ADDENDUM TO SMT CONTRACT OF EMPLOYMENT (the Contract of Employment)

General Data Protection Regulation


This Addendum (the GDPR Addendum) is entered into on this 24TH day of November 2021 between
the parties whose signatures appear below.
Whereas:
A. The EU General Data Protection Regulation (GDPR) comes into force on 25 May 2018 and
sets out what an individual’s personal data can be used for, the rights of the individuals in respect of
that data and how it is to be held and transferred.
B. Personal data relates to information about a living individual who can be identified from that
data. Identification can be by the information alone or in conjunction with any other information in the
data controller’s possession, or likely to come into such possession.
C. Our obligation under the GDPR is to ensure that we keep personal data up to date; store and
destroy it securely. We don’t collect or retain excessive amounts of data; we protect personal data from
loss, misuse, unauthorised access and disclosure, whilst ensuring that appropriate technical measures
are in place to protect personal data.
D. As a consequence of the GDPR coming into force the Parties wish to amend the Contract as
follows.
In consideration of the promises and mutual covenants and agreements herein set out below the Parties
hereby agree as follows:

1. In order to perform our contract with you we collect and/or obtain from you, amongst other
information, the following:

(i) contact information (name, postal addresses, email addresses, telephone and fax numbers);
(ii) professional information such as job titles, former job titles, organisational associations,
professional experience and qualifications, reports and assessments;
(iii) bank account details;
(iv) medical details; and
(v) next of kin details

2. Please note that the information listed in clause 1(i) to clause 1(iii) may be shared with third
parties. For example, your name and bank account details may be shared with our bank(s) and
professional advisers to allow wages and other contractually due payments to be made to you.
This allows us to perform our Contract with you.
3. In the event of a medical emergency or issue we will share and exchange medical details with
medical services, our insurers and third parties with whom we may need to contract, for
example to repatriate you home. We will be doing this to preserve your wellbeing.
4. In the event of a medical emergency or issue we may need to contact your next of kin. To
enable us to do so we require you to obtain your next of kin’s written consent to us holding
their details on your file. Please arrange for your next of kin to fill in and return by e-mail or
fax the document at schedule 1.
5. In the event that you wish us to pay all or a proportion of your wages which are contractually
due to you to a third party then we will require you to obtain your intended beneficiaries written
consent to us holding their details on your file along with your written confirmation of the
proportion to be paid to that beneficiary. Please arrange and /or obtain the required information
at schedule 2.
6. In addition, we ask that we may use your image in the in-house magazine, Nautical News, on
our website and in marketing material. If you consent to us using your image in Nautical News,
on our website and in marketing material then please tick the box below and sign your name
alongside.
By ticking this box I consent to my image being used as stated in this clause 6:

7. Your employment file will be securely retained in our system for as long as you are employed
by us and thereafter until you reach nominal retirement age.
8. Unless subject to an exemption under the GDPR you have the following rights with respect to
your personal data: -
(i) the right to request a copy of your personal data which we holds about you;
(ii) the right to request that we correcs any personal data if it is found to be inaccurate or
out of date;
(iii) the right to request your personal data is erased where it is no longer necessary for us
to retain such data;
(iv) where consent has been required and given by you then you have the right to ask us to
delete that data at at any time; and
(v) the right to request that we provide you with your personal data and where possible, to
transmit that data directly to another data controller, (known as the right to data portability),
(where applicable).

9. The SMT Shipping (Cyprus) Ltd. Privacy Policy can be found on the SMT Shipping website.
If you have a compaint of uery with respect to the GDPR then you may contact the Data
Protection Officer, Vanessa Voorham (v.voorham@smtshipping.com) or if you prefer you may
use our general data privacy email box at privacy@smtshipping.com.

You also have the right to lodge a complaint with the Cyprus Information Commissioners
Office.
10. It is agreed that the following changes to the Contract of Employment will have retrospective
effect as from 25 May 2018.
11. This GDPR Addendum may be executed in counterparts all of which when taken together shall
be considered the same document.
12. The schedules to this GDPR Addendum are hereby incorporated and form part of thsi GDPR
Addendum.

I, SILVIA S. APAGAN hereby consent to the personal details listed below being held by SMT
SHIPPING-SKANFIL MARITIME for the purpose of informing me about any accident or illness or
event involving MOTORMAN SOLOMON P. APAGAN. SMT SHIPPING-SKANFIL MARITIME
will retain these details for as long as SMT SHIPPING-SKANFIL MARITIME is employed and on
the companys books.

It is understood that I can contact SMT SHIPPING-SKANFIL MARITIME at any time and withdraw
my consent to them holding these details.

I, MOTORMAN SOLOMON P. APAGAN hereby instruct SMT SHIPPING-SKANFIL MARITIME


to pay the following sum or proportion of my wages to SILVIA S. APAGAN. I agree that any payment
made to SILVIA S. APAGAN will be considered as either the whole or partial payment obligation of
SMT SHIPPING-SKANFIL MARITIME under the contract of employment.

I, SILVIA S. APAGAN (the beneficiary) agree to SMT SHIPPING-SKANFIL MARITIME holding


the personal details below for the purpose of paying to me various sums from the wages of
MOTORMAN SOLOMON P. APAGAN. I understand that SMT SHIPPING-SKANFIL MARITIME
will retain only these details for as long as SMT SHIPPING-SKANFIL MARITIME current
employment. I understand that these details will be shared with SMT SHIPPING-SKANFIL
MARITIME banks and other third parties to enable payment to be made.

It is understood that I can contact SMT SHIPPING-SKANFIL MARITIME at any time and withdraw
my consent to them holding these details. I also undertake to inform MOTORMAN SOLOMON P.
APAGAN that I have withdrawn such consent.
