1. THE WORKMEN’S COMPENSATION ACT, 1923

If personal injury is caused to a workman by accident arising out of and in the course of employment, his
employer shall be liable to pay compensation. The employer shall not be so liable, if the injury does not
result in the total or partial disablement, in respect of an injury not resulting to death caused by an accident
which is directly attributable to the workmen having been at the time under the influence of alcohol, or
willful disobedience
Amount of compensation:
 Where death results from injury- an amount equal to fifty percent of monthly wage multiplied by the
relevant factor or an amount of eighty thousand rupees whichever is more.
 Where permanent total disablement results an amount equal to sixty percent of his monthly wage
multiplied by the relevant factor or an amount of ninety thousand rupees whichever is more.

2. THE CONTRACT LABOUR ACT, 1970

Canteens
(1) The appropriate may make rules requiring that in every establishment-

b. Wherein work requiring employment of contact labour is likely to continue for such period as may be
prescribed, and
c. Wherein contract labour numbering one hundred or more is ordinarily employed by a contractor,

(2) Without prejudice to the generality of the foregoing power, such rules may provide for -
a. The date by which the canteens shall be provided.
b. The number of canteens that shall be provided, and the standards in respect of construction,
accommodation furniture and other equipment of the canteens; and
c. The foodstuffs which may be served therein and the charges may be made therefore.

Other facilities
It shall be the duty of every contractor employing contract labour in connection with the work of an
establishment to which this Act applies, to provide and maintain –
Chapter V a. A sufficient supply of wholesome drinking water for the contract labour at convenient places;

Section-18 b. A sufficient number of latrines and urinals of the prescribed types so situated as to be convenient and
accessible to the contract labour in the establishment; and
c. Washing facilities.
First-aid facilities
Chapter V There shall be provided and maintained by the contractor so as to be readily accessible during all working

Responsibility for payment of wages


(1) A contractor shall be responsible for payment of wages to each worker employed by him as contract
labour and such wages shall be paid before the expiry of such period as may be prescribed.

(2) Every principal employer shall nominate a representative duly authorized by him to be present at the
time of disbursement of wages by the contractor and it shall be the duty of such representative to certify the
amounts paid as wages in such manner as may be prescribed.
5 Chapter V (3) It shall be the duty of the contractor to ensure the disbursement of wages in the presence of the site Yes

(4) In case the contractor fails to make payment of wages within the prescribed period or makes short
payment, then the principal employer shall be liable to, make payment of wages in full or the unpaid balance
due, as the case may be, to the contract labour employed by the contractor and recover the amount so paid
from the contractor either by deduction from any amount payable to the contractor under any contract or as
a debt payable by the contractor.

3. THE CONTRACT LABOUR RULES, 1971

Forms and terms and conditions of license


(1) Every license granted under sub-section (1) of section 12 shall be in Form VI.
(2) Every license granted under sub-rule (1) or renewed under rule 29 shall be subject to the following
conditions, namely: -
The license shall be non-transferable;
The number of workmen employed as contract labour in the establishment shall not, on any day, exceed the
maximum number specified in the license;
Save as provided in these rules, the fees paid for the grant, or as the case may be, for renewal of the license
shall be non-refundable;
The rates of wages payable to the workmen by the contractor shall not be less than the rates prescribed
under the Minimum Wages Act,1948 (11 of 1948), for such employment where applicable and where the
rates have been fixed by agreement, settlement or award, not less than the rates so fixed;

In cases where the workman employed by the contractor perform the same or similar kind of work as the
workmen directly employed by the rates, holidays, hours of work and other conditions of service of the
workmen directly employed by the principle employer of the establishment on the same or similar kind of
work:
a. Provided that in the cases of any disagreement with regard to the type of work the same shall be decided
by 1[the Deputy Chief Labour Commissioner (Central) 2
b. In other cases the wages rates, holidays, hours of work and conditions of service of the workmen of the
contractor shall be such as may be specified in this behalf by 1[the Deputy Chief Labour Commissioner
(Central)];
Explanation –While determining the wages rates, holidays, hours of work and other conditions of services
under (b) above,1[the Deputy Chief Labour Commissioner (central) shall have due regard to the wage rates,
holidays, hours of work and other conditions of service obtaining in similar employments;

a. In every establishment where twenty or more women are ordinarily employed as contract labour, there
shall be provided two rooms of reasonable dimensions for the use of their children under the age of six
years,
b. One of such rooms shall be used as a play room for the children and the other as bed room for the
children,
c. The contractor shall supply adequate number of toys and games in the play room and sufficient number of
cots and beddings in the sleeping room,
d. The standard of construction and maintenance of the crèches shall be such as may be specified in this
behalf by the Chief Labour Commissioner (Central);
The licensee shall notify any change in the number of workmen or the conditions of work to the licensing

1. [(viii) The licensee shall, within fifteen days of the commencement and completion of each contract work
submit a return to the Inspector, appointed under section 28 of the Act intimating the actual date of the
commencement or, as the case may be, completion of such contract work in Form VIA];

carried on];
3. [(x) No female contract labour shall be employed by any contractor before 6.00 a.m. or after 7.00 p.m.:
Provided that this clause shall not apply to the employment of women in pithead baths, crèches and
canteens and so to mid wise and nurse in hospitals and dispensaries.]

Validity of the license.


Every license granted under rule 25 or renewed under rule 29 shall remain in force for twelve months from

Renewal of license
(1) Every contractor shall apply to the licensing officer for renewal of the license.
(2) Every such application shall be in Form VII in triplicate and shall be made not less than thirty days before
the date on which the license expires, and if the application is so made, the license shall be deemed to have
been renewed until such date when the renewed license is issued.
(3) The fees chargeable for renewal of the license shall be the same as for the grant thereof:
9 Rule –29 Provided that if the application for renewal is not received within the time specified in sub-rule (2), a fee of
25 percent. In excess of the fee ordinarily payable for the license shall be payable for such renewal:
Provided further that in case where the licensing officer is satisfied that the delay in submission of the
application is due to unavoidable circumstances beyond the control of the contractor, he may reduce or
remit as he thinks fit the payment of such excess fee.

Latrines and Urinals


Latrines shall be provided in every establishment coming within the scope of the Act on the following scale,
namely: -

(b) Where males are employed, there shall be at least one latrine for every 25 males;
Provided that where the number of males or females exceeds 100,it shall be sufficient if there is one latrine
for every 25 males or females, as the case may be, upto the first 100,and one for every 50 thereafter.
First-aid Facilities
In every establishment coming within the scope of the Act there shall be provided and maintained so, as to

Register of contractors
12 Rule – 74 Every principal employer shall maintain in respect of each registered establishment a register of contractors
in Form XII.

Employment card
(i) Every contractor shall issue an employment card in Form XIV to each worker within three days of the

Examination of pressure vessel by competent person


Every pressure vessel or Plant in service shall be examined by competent person:
Externally, once in every 6 months.
Internally, once in every period of 12 months.
If internal examination is not possible due to the construction, this examination may be replaced by a
hydrostatic test, which shall be carried out once in every 2 years. For continuously operating pressure vessel

7. THE MANAGEMENT AND HANDLING OF E-WASTE RULES 2008
Responsibility of the Producer: organizing an effective take back system for all used electrical and electronic
equipment’s which are no longer fit for its intended use.

8. WATER (PREVENTION & CONTROL OF POLLUTION)ACT 1974 & RULES 1975

Prohibition on use of stream or well for disposal of polluting matter, etc. - (1) Subject to the provisions of this
section,-
(a) no person shall knowingly cause or permit any poisonous, noxious or polluting matter determined in
Sec 24 accordance with such standards as may be laid down by the State Board to enter (whether directly or

consequences.

Restrictions on new outlets and new discharges: Subject to the provisions of this section, no person shall,
without the previous consent of the State Board -
(a) establish or take any steps to establish any industry, operation or process, or any treatment and disposal
system or an extension or addition thereto, which is likely to discharge sewage or trade effluent into a
stream or well or sewer or on land (such discharge being hereafter in this section referred to as discharge of
sewage); or
(b) bring into use any new or altered outlets for the discharge of sewage; or
(c) begin to make any new discharge of sewage:
Provided that a person in the process of taking any steps to establish any industry, operation or process

11. HAZARDOUS WASTE (MANAGEMENT, HANDLING AND TRAN BOUNDARY MOVEMENT) FOURTH AMENDMENT RULES, 2010

Packaging, labeling and transport of hazardous waste


The hazardous wastes shall be packaged, based on the composition in a manner suitable for handling,
storage and transport and the labeling and packaging shall be easily visible and able to withstand physical

12. GAS CYLINDER RULES, 1981


 Valves fitted to Carbon Dioxide cylinders will be provided in the body with a safety release consisting of
softened copper disc so arranged as to burst at a pressure between 200 kg/cm2 and 220kg/cm2

Safety relief devices

Prohibition of employment of children and intoxicated persons

No person shall smoke and no fires, other than blow pipe flames for repairs, or no articles or substances of

allowed at any time in proximity to a place where any cylinder for flammable gases is being stored or

General Precautions:
Cylinders together with their valves and other fittings and the identification colours under these rules shall
always be maintained in good condition.

(1)Transport of cylinders by vehicles.-
a) Cylinders filled with any compressed gas shall not be transported by a bicycle or any other two wheeled
mechanically propelled vehicle.
b) Cylinders shall be so transported as not to project in the horizontal plane beyond the sides or ends of the
vehicle by which they are transported.
c) There shall be no sharp projections on the inside of the vehicle.
d) Cylinders shall be adequately secured to prevent their falling off the vehicle and being subjected to rough
handling, excessive shocks or local stresses.
e) Cylinders transported in vehicles shall be blocked or braced and be so secured to prevent movement,
striking each other or falling down.
f) Cylinders filled with any compressed gas shall not be transported along with any other article of a highly
flammable or corrosive nature.
(2) Restriction of transport:
(a) Cylinders containing flammable gases shall not be transported along with the cylinders containing any
other type of compressed gas:
(b) Cylinders containing toxic or corrosive gas shall not be transported along with food-stuffs.
Notwithstanding anything contained in clause (a) above, DA cylinders not exceeding 25 in numbers may be

transported along with non-toxic non-flammable gases taking due precautions.
(3) Loading and unloading for transport.-
(a) No lifting magnet shall be used in loading or unloading of cylinders filled with any compressed gas.
(b) Where any such operation is carried on by means of a crane or a fork-lift truck, a proper cradle with
chains or wire rope slings shall be used.

(4) Protection of valves during transport: —


(a) Every cylinder containing compressed gas shall, when transported, have its valve protected against
damage in the manner provided in sub-rules (b) and (c) unless it is securely packed in a box or crate.
(b) Where the design of the cylinder does not provide for the valve lying wholly below the level of the body
of the cylinder, a stout metal cap, metal cover or a protective metal ring or grill of a design approved by the
Chief Controller shall be provided, the design being such that the cap or cover or ring or grill is nowhere in
close proximity to any part of the valve or valve body.
(c) Where metal caps or metal covers are provided, to protect valves fitted to cylinder other than those
containing highly toxic gases like Hydrogen cyanide, Phosgene, Cyanogen, Cyanogen chloride, it shall be
provided with a vent of such size so as to prevent any gas pressure inside the cap or covers.

43. Licence for filling and possession: —


(1) No cylinder filled with compressed gas shall be possessed by anyone except under and in accordance with
the conditions of a licence granted under these rules.
(2) The licensee shall be responsible, for all operations connected with the filling and possession of cylinders
in the licensed premises.

44. No licence needed for filling and possession in certain cases: —


Notwithstanding anything contained in Rule 43, no licence shall be necessary for –
Rule 43&44 (a) possession of any cylinder filled with a compressed gas by a carrier or other person for the purpose of Site Aplicable

Handling of electric supply lines & apparatus


Before any conductor or apparatus is handled adequate precautions shall be taken, by earthing or other
suitable means, to discharge electrically such conductor or apparatus, and any adjacent conductor or
apparatus if there is danger therefrom, and to prevent any conductor or apparatus from being accidentally or
inadvertently electrically charged when persons are working thereon:
Every person who is working on an electric supply line or apparatus or both shall be provided with tools and
devices such as gloves, rubber shoes, safety belts, ladders, earthing devices, helmets, line testers, hand lines

Supply to vehicles, cranes etc.


Every person owning a vehicle, traveling crane or the like to which energy is supplied from an external source
shall ensure that it is efficiently controlled by a suitable switch enabling all voltage to be cut-off in one

operation and where such vehicle, traveling crane or the like runs on metal rails, the owner shall ensure that
the rails are electrically continuous and earthed.

Cables for portable or transportable apparatus


Flexible cables shall not be used
for portable or transportable motors, generators, transformer rectifiers, electric drills, electric
sprayers, welding sets or any other portable or transportable apparatus unless they are heavily
insulated and adequately protected from mechanical injury.

connection with the frame of any such apparatus and earth.
(3)The cables shall be three core type and four core type for portable and transportable
apparatus working on single phase and three phase supply respectively and the wire meant to

Provisions applicable to protective equipment-


43.Provisions applicable to protective equipment- (1) Fire buckets filled with clean dry
sand and ready for immediate use for extinguishing fires, in addition to fire extinguishers
suitable for dealing with electric fires, shall be conspicuously marked and kept in all
generating stations, enclosed sub-stations and switch stations in convenient situation. The
fire extinguishers shall be tested for satisfactory operation at least once a year and record of
such tests shall be maintained.
(2) First-aid boxes or cupboards, conspicuously marked and equipped with such contents as
the State Government may specify, shall be provided and maintained in every generating
station, enclosed sub-station and enclosed switch station so as to be readily accessible during
all working hours. All such boxes and cupboards shall, except in the case of unattended substations

1. THE WORKMEN’S COMPENSATION ACT, 1923

time of disbursement of wages by the contractor and it shall be the duty of such representative to certify the
amounts paid as wages in such manner as may be prescribed.

(4) In case the contractor fails to make payment of wages within the prescribed period or makes short

a debt payable by the contractor.

3. THE CONTRACT LABOUR RULES, 1971

Forms and terms and conditions of license


(1) Every license granted under sub-section (1) of section 12 shall be in Form VI.
(2) Every license granted under sub-rule (1) or renewed under rule 29 shall be subject to the following
conditions, namely: -
The license shall be non-transferable;
The number of workmen employed as contract labour in the establishment shall not, on any day, exceed the
maximum number specified in the license;
Save as provided in these rules, the fees paid for the grant, or as the case may be, for renewal of the license
shall be non-refundable;
The rates of wages payable to the workmen by the contractor shall not be less than the rates prescribed
under the Minimum Wages Act,1948 (11 of 1948), for such employment where applicable and where the
rates have been fixed by agreement, settlement or award, not less than the rates so fixed;

In cases where the workman employed by the contractor perform the same or similar kind of work as the
workmen directly employed by the rates, holidays, hours of work and other conditions of service of the
workmen directly employed by the principle employer of the establishment on the same or similar kind of
work:
a. Provided that in the cases of any disagreement with regard to the type of work the same shall be decided
by 1[the Deputy Chief Labour Commissioner (Central) 2
b. In other cases the wages rates, holidays, hours of work and conditions of service of the workmen of the
contractor shall be such as may be specified in this behalf by 1[the Deputy Chief Labour Commissioner
(Central)];
Explanation –While determining the wages rates, holidays, hours of work and other conditions of services
under (b) above,1[the Deputy Chief Labour Commissioner (central) shall have due regard to the wage rates,
holidays, hours of work and other conditions of service obtaining in similar employments;

a. In every establishment where twenty or more women are ordinarily employed as contract labour, there
shall be provided two rooms of reasonable dimensions for the use of their children under the age of six
years,
b. One of such rooms shall be used as a play room for the children and the other as bed room for the
children,
c. The contractor shall supply adequate number of toys and games in the play room and sufficient number of
cots and beddings in the sleeping room,
d. The standard of construction and maintenance of the crèches shall be such as may be specified in this
behalf by the Chief Labour Commissioner (Central);
The licensee shall notify any change in the number of workmen or the conditions of work to the licensing

1. [(viii) The licensee shall, within fifteen days of the commencement and completion of each contract work
submit a return to the Inspector, appointed under section 28 of the Act intimating the actual date of the
commencement or, as the case may be, completion of such contract work in Form VIA];

carried on];
3. [(x) No female contract labour shall be employed by any contractor before 6.00 a.m. or after 7.00 p.m.:

Validity of the license.


Every license granted under rule 25 or renewed under rule 29 shall remain in force for twelve months from

Renewal of license
(1) Every contractor shall apply to the licensing officer for renewal of the license.
(2) Every such application shall be in Form VII in triplicate and shall be made not less than thirty days before
the date on which the license expires, and if the application is so made, the license shall be deemed to have
been renewed until such date when the renewed license is issued.
(3) The fees chargeable for renewal of the license shall be the same as for the grant thereof:
9 Rule –29 Provided that if the application for renewal is not received within the time specified in sub-rule (2), a fee of
25 percent. In excess of the fee ordinarily payable for the license shall be payable for such renewal:
Provided further that in case where the licensing officer is satisfied that the delay in submission of the
application is due to unavoidable circumstances beyond the control of the contractor, he may reduce or
remit as he thinks fit the payment of such excess fee.

Latrines and Urinals


Latrines shall be provided in every establishment coming within the scope of the Act on the following scale,
namely: -

(b) bring into use any new or altered outlets for the discharge of sewage; or
(c) begin to make any new discharge of sewage:
Provided that a person in the process of taking any steps to establish any industry, operation or process

flammable or corrosive nature.
(2) Restriction of transport:
(a) Cylinders containing flammable gases shall not be transported along with the cylinders containing any
other type of compressed gas:
(b) Cylinders containing toxic or corrosive gas shall not be transported along with food-stuffs.

chains or wire rope slings shall be used.

(4) Protection of valves during transport: —


(a) Every cylinder containing compressed gas shall, when transported, have its valve protected against
damage in the manner provided in sub-rules (b) and (c) unless it is securely packed in a box or crate.
(b) Where the design of the cylinder does not provide for the valve lying wholly below the level of the body
of the cylinder, a stout metal cap, metal cover or a protective metal ring or grill of a design approved by the
Chief Controller shall be provided, the design being such that the cap or cover or ring or grill is nowhere in
close proximity to any part of the valve or valve body.
(c) Where metal caps or metal covers are provided, to protect valves fitted to cylinder other than those
containing highly toxic gases like Hydrogen cyanide, Phosgene, Cyanogen, Cyanogen chloride, it shall be
provided with a vent of such size so as to prevent any gas pressure inside the cap or covers.

43. Licence for filling and possession: —


(1) No cylinder filled with compressed gas shall be possessed by anyone except under and in accordance with
the conditions of a licence granted under these rules.
(2) The licensee shall be responsible, for all operations connected with the filling and possession of cylinders
in the licensed premises.

44. No licence needed for filling and possession in certain cases: —


Notwithstanding anything contained in Rule 43, no licence shall be necessary for –
Rule 43&44 (a) possession of any cylinder filled with a compressed gas by a carrier or other person for the purpose of Site Aplicable

Flexible cables shall not be used
for portable or transportable motors, generators, transformer rectifiers, electric drills, electric
sprayers, welding sets or any other portable or transportable apparatus unless they are heavily
insulated and adequately protected from mechanical injury.

Provisions applicable to protective equipment-


43.Provisions applicable to protective equipment- (1) Fire buckets filled with clean dry
sand and ready for immediate use for extinguishing fires, in addition to fire extinguishers
suitable for dealing with electric fires, shall be conspicuously marked and kept in all
generating stations, enclosed sub-stations and switch stations in convenient situation. The
fire extinguishers shall be tested for satisfactory operation at least once a year and record of
such tests shall be maintained.
(2) First-aid boxes or cupboards, conspicuously marked and equipped with such contents as
the State Government may specify, shall be provided and maintained in every generating
station, enclosed sub-station and enclosed switch station so as to be readily accessible during
all working hours. All such boxes and cupboards shall, except in the case of unattended substations

(2) Every license granted under sub-rule (1) or renewed under rule 29 shall be subject to the following
conditions, namely: -
The license shall be non-transferable;
The number of workmen employed as contract labour in the establishment shall not, on any day, exceed the
maximum number specified in the license;
Save as provided in these rules, the fees paid for the grant, or as the case may be, for renewal of the license
shall be non-refundable;
The rates of wages payable to the workmen by the contractor shall not be less than the rates prescribed
under the Minimum Wages Act,1948 (11 of 1948), for such employment where applicable and where the
rates have been fixed by agreement, settlement or award, not less than the rates so fixed;

In cases where the workman employed by the contractor perform the same or similar kind of work as the
workmen directly employed by the rates, holidays, hours of work and other conditions of service of the
workmen directly employed by the principle employer of the establishment on the same or similar kind of

holidays, hours of work and other conditions of service obtaining in similar employments;

a. In every establishment where twenty or more women are ordinarily employed as contract labour, there
shall be provided two rooms of reasonable dimensions for the use of their children under the age of six
years,
b. One of such rooms shall be used as a play room for the children and the other as bed room for the
children,
c. The contractor shall supply adequate number of toys and games in the play room and sufficient number of
cots and beddings in the sleeping room,
d. The standard of construction and maintenance of the crèches shall be such as may be specified in this
behalf by the Chief Labour Commissioner (Central);
The licensee shall notify any change in the number of workmen or the conditions of work to the licensing

submit a return to the Inspector, appointed under section 28 of the Act intimating the actual date of the
commencement or, as the case may be, completion of such contract work in Form VIA];

carried on];
3. [(x) No female contract labour shall be employed by any contractor before 6.00 a.m. or after 7.00 p.m.:

canteens and so to mid wise and nurse in hospitals and dispensaries.]

Validity of the license.


Every license granted under rule 25 or renewed under rule 29 shall remain in force for twelve months from
8 Rule -27 the date it is granted or renewed.

Renewal of license
(1) Every contractor shall apply to the licensing officer for renewal of the license.
(2) Every such application shall be in Form VII in triplicate and shall be made not less than thirty days before
the date on which the license expires, and if the application is so made, the license shall be deemed to have
been renewed until such date when the renewed license is issued.
(3) The fees chargeable for renewal of the license shall be the same as for the grant thereof:
9 Rule –29 Provided that if the application for renewal is not received within the time specified in sub-rule (2), a fee of
25 percent. In excess of the fee ordinarily payable for the license shall be payable for such renewal:
Provided further that in case where the licensing officer is satisfied that the delay in submission of the
application is due to unavoidable circumstances beyond the control of the contractor, he may reduce or
remit as he thinks fit the payment of such excess fee.

Latrines and Urinals


Latrines shall be provided in every establishment coming within the scope of the Act on the following scale,
namely: -
10 Rule –51 (a) Where females are employed, there shall be at least one latrine for every 25 females; Site Aplicable

Provided that where the number of males or females exceeds 100,it shall be sufficient if there is one latrine

In every establishment coming within the scope of the Act there shall be provided and maintained so, as to

(c) begin to make any new discharge of sewage:
Provided that a person in the process of taking any steps to establish any industry, operation or process

The hazardous wastes shall be packaged, based on the composition in a manner suitable for handling,
storage and transport and the labeling and packaging shall be easily visible and able to withstand physical

handling, excessive shocks or local stresses.
e) Cylinders transported in vehicles shall be blocked or braced and be so secured to prevent movement,
striking each other or falling down.
f) Cylinders filled with any compressed gas shall not be transported along with any other article of a highly
flammable or corrosive nature.
(2) Restriction of transport:
(a) Cylinders containing flammable gases shall not be transported along with the cylinders containing any
other type of compressed gas:
(b) Cylinders containing toxic or corrosive gas shall not be transported along with food-stuffs.

(3) Loading and unloading for transport.-
(a) No lifting magnet shall be used in loading or unloading of cylinders filled with any compressed gas.
(b) Where any such operation is carried on by means of a crane or a fork-lift truck, a proper cradle with
chains or wire rope slings shall be used.

(4) Protection of valves during transport: —


(a) Every cylinder containing compressed gas shall, when transported, have its valve protected against
damage in the manner provided in sub-rules (b) and (c) unless it is securely packed in a box or crate.
(b) Where the design of the cylinder does not provide for the valve lying wholly below the level of the body
of the cylinder, a stout metal cap, metal cover or a protective metal ring or grill of a design approved by the
Chief Controller shall be provided, the design being such that the cap or cover or ring or grill is nowhere in
close proximity to any part of the valve or valve body.
(c) Where metal caps or metal covers are provided, to protect valves fitted to cylinder other than those
containing highly toxic gases like Hydrogen cyanide, Phosgene, Cyanogen, Cyanogen chloride, it shall be
provided with a vent of such size so as to prevent any gas pressure inside the cap or covers.

43. Licence for filling and possession: —


(1) No cylinder filled with compressed gas shall be possessed by anyone except under and in accordance with
the conditions of a licence granted under these rules.
(2) The licensee shall be responsible, for all operations connected with the filling and possession of cylinders
in the licensed premises.

44. No licence needed for filling and possession in certain cases: —


Notwithstanding anything contained in Rule 43, no licence shall be necessary for –
Rule 43&44 (a) possession of any cylinder filled with a compressed gas by a carrier or other person for the purpose of Site Aplicable

(iii) any non-flammable non-toxic gas when the total number of such cylinders does not exceed

(iv) any toxic gas when the total quantity of such cylinders does not exceed 5 at a time;
(v) acetylene gas contained in cylinders in dissolved state when the total quantity of such

inadvertently electrically charged when persons are working thereon:
Every person who is working on an electric supply line or apparatus or both shall be provided with tools and
devices such as gloves, rubber shoes, safety belts, ladders, earthing devices, helmets, line testers, hand lines

operation and where such vehicle, traveling crane or the like runs on metal rails, the owner shall ensure that
the rails are electrically continuous and earthed.

Cables for portable or transportable apparatus


Flexible cables shall not be used
for portable or transportable motors, generators, transformer rectifiers, electric drills, electric
sprayers, welding sets or any other portable or transportable apparatus unless they are heavily
insulated and adequately protected from mechanical injury.
79 Section 38 (2) Where the protection is by means of metallic covering the covering shall be in metallic
connection with the frame of any such apparatus and earth.
(3)The cables shall be three core type and four core type for portable and transportable
apparatus working on single phase and three phase supply respectively and the wire meant to
be used for ground connection shall be easily identifiable.

Provisions applicable to protective equipment-


43.Provisions applicable to protective equipment- (1) Fire buckets filled with clean dry
sand and ready for immediate use for extinguishing fires, in addition to fire extinguishers
suitable for dealing with electric fires, shall be conspicuously marked and kept in all
generating stations, enclosed sub-stations and switch stations in convenient situation. The
fire extinguishers shall be tested for satisfactory operation at least once a year and record of
such tests shall be maintained.
(2) First-aid boxes or cupboards, conspicuously marked and equipped with such contents as

1. THE WORKMEN’S COMPENSATION ACT, 1923

time of disbursement of wages by the contractor and it shall be the duty of such representative to certify the
amounts paid as wages in such manner as may be prescribed.

(4) In case the contractor fails to make payment of wages within the prescribed period or makes short

a debt payable by the contractor.

3. THE CONTRACT LABOUR RULES, 1971

Forms and terms and conditions of license


(1) Every license granted under sub-section (1) of section 12 shall be in Form VI.
(2) Every license granted under sub-rule (1) or renewed under rule 29 shall be subject to the following
conditions, namely: -
The license shall be non-transferable;
The number of workmen employed as contract labour in the establishment shall not, on any day, exceed the
maximum number specified in the license;
Save as provided in these rules, the fees paid for the grant, or as the case may be, for renewal of the license
shall be non-refundable;
The rates of wages payable to the workmen by the contractor shall not be less than the rates prescribed
under the Minimum Wages Act,1948 (11 of 1948), for such employment where applicable and where the
rates have been fixed by agreement, settlement or award, not less than the rates so fixed;

In cases where the workman employed by the contractor perform the same or similar kind of work as the
workmen directly employed by the rates, holidays, hours of work and other conditions of service of the
workmen directly employed by the principle employer of the establishment on the same or similar kind of
work:
a. Provided that in the cases of any disagreement with regard to the type of work the same shall be decided
by 1[the Deputy Chief Labour Commissioner (Central) 2
b. In other cases the wages rates, holidays, hours of work and conditions of service of the workmen of the
contractor shall be such as may be specified in this behalf by 1[the Deputy Chief Labour Commissioner
(Central)];
Explanation –While determining the wages rates, holidays, hours of work and other conditions of services
under (b) above,1[the Deputy Chief Labour Commissioner (central) shall have due regard to the wage rates,
holidays, hours of work and other conditions of service obtaining in similar employments;

a. In every establishment where twenty or more women are ordinarily employed as contract labour, there
shall be provided two rooms of reasonable dimensions for the use of their children under the age of six
years,
b. One of such rooms shall be used as a play room for the children and the other as bed room for the
children,
c. The contractor shall supply adequate number of toys and games in the play room and sufficient number of
cots and beddings in the sleeping room,
d. The standard of construction and maintenance of the crèches shall be such as may be specified in this
behalf by the Chief Labour Commissioner (Central);
The licensee shall notify any change in the number of workmen or the conditions of work to the licensing

1. [(viii) The licensee shall, within fifteen days of the commencement and completion of each contract work
submit a return to the Inspector, appointed under section 28 of the Act intimating the actual date of the
commencement or, as the case may be, completion of such contract work in Form VIA];
2. [(ix) A copy of the licence shall be displayed prominently at the premises where the contract work is being
carried on];
3. [(x) No female contract labour shall be employed by any contractor before 6.00 a.m. or after 7.00 p.m.:
Provided that this clause shall not apply to the employment of women in pithead baths, crèches and
canteens and so to mid wise and nurse in hospitals and dispensaries.]

Validity of the license.


Every license granted under rule 25 or renewed under rule 29 shall remain in force for twelve months from

Renewal of license
(1) Every contractor shall apply to the licensing officer for renewal of the license.
(2) Every such application shall be in Form VII in triplicate and shall be made not less than thirty days before
the date on which the license expires, and if the application is so made, the license shall be deemed to have
been renewed until such date when the renewed license is issued.
(3) The fees chargeable for renewal of the license shall be the same as for the grant thereof:
9 Rule –29 Provided that if the application for renewal is not received within the time specified in sub-rule (2), a fee of
25 percent. In excess of the fee ordinarily payable for the license shall be payable for such renewal:
Provided further that in case where the licensing officer is satisfied that the delay in submission of the
application is due to unavoidable circumstances beyond the control of the contractor, he may reduce or
remit as he thinks fit the payment of such excess fee.

Latrines and Urinals


Latrines shall be provided in every establishment coming within the scope of the Act on the following scale,
namely: -

(c) begin to make any new discharge of sewage:
Provided that a person in the process of taking any steps to establish any industry, operation or process

No person in or near any place where cylinders containing flammable gases are filled, stored or handled shall
have in his possession any matches, fuses or other appliances for producing ignition or explosion.

General Precautions:
Cylinders together with their valves and other fittings and the identification colours under these rules shall
always be maintained in good condition.

(1)Transport of cylinders by vehicles.-
a) Cylinders filled with any compressed gas shall not be transported by a bicycle or any other two wheeled

b) Cylinders shall be so transported as not to project in the horizontal plane beyond the sides or ends of the
vehicle by which they are transported.
c) There shall be no sharp projections on the inside of the vehicle.
d) Cylinders shall be adequately secured to prevent their falling off the vehicle and being subjected to rough
handling, excessive shocks or local stresses.
e) Cylinders transported in vehicles shall be blocked or braced and be so secured to prevent movement,
striking each other or falling down.
f) Cylinders filled with any compressed gas shall not be transported along with any other article of a highly
flammable or corrosive nature.
(2) Restriction of transport:
(a) Cylinders containing flammable gases shall not be transported along with the cylinders containing any
other type of compressed gas:
(b) Cylinders containing toxic or corrosive gas shall not be transported along with food-stuffs.

(3) Loading and unloading for transport.-
(a) No lifting magnet shall be used in loading or unloading of cylinders filled with any compressed gas.
(b) Where any such operation is carried on by means of a crane or a fork-lift truck, a proper cradle with
chains or wire rope slings shall be used.

(4) Protection of valves during transport: —


(a) Every cylinder containing compressed gas shall, when transported, have its valve protected against
damage in the manner provided in sub-rules (b) and (c) unless it is securely packed in a box or crate.
(b) Where the design of the cylinder does not provide for the valve lying wholly below the level of the body
of the cylinder, a stout metal cap, metal cover or a protective metal ring or grill of a design approved by the
Chief Controller shall be provided, the design being such that the cap or cover or ring or grill is nowhere in
close proximity to any part of the valve or valve body.
(c) Where metal caps or metal covers are provided, to protect valves fitted to cylinder other than those
containing highly toxic gases like Hydrogen cyanide, Phosgene, Cyanogen, Cyanogen chloride, it shall be
provided with a vent of such size so as to prevent any gas pressure inside the cap or covers.

43. Licence for filling and possession: —


(1) No cylinder filled with compressed gas shall be possessed by anyone except under and in accordance with
the conditions of a licence granted under these rules.
(2) The licensee shall be responsible, for all operations connected with the filling and possession of cylinders
in the licensed premises.

44. No licence needed for filling and possession in certain cases: —


Notwithstanding anything contained in Rule 43, no licence shall be necessary for –
Rule 43&44 (a) possession of any cylinder filled with a compressed gas by a carrier or other person for the purpose of Site Aplicable

(b) possession of cylinders filled with –
(i) liquified petroleum gas when the total quantity of gas does not exceed 100 kg at a time;

time;
(iii) any non-flammable non-toxic gas when the total number of such cylinders does not exceed
200 at a time;
(iv) any toxic gas when the total quantity of such cylinders does not exceed 5 at a time;
(v) acetylene gas contained in cylinders in dissolved state when the total quantity of such

inadvertently electrically charged when persons are working thereon:
Every person who is working on an electric supply line or apparatus or both shall be provided with tools and
devices such as gloves, rubber shoes, safety belts, ladders, earthing devices, helmets, line testers, hand lines

the rails are electrically continuous and earthed.

Cables for portable or transportable apparatus


Flexible cables shall not be used
for portable or transportable motors, generators, transformer rectifiers, electric drills, electric
sprayers, welding sets or any other portable or transportable apparatus unless they are heavily
insulated and adequately protected from mechanical injury.
79 Section 38 (2) Where the protection is by means of metallic covering the covering shall be in metallic
connection with the frame of any such apparatus and earth.
(3)The cables shall be three core type and four core type for portable and transportable
apparatus working on single phase and three phase supply respectively and the wire meant to

Provisions applicable to protective equipment-


43.Provisions applicable to protective equipment- (1) Fire buckets filled with clean dry
sand and ready for immediate use for extinguishing fires, in addition to fire extinguishers
suitable for dealing with electric fires, shall be conspicuously marked and kept in all
generating stations, enclosed sub-stations and switch stations in convenient situation. The
fire extinguishers shall be tested for satisfactory operation at least once a year and record of
such tests shall be maintained.
(2) First-aid boxes or cupboards, conspicuously marked and equipped with such contents as
the State Government may specify, shall be provided and maintained in every generating
station, enclosed sub-station and enclosed switch station so as to be readily accessible during
all working hours. All such boxes and cupboards shall, except in the case of unattended substations

3. THE CONTRACT LABOUR RULES, 1971

Forms and terms and conditions of license


(1) Every license granted under sub-section (1) of section 12 shall be in Form VI.
(2) Every license granted under sub-rule (1) or renewed under rule 29 shall be subject to the following
conditions, namely: -
The license shall be non-transferable;
The number of workmen employed as contract labour in the establishment shall not, on any day, exceed the
maximum number specified in the license;
Save as provided in these rules, the fees paid for the grant, or as the case may be, for renewal of the license
shall be non-refundable;
The rates of wages payable to the workmen by the contractor shall not be less than the rates prescribed
under the Minimum Wages Act,1948 (11 of 1948), for such employment where applicable and where the
rates have been fixed by agreement, settlement or award, not less than the rates so fixed;

In cases where the workman employed by the contractor perform the same or similar kind of work as the
workmen directly employed by the rates, holidays, hours of work and other conditions of service of the
workmen directly employed by the principle employer of the establishment on the same or similar kind of
work:
a. Provided that in the cases of any disagreement with regard to the type of work the same shall be decided
by 1[the Deputy Chief Labour Commissioner (Central) 2
b. In other cases the wages rates, holidays, hours of work and conditions of service of the workmen of the
contractor shall be such as may be specified in this behalf by 1[the Deputy Chief Labour Commissioner
(Central)];
Explanation –While determining the wages rates, holidays, hours of work and other conditions of services
under (b) above,1[the Deputy Chief Labour Commissioner (central) shall have due regard to the wage rates,
holidays, hours of work and other conditions of service obtaining in similar employments;

a. In every establishment where twenty or more women are ordinarily employed as contract labour, there
shall be provided two rooms of reasonable dimensions for the use of their children under the age of six
years,
b. One of such rooms shall be used as a play room for the children and the other as bed room for the
children,
c. The contractor shall supply adequate number of toys and games in the play room and sufficient number of
cots and beddings in the sleeping room,
d. The standard of construction and maintenance of the crèches shall be such as may be specified in this
behalf by the Chief Labour Commissioner (Central);
The licensee shall notify any change in the number of workmen or the conditions of work to the licensing

Validity of the license.


Every license granted under rule 25 or renewed under rule 29 shall remain in force for twelve months from

Renewal of license
(1) Every contractor shall apply to the licensing officer for renewal of the license.
(2) Every such application shall be in Form VII in triplicate and shall be made not less than thirty days before
the date on which the license expires, and if the application is so made, the license shall be deemed to have
been renewed until such date when the renewed license is issued.
(3) The fees chargeable for renewal of the license shall be the same as for the grant thereof:
9 Rule –29 Provided that if the application for renewal is not received within the time specified in sub-rule (2), a fee of
25 percent. In excess of the fee ordinarily payable for the license shall be payable for such renewal:
Provided further that in case where the licensing officer is satisfied that the delay in submission of the
application is due to unavoidable circumstances beyond the control of the contractor, he may reduce or
remit as he thinks fit the payment of such excess fee.

Latrines and Urinals


Latrines shall be provided in every establishment coming within the scope of the Act on the following scale,
namely: -

(c) begin to make any new discharge of sewage:
Provided that a person in the process of taking any steps to establish any industry, operation or process

(1)Transport of cylinders by vehicles.-

b) Cylinders shall be so transported as not to project in the horizontal plane beyond the sides or ends of the
vehicle by which they are transported.
c) There shall be no sharp projections on the inside of the vehicle.
d) Cylinders shall be adequately secured to prevent their falling off the vehicle and being subjected to rough
handling, excessive shocks or local stresses.
e) Cylinders transported in vehicles shall be blocked or braced and be so secured to prevent movement,
striking each other or falling down.
f) Cylinders filled with any compressed gas shall not be transported along with any other article of a highly
flammable or corrosive nature.
(2) Restriction of transport:
(a) Cylinders containing flammable gases shall not be transported along with the cylinders containing any
other type of compressed gas:
(b) Cylinders containing toxic or corrosive gas shall not be transported along with food-stuffs.
Notwithstanding anything contained in clause (a) above, DA cylinders not exceeding 25 in numbers may be

(3) Loading and unloading for transport.-
(a) No lifting magnet shall be used in loading or unloading of cylinders filled with any compressed gas.
(b) Where any such operation is carried on by means of a crane or a fork-lift truck, a proper cradle with
chains or wire rope slings shall be used.

(4) Protection of valves during transport: —


(a) Every cylinder containing compressed gas shall, when transported, have its valve protected against
damage in the manner provided in sub-rules (b) and (c) unless it is securely packed in a box or crate.
(b) Where the design of the cylinder does not provide for the valve lying wholly below the level of the body
of the cylinder, a stout metal cap, metal cover or a protective metal ring or grill of a design approved by the
Chief Controller shall be provided, the design being such that the cap or cover or ring or grill is nowhere in
close proximity to any part of the valve or valve body.
(c) Where metal caps or metal covers are provided, to protect valves fitted to cylinder other than those
containing highly toxic gases like Hydrogen cyanide, Phosgene, Cyanogen, Cyanogen chloride, it shall be
provided with a vent of such size so as to prevent any gas pressure inside the cap or covers.

43. Licence for filling and possession: —


(1) No cylinder filled with compressed gas shall be possessed by anyone except under and in accordance with
the conditions of a licence granted under these rules.
(2) The licensee shall be responsible, for all operations connected with the filling and possession of cylinders
in the licensed premises.

44. No licence needed for filling and possession in certain cases: —


Notwithstanding anything contained in Rule 43, no licence shall be necessary for –
Rule 43&44 (a) possession of any cylinder filled with a compressed gas by a carrier or other person for the purpose of Site Aplicable
transport in accordance with the provisions of these rules;
(b) possession of cylinders filled with –
(i) liquified petroleum gas when the total quantity of gas does not exceed 100 kg at a time;

time;
(iii) any non-flammable non-toxic gas when the total number of such cylinders does not exceed
200 at a time;
(iv) any toxic gas when the total quantity of such cylinders does not exceed 5 at a time;
(v) acetylene gas contained in cylinders in dissolved state when the total quantity of such

inadvertently electrically charged when persons are working thereon:

devices such as gloves, rubber shoes, safety belts, ladders, earthing devices, helmets, line testers, hand lines

operation and where such vehicle, traveling crane or the like runs on metal rails, the owner shall ensure that
the rails are electrically continuous and earthed.

Cables for portable or transportable apparatus


Flexible cables shall not be used
for portable or transportable motors, generators, transformer rectifiers, electric drills, electric
sprayers, welding sets or any other portable or transportable apparatus unless they are heavily
insulated and adequately protected from mechanical injury.

connection with the frame of any such apparatus and earth.
(3)The cables shall be three core type and four core type for portable and transportable
apparatus working on single phase and three phase supply respectively and the wire meant to

Provisions applicable to protective equipment-


43.Provisions applicable to protective equipment- (1) Fire buckets filled with clean dry
sand and ready for immediate use for extinguishing fires, in addition to fire extinguishers
suitable for dealing with electric fires, shall be conspicuously marked and kept in all
generating stations, enclosed sub-stations and switch stations in convenient situation. The
fire extinguishers shall be tested for satisfactory operation at least once a year and record of
such tests shall be maintained.
(2) First-aid boxes or cupboards, conspicuously marked and equipped with such contents as
the State Government may specify, shall be provided and maintained in every generating
station, enclosed sub-station and enclosed switch station so as to be readily accessible during
all working hours. All such boxes and cupboards shall, except in the case of unattended substations
