriate a substantial portion of their respective annual
budgets to assist in or enhance the enforcement of this Act giving priority to preventive or educational
programs and the rehabilitation or treatment of drug dependents;”

WHEREAS, the department of the Interior and Local Government (DILG) and Dangerous Drug Board
(DDB) issued joint Memorandum Circular No. 2018-01, dated 21 May 2018 with subject” Implementing
Guidelines on the Functionality and Effectiveness of Local Anti-Drug Abuse Councils” which directs the
conduct of annual Barangay Anti-Drug Abuse Council (BADAC) functionality audits to be led by the
DILG:

WHEREAS, the Department of the Interior and Local Government issued Memorandum Circular No.
2018-135, dated 16 August 2018, with subject “Technical Guide Notes on BADAC Functionality Audit and
Barangay Drug Clearing Program (BDCP) Monitoring and Evaluation System,” providing the details on
the conduct of the annual BADAC Audit of Barangays;

WHEREAS, as a regional strategy for the effective implementation of the BADAC Audit, the DILG-NCR
encourages all Local Government units in the National Capital Region (NCR) to form a BADAC Audit
Team in their respective jurisdictions;

NOW THEREFORE, I HON. ROBERTO V. CARPIO, Punong Barangay of PAMUCUTAN, City of


Zamboanga, by virtue of the power vested in me by law as Punong Barangay of Barangay Pamucutan , do
hereby order and decree the following:

SECTION 1. CREATION AND COMPOSITION

The Barangay Anti-Drug Abuse Council (BADAC) Functionality City Audit Team of the City of
Zamboanga is hereby created, and it shall be composed of the following individuals with their respective
designations, namely:

CHAIRPERSON : Hon. Roberto V. Carpio - Punong Barangay


CO-CHAIRPERSON : Hon. Roger G. Caguimbal -Kagawad Committee on Peace and Order
and Drug Abuse Prevention and Control Office

MEMBERS : Mr. Ramon I. Bautista - ZCPS9 Officer Incharge


Ayala, Zamboanga City
Mrs. Mary Jane W. Agarin - Public Health Midwife
City Helath Office

Jury G. Rocamora - City Officer, PDEA of Zamboanga City


Mr. Glenn E. Lusaya - School Principal/TIC
Mr. Arman Q. Bentain- President Youth Dev’t
Mrs. Regina L. Bernardo - Executive Officer/Chief Tanod

Local Operations Office of Barangay shall await the representative, should there be any, for inclusion in
the composition.

Membership in the Audit Team is a function of the Office which is occupied by the individual above-
named. Hence, the termination, resignation, removal, transfer, illness, incapacity, death, or any similarly-
situated circumstance of the member shall entitle the successor to assume membership without the need for
issuance of another order or directive. Hoever, for the representative of the Philippine Drug Enforcement
Agency (PDEA), the successor shall be named by the superiors concerned and shall be properly endorsed to
the DILG Local Operations Office of City of Zamboanga

SECTION 2. FUNCTIONS.

The BADAC Functionality City Audit Team of the City of Zamboanga shall perform the following
functions, namely;

a. Ensure the conduct of the annual Barangay Anti-Drug Abuse Council (BADAC) functionality
audit covering the (7) Puroks of Barangay Pamucutan.
b. Meet once a year, or as needed, to plan the conduct of the Barangay Anti-Drug Abuse Council
(BADAC) functionality audit;
c. Notify the barangays on the conduct of the audit or when there are updates regardinf the audit;
d. Schedule and conduct the audit per barangay, which includes actual barangay visitation,
document review and interview;
e. Conduct a post-assessment deliberation to consolidate and finalize the result of the audit for
submission to the DILG NCR Regional Office;
f. Encode the BADAC data gatjered during the audit in the BADAC online reporting template
provided by the DILG NCR; and
g. Perform such other functions as may be directed by competent authority, or as may be
necessary to achieve the foregoing.

Expenses for the conduct of the Badac Functionality City Audit Team meetings and related activities shall
be taken from the funds of the Drug Abuse Prevention and Control Office.

SECTION 4. Repealing Clause

All previous orders and directives inconsistent with any provision herein found shall be deemed repealed,
revoked, or amended accordingly.

SECTION 5. Separability Clause

In the event that any provision herein found shall be judicially declared illegal or infirm, untouched
provisions shall remain in full force and effect.

SECTION 6. Effectivity Clause

This Executive Order shall become effective immediately upon signing, and it shall remain in full force and
effect until repealed, revoked or amended accordinghly.
