Fertilizer and Pesticide Authority

fertilizer, pesticide and other agricultural
chemicals except under a license issued by
FPA…”
Definition of Terms
ACCREDITATION authorization to individuals who have attended
training and have passed corresponding examinations given by FPA

ACCREDITED SAFETY DISPENSER OF FERTILIZER AND PESTICIDE (ASD)

refers to an individual who attended the 2-day training conducted by FPA for such
purpose, has passed the corresponding examinations and issued with accreditation
card by FPA
DEALER person(s) who sells fertilizer/ pesticides to
farmer/end users
DISTRIBUTORS person(s) or entity(s) who sells fertilizer/ pesticide to dealers
and outlets only. Distributors get their supply directly from importers/
manufacturers.
Definition of Terms
HANDLERS exporter, importer, indentor, processor, manufacturer,
formulator, distributor, supplier, dealer, and repacker of fertilizer and
pesticide products.

LICENSE written authority given by FPA to persons to import, manufacture,

process, formulate, repack, store, distribute and sell fertilizer, pesticide and
other agricultural products.

Licensing Policies
1 All covered handlers must have an ASD or IBOs must be trained as ASD to
advise buyers on the proper handling and safe use of F/P.
2 ASD is required to be present at the store during business hours.
3 ASD should keep records of sale and disposition of F/P.
4 Non-compliance shall preclude handlers from selling F/P products.
5 Prohibition to supply handlers with no ASD and IBOs not trained as such.

6 APPA cardholders to be issued ASD accreditation, no training and exams.
7 APD cardholders to attend one (1) day refresher course on general
pesticide information. No exams required.
8 FPAND-IBO who is opting to sell Category I and II pesticides must attend
one (1) day refresher course on general pesticide information. No exams
required.
9 New applicants for dealership license and/or FPAND-IBO accreditation
must attend ASD training and pass the exams.

 Monitoring Activities
FPA has the authority to
conduct a wide range of
activities after fertilizer and
pesticide products are
registered to assure that these
are being handled, distributed
and used safely and in
accordance with the applicable
rules, regulations and product
labeling.
Regional FPA Officers are tasked
to monitor compliance of
distributors, manufacturer and
importers regarding rules and
regulations.
- Data generated in these
monitoring activities shall be used
as a basis for the
renewal/revocation of licenses.
Monitoring Activities
ENFORCEMENT

When violations are discovered, appropriate actions

ranging from:

• Issuance of a warning letter to administrative action such as

compulsion to attend seminar to imposition of fines or cancellation
of product registration and /or company license will be taken
• Product recall, remedial advertising and similar requirements
may also be imposed
ENFORCEMENT

Licenses issued by FPA may be revoked, cancelled or

suspended on the basis of the following:
• False statements in the application or any required report or
record;
• False claims in advertisement;
• Violations of or failure to observe FPA rules and regulations;
• Refusal to allow inspection, and;
• Commission of prohibited acts under P.D.1144.
PENALTIES

Section 10 of P.D. 1144

A. Fertilizer
Any person who violates any of the provisions of this Decree or any of the provisions of the rules and
regulations issued or promulgated by the FPA on fertilizer shall be punished by imprisonment of not
less than 15 years and 1 day or more than 20 years if the amount involved is more than P50,000.00; by
imprisonment of not less than 10 years and 1 day or more than 15 years if the amount involved is
P10,000.00 or less, as well as a fine ranging from an amount equal to the value involved to three times
such value but which shall in no case be less than P5,000.00 nor more than P20,000.00; by a fine or
P5,000.00 nor more than P10,000.00 by other violations where the amount involved cannot be
determined; Provided, that if falsification of a public or commercial document is committed by reasons
or on the occasion of the commission of any of the acts punishable herein, the offender shall be
imposed the maximum fine and term of imprisonment as above prescribed. If the violation is committed
by a corporation, firm, partnership, cooperative, association or any other entity, the penalty shall be
imposed upon the guilty office or offices and such corporation, firm, partnership, association or entity.
PENALTIES

Section 10 of P.D. 1144

A. Pesticide
Any person who violates any of the provisions of this Decree or any of the provisions of the rules and
regulations issued or promulgated by the FPA on pesticide shall be liable to a penal servitude of not in
excess of 1 year of a fine of P5,000.00 but not more than P10,000.00 provide that if the violation is
committed by a corporation, firm, partnership, cooperative, association or any other entity, the penalty
shall be imposed upon the guilty officials or officers of such entities
