SUBJECT: CONTRACT REVIEW ON THE PROPOSED

MEMORANDUM OF AGREEMENT TO BE
ENTERED INTO BETWEEN THE CITY OF
CEBU AND BARANGAY SUDLON I, CEBU CITY

Dear HONORABLE ZAFRA:

Endorsed to this Office for review/comments/recommendations is the

draft Memorandum of Agreement or MOA between the City of Cebu and
Barangay Sudlon I, Cebu City relative to the Five Million Pesos
(Php5,000,000.00) Financial Assistance to be given by the City of Cebu to
all barangays within its jurisdiction.

The basis for such financial assistance to the barangays is City

Ordinance No. 2518 (Annual Budget of the City of Cebu for Calendar
Year2019), which indubitably states under item 4.3 thereof that: “the
Financial Assistance to North and South District Barangays with account
No. 5-02-14-030-09 amounting to Php 400,000,000.00 representing as
financial assistance to 80 barangays, pegged at Php 5,000,000.00 each”.

OBSERVATIONS:

After a careful evaluation, study, and review of the draft MOA, this
office finds the same to be in order and complies with basic legal
requirements of a written agreement.

Moreover, it was observed that the provision contained in the MOA

are in accordance with law, and are not contrary to morals, good customs,
public order or public policy.

RECOMMENDATION:

This office respectfully recommends that a Sangguniang Panlungsod

resolution authorizing the City Mayor to enter into the MOA be secured 1. In
the same manner that a Sanguniang Barangay resolution must also be
secured authorizing Honorable Barangay Captain Dante M. Tabucal to enter
into the MOA.2
