MEMORANDUM

SUBJECT : PRESENTATION OF GRIEVANCES

BACKGROUND

On July 27, 2021, the undersigned received a memorandum from CENR


Officer Caesar E. Quebec countersigned by Technical Services Supervisor Isaias
Guimod and Admin/Ecoms 11 Reynaldo Dano with the subject “ FREQUENT
UNAUTHORIZED TARDINESS ( HABITUAL TARDINESS”. It was mentioned in the
said memorandum that my Daily Time Record shows series of unauthorized
tardiness , but has no daily time record attached no specific month within the same
semester which would warrant their action as per Section 50, (B), (6) of the 2017
RULES ON THE ADMINISTRATIVE CASES IN THE CIVIL SERVICE (2017
RACCS). Copy of Memorandum is hereto attached as ANNEX “A”.

On August 2, 2021, another memorandum from CENRO Caesar Quebec was


received by the undersigned with subject “ INCOMPLIANT TO SUBMIT
COMPLETED STAFF WORK (CSW) REPORT ON THE ACTUAL AND EXTENT OF
DAMAGED INCURRED ON THE PROPOSED ROAD OPENING OF VICTORIA-
SABLAYAN ROAD PROJECT OF DPWH”, which I answered on August 3, 2021 wherein
I was only given 72 hours to do and which is impossible to accomplished for the
following reasons: 1. The extent of the damage incurred in the seven 7 kilometres road
opening at Sablayan-Victoria road will be assessed by a geo-hazard expert considering
that said road opening is an environmentally critical project; 2. That the team shall be
created in the gathering relevant information/data involving CENRO/PENRO
personnel; 3. That the participation of the Environmental Management Sector (EMS) of
this CENR Office shall be enjoined; 4. Participation of trained personnel of this CENRO
in preparing CSW shall also be enjoined. Copy of said memorandum is hereto attached
as ANNEX “B”.

The two (2) above-cited memoranda was answered by the undersigned in


writing on August 3, 2021, Copy furnish the Regional Office MIMAROPA and PENR
Office, Mamburao Occidental Mindoro. Copy of said response is hereto attached as
ANNEX “C”. Another memorandum was again issued by the CENRO dated August
10, 2021 ordering me to explain why I should not be sanctioned by reason of the above
mentioned Memorandums.

After answering all the allegations and accusations , work place is no longer
healthy. It seems that the CENRO, TSS Guimod and Admin Dano are doing
something that will turn me down behind my back because they did not discuss
anything to me , until I’ve learned that Admin Dano prepared a recommendation
to replaced me as Chief of Monitoring and Enforcement Section of this CENR
Office. The content of the recommendation was unknown to me and it was not
discussed with me .

On October 11, 2021, Admin Officer/ECOMS 11 Reynaldo Dano handed me a


copy of Special Order signed by the Regional Executive Director Maria Lourdes
Ferrer dated September 22, 2021 with endorsement of PENRO Ernesto Tanada
dated October 3, 2021 which was officially received by the undersigned dated
October 11, 2021. Copy is hereto attached as ANNEXED "D"

PRESENTATION OF GRIEVANCES

1. The memorandum of the CENR Officer prepared by ECOMS/Admin


Reynaldo Dano and initialed by Forester 111/ Technical Services Supervisor
Isaias Guimod Re : “ FREQUENT UNAUTHORIZED TARDINESS
( HABITUAL TARDINESS”. Has no evidence attached. Related to this, I am
submitting my Daily Time Record for the months from January to July
2021. Said allegations has no substantial evidence. I personally talk to Admin
Dano regarding this matter and his answer was “ reminder lang yan at
hindi para sagutin ang memo na yan”. For a government employee , this
kind of memorandum citing observance of unauthorized tardiness matters
so much because there are only two offenses remaining leading to the
dismissal of an employee as provided for under Section 46 (F) (4) of the
Revised Rules on Administrative Cases in the Civil Service . I respectfully
appeal not to consider the accusation for the reason of no legal basis. I
strongly believe that this matter will not fall into a disciplinary cases that
are beyond the jurisdiction of the grievance machinery as provided in the
Employee Rights and Privileges contained in the DENR Revised Edition
2019 Employee Hand Book, page 17 & 18 . It should not be used in the
disciplinary actions of a Supervisor to his subordinates.

2. According to the source, the basis of recommendation to oust me from


my post was my statements in my response dated August 10, 2021 ,
page 2, paragraph 1 & 3 , Re: “For all the reasons stated above, the
memorandum issued by CENRO Caesar Quebec dated August 2,
2021 ordering the undersigned to submit CSW report in just 72
hours or else he will be charging me insubordination is drastic,
inconsiderate action and unjust treatment on the part of a woman
Senior Citizen Employee”: The undersigned would like also to
emphasize that there are young and energetic personnel of this
office who has a formal training in preparing CSW report”. This
statements were for the particular task subjected in my
memorandum only because in the memorandum dated August 2,
2021, CENRO Quebec was forcing me to accomplish CSW in 72
hours which is not doable during the period because DPWH
project has many concerns to be talked other with other
government entities. It’s a public knowledge that the undersigned
performed very well when it comes to target accomplishment of
this office even during Pandemic that Senior Citizens are
prohibited to go outside and required to work from home per
AITF rulings. This serve as an appeal that the voice of aggrieved
employee be heard and deserve an explanation why I was
treated like nothing despite my government service for almost
37 years was full of sacrifices defending people we are serving
leaving/denying myself interest/ satisfaction. I am not perfect
but I deserve respect. I’ve done my best to serve upholding what
is right. My current situation of living in chaos within the
workplace, feeling that any time I will be threatened

My supervisors did not even inform or discussed with me if


there are problems or shortcomings in my performance of official
duties , instead they bullied me through issuance of memorandum
mandating me to explain but no matter how rightful are my
explanation, they never considered giving no credits. They even
accused me without presenting evidence. My dignity as a public
servant was deprived to the extent that my rights being an
employee of the government was oppressed. Oppressed in the
sense that they reassigned me under the office of the CENRO
waiting for instruction if they wanted to. If not, my job
description is considered nothing just like other DENR
employees of the DENR in this province holding Salary Grade
18 and above . For what valid reasons? I just want to make
use of our Grievance Machinery and ask for Preliminary
Investigation for

1. Oppression and;
2. Abuse of Authority
