MOTION TO RESET DATE OF HEARING

PLAINTIFF, through the undersigned counsel, unto this Honorable

Court, and by way of this Motion, most respectfully states THAT:

1. In an Order dated September 29, 2021 which the undersigned

received on October 14, 2021, the above captioned case was set
for hearing on November 24, 2021 at 2:00 o’clock in the
afternoon.

2. The undersigned counsel cannot attend the said time of hearing

because there is also a scheduled hearing at the Regional Trial
Court, Branch 8, Aparri, Cagayan on the same date and time in
the case entitled Civil Case No. II-6754 for Accion Publiciana and
Damages with Application for Restraining Order and/or Injuncton
which was set long before the undersigned received the
September 29, 2021 order.

3. Therefore, as a gesture of utmost sincerity and good faith,

undersigned counsel hereby respectfully begs the indulgence of
this Honorable Court to move the date of hearing on a later date.

4. This Motion is in no matter intended to delay the proceedings of

the above-entitled case but is brought forth solely by the
foregoing circumstance and reason.

PRAYER

WHEREFORE, premises considered, it is respectfully prayed unto this

Honorable Court that the time of hearing of the above captioned case be
reset to a different date if possible instead of November 24, 2021.
