- Rep. Act no. 8800 also called “Safeguard Measure Act” section 39 of Republic Act 8800 (RA
8800) sets its effectivity. Fifteen days following its complete publication in two newspapers of general
circulation or within the Official Gazette, whichever comes earlier. "RA 8800 was published in two
newspapers of general circulation on July 24, 2000 and thus is effective on August 9, 2000. NOW,
THEREFORE, these Implementing Rules and Regulations are issued as Joint Administrative Order No. 03
to guide all concerned departments, offices, agencies, and stakeholders, within the implementation of
RA 8800. Based on my very own understanding rep. act no. 8800 The State shall promote the
competitiveness of domestic industries and producers supported sound industrial and agricultural
development policies, and also the efficient use of development policies, and therefore, the efficient use

cause, serious injury to the domestic industry, the Secretary shall at once, transmit its records to the
Commission for an immediate formal investigation. In the event of a negative final determination, or if
the cash bond is in way over the definitive safeguard duty assessed, the Secretary shall immediately
issue, through the Secretary of Finance, instruction to the Commissioner of Customs, authorizing the
return of the cash bond or the rest thereof, because the case could also be, previously collected as
provisional general safeguard measure within ten days from the date a judicial decision has been made:
Provided, That the govt. shall not be responsible for any interest in the quantity to be returned. The
Secretary shall not accept for consideration another petition from the identical industry, with relation to
the identical imports of the merchandise into account within one year after the date of rendering such a
call. When the definitive safeguard measure is within the kind of a tariff increase, such increase shall not
be subject or limited to the most levels of a tariff as outlined in Section 401 of the Tariff and Customs
Code of the Philippines.
