MEMORANDUM OF AGREEMENT

This MEMORANDUM of AGREEMENT made and executed by and between:

DOLE – WESTERN PANGASINAN FIELD OFFICE an agency duly


organized and existing under and by virtue of the laws of the Philippines,
with office address at Alaminos City, Pangasinan hereby represented by
MS. RHODORA D. DINGLE, OIC-Head hereinafter referred to as the
“FIRST PARTY”,

-and-

GOLDEN WEST COLLEGES a reputable academe, duly organized and


existing under and by virtue of the laws of the Philippines, with office
address at San Jose Drive Alaminos, City, Pangasinan represented by its
College President, DOMINI P. VALDEZ hereinafter referred to as the
“SECOND PARTY”.

WITNESSETH:

WHEREAS, the On-The-Job Training (OJT) Program is an important


component of Bachelor of Science in Information Technology as it provides
students opportunity to put into practice the knowledge and skills acquired
from the courses they have taken. Specifically, the OJT Program is meant
to provide Information Technology Interns the opportunity to gain
practical/ hands-on experience in the field; to enhance the personality,
confidence, mediation/negotiation, public relations/communication and
critical thinking skills of Information Technology Interns; to inculcate in the
Interns the value of respect for the law and service to the community; and
to provide opportunities for the Interns to integrate and synthesize the
various theories in Information Technology.

WHEREAS, the knowledge and training that the trainees will acquire from
the FIRST PARTY will help the student-trainees in the future employment
considering that the FIRST PARTY have the facilities which can give them
the necessary skills;

NOW THEREFORE, for and in consideration of the foregoing premises and


their mutual covenants hereinafter set forth, the parties hereto agree.

RIGHTS AND OBLIGATIONS

The School shall:

1. Be responsible for making practicum arrangements, designating


Practicum Instructor, and coordinating with the partner institution
on the designation of Site Supervisor;
2. Set and prescribe institutional requirements (punctuality, proper
dress code, code of ethics) and necessary forms to be accomplished
by the Information Technology Interns;
3. Provide for regular coordination with the partner institution
regarding the implementation of the practicum;
4. Observe institutional policies, rules and regulations of both the
HEI and partner institution in which the practicum shall be
undertaken;
5. Participate in whatever related activities which shall be required
during the practicum;
6. Prepare and submit a practicum report covering the related
activities undertaken and learning acquired during the practicum;
7. Observe the confidentiality of information learned during the
practicum;
8. See the academic aspects of the Practicum;
9. Coordinate with the Site Supervisor with regards to the
implementation of the Practicum;
10. Resolve problems encountered by intern;
11. Review and evaluate reports/feedback on the Information
Technology Intern’s performance;
12. Conduct an overall evaluation of the performance and practicum
report and give the final grade to each of the Information
Technology intern; and
13. Ensure that the Interns shall uphold the confidentiality of
information learned during the practicum.

The DOLE – WESTERN PANGASINAN FIELD OFFICE shall:

1. Oversee the practical or applied aspects of the Intern’s Practicum;


2. Ensure that the intern has sufficient opportunities to gain
appropriate variety of experience;
3. Attend to all concerns relative to the on-the-job training intern;
4. Provide regular consultation and constructive feedback regarding
the Intern’s performance;
5. Review and comment on the Intern’s practicum report and offer
recommendations, should corrective action be required;
6. Submit an accomplished Practicum Evaluation form to the
Practicum Instructors reflecting the Intern’s performance during
the entire practicum and certify that the required minimum
practicum hours were completed.
7. Ensure safety and protection of the Information Technology
Interns;
8. Always uphold the quality of the OJT Program being offered. Thus
will ensure that the student trainees will also comply with
SECOND PARTY’S required work discipline and decorum.

OTHER TERMS AND CONDITIONS

1. Parties Hereby agree to promote the principle of shared


responsibility related to the implementation of the OJT Program;
2. Insurance coverage for the students is excluded as well as any if,
by any reason, of force majeure, acts of God, strikes, shortage of
labor and materials, existence of laws, statutes, rules and
regulations, whether known or unknown to the parties at the time
of the execution of this agreement, or the subsequent passage of
other laws, ordinances, or regulations by the government or any of
its subdivisions, or the happening of any unforeseen event, the
FIRST PARTY’S obligation under this agreement, shall be
suspended for the duration of the calamity, force majeure, or any
such contingencies. Upon cessation of the calamity, force majeure
or any such contingencies, the FIRST PARTY shall immediately
advise the SECOND PARTY for the immediate implementation of
the OJT Program;
3. The parties agree that the venue of the action for any suit arising
from this Agreement shall exclusively be the proper court of law in
Pangasinan;
4. Should any student trainee be found violating duly stipulated and
accepted issued rules, any student trainees’ misconduct being
found detrimental to the operations of the FIRST PARTY, shall be
expelled from the training program;
5. This Memorandum of Agreement shall take effect upon signing of
the parties concerned and shall remain in full force and in effect
subject to the compliance as stipulated hereto. Any of the parties
concerned may revoke/terminate this agreement provided
sufficient time period of not less than 30 days upon notice is
given.
6. Should any term or condition of this Agreement be declared
contrary to law, the other terms and conditions hereof shall not be
affected thereby and shall remain valid, subsisting and
enforceable.

IN WITNESS WHEREOF, the parties hereto signed this agreement


this 12nd day of January 2021 at San Jose Drive, Poblacion Alaminos City,
Pangasinan Philippines.
