l.Descrierea programului de studii

Studiile suferioare de master (Ciclul II), vine s[ completeze cuno$tinfele 9i competentele
oblinutela LicenJd (Ciclul I). Programul de master Drept penal este in corespundere cu

Nomenclatorul domeniilor de formare profesionald Si al specialitd\ilor in invdydmdntul superior (din

28.06.2017) fiind adaptat cerinfelor pie{ii muncii. Astfel, Programul de master contine toate
elementele proiective: plan de invd![mAnt; qi curricula disciplinelor, calendarul academic, orarul
lecliilor.
Programul de master Drept penal (90 credite) este racordat la Cadrul Nalional al Calificdrilor.

modalitatea de evaluare a masteranzilor etc. sunt intocmite in corespundere cu Cadrul National al
Calificlrilor ce reprezintd instrumentul pentru recunoa$terea calificdrilor in plan nafional 9i
interna{ional.
Scopul Programului de Master (90 credite) este formarea specialigtilor in domeniul justiliei
penale, piecum gi oferirea oportunitefllor de instruire profesionigtilor care activeazd in sistemul
justilie d:in Republica Moldovu. Prog.u-ul de Master - Drept Penal (90 credite) - oferi posibilitatea
studierii aprofundate a unor institulii de drept penal, a unor categorii de infracliuni, precum 9i a unor
domenii noi in sfera dreptului penal gi a criminologiei. Absolven{ii acestui program au posibilitatea
sd foloseascd cunogtinfele gi abilitd{ile ob{inute pentru a se angaja in cAmpul muncii, pentru a fi
promovali sau pentru a urrna o specializare mai ingusti in sfera lor de activitate. De asemenea, ei pot
urma studii de doctorat in domeniul justifiei penale gi criminologiei.
Abordarea pedagogici in cadrul Programului de Master sebazeazd pe folosirea metodelor de
invdfare problematizate gi elaborarea proiectelor de grup pentru facilitarea oblinerii abilitdlilor
necesare unui specialist in domeniul justiliei penale.

1. Study Programme Description

Master Program (Circle II) is complimenting the knowledge and competences acquiredat
Bachelor (Circte I). The Master's progyam in Criminal Law is in accordance with the Nomenclature
of vocational trainingfields and specialties in higher education (rom 28.06.2017) being adjusted to
the demands of the labor market. Thus, the Master's program contains all the projective elements:
curriculum; the syllabuses and curricula, the academic calendar, the lesson schedule.
The master's program Criminal Law (90 credits) is adjusted to the National Qualifications
Framework. In this respect, the Master's Degree curriculum in criminal law (90 credits), the
curricula of the disciplines, and the method of evaluation of the masters, etc. are drawn up in
accordance with the National Qualifications Framework which is the instrument for the recognition
of qualifications at national and international level.
The purpose of the Master Program - Cri inal Law (90 credits) is to train specialists in the
criminal justice area as well as to olfer additional training opportunities to the legal professionals
working in Moldovan justice system. This Master Program aims at in depth study of particular
criminal law institutions, specific categories of crimes and new areas in criminal law and
criminologt. Graduates of this program have the opportunity to use these lcnowledge and skills to
find a suitable job, to be promoted in their career or to pursue a narrow specialization in criminal
j ustice or criminologt.
Pedagogical approach consists of problem based learning and group projects that facilitate
the development of necessary skills for a criminal justice professional.

Programul de master Drept Penal (90 credite) are ca scop formarea specialigtilor de inaltl
calificare in domeniul dreptului fenal, oblinAnd in cadrul programului cunoqtin{e teoretice 9i practice
temeinice despre mecanismele funcfionlrii dreptului penal. Mai mult, programul este orientat spre
formarea specialigtilor de factur[ nou[, capabile s[ se implice in contextul juridico-social competitiv
gi dinamic, posedAnd abilitl{i de analizd teoreticl gi implicare practic[ in solufionarea problemelor
din domeniul dreptului penal.
Absolven{ii Programului de Master profesionat Drept penal (90 credite) trebuie si posede
urmitoarele competenle generale'.
1. cunoagterea aprofundat6 a terminologiei juridice specifice programului de studii 9i teoriilor
din domeniu prin prisma unor realitili juridice concrete;
2. utilizarea unor metode, mecanisme gi/sau instrumente innovative in analiza, validarea qi
interpretarea datelor qi informa{iilor din domeniu juridic;
3. solufionarea problemelor juridice noi apdrute, prin aplicarea nomelor de drept na{ionale,
europene gi internationale;
4. rezolvarea cu grad de responsabilitate sporit a problemelor teoretice gi practice noi prin
utilizarea integratd a aparatului conceptual gi metodologic;
5. elaborarea de acte juridice specifice domeniului de studiu gi activit[1ii practice propuse spre
exercltare;
6. utilizarea adecvatd a limbajului specific pentru explicarea gi interpretarea unor situalii
standard/tipice gi/sau noi in medii profesionale diferite gi contexte mai largi asociate
domeniului;
7. aplicarea normelor gi valorilor etice in procesul de studiu gi cercetare precum 9i in procesul
 de proiectare a activitdlilor;
8. autogestionarea procesului de formare profesionald continu[ prin previziunea nevoilor de
d ezvo ltare profe s i onal d \n baza analizei refl exive a propri ei activ itlti.

Absolvenlii trebuie sd posede Ei urmdtoarele competenle specifice:

1. cunoagterea aprofundatd a terminologiei juridico-penale specifice Programului de master
Drept penal, precum gi a teoriilor in domeniu prin prisma realitlliijuridico-penale determinate
de Politica penal[ contemporan[ a Statului;
2. rezolvarea situaliilor tipice domeniului Drept penal, prin utilizarea unor metode, procedee,
mecanisme gi/sau instrumente inovative in analiza, validarea gi interpretarea datelor 9i
informaliilor din domeniul juridico-penal;
3. aplicarea normelor de drept penal na{ional, european gi internalional, in vederea solufiondrii
problemelor j uridico-penale apdrute ;
4. distingerea cazurilor practice existente in jurisprudenla nafional[ gi internafionald relevante
explic[rii qi interpretdrii situaliilor juridice specifice direcliilor de profesionalizare ale
Programului de master Drept penal;
5. analiza uniformit[1ii jurisprudentei nationale in materie penal6, precum 9i identificarea
erorilor judiciare la aplicarea normelor penale;
6. explicarla gi interpretarea unor situalii tipice gi/sau noi in mediu profesional juridico-penal,
prin utilizarea corectd a vocabularului juridic precum gi pentru elaborarea unor unor
argumentlri specifice dreptului penal;
7. autogestionarea procesului de formare profesionald continud prin previziunea nevoilor de
dezvo ltare profe s ional 6 in baza analizei refl exive a propriei activiteti ;
8. exprimarea viziunilor proprii vis-a-vis de reglement[rile in vigoare, de coliziunile existente in
doitrin6, precum gi formularea propunerilor de lege ferenda in vederea perfecfiondrii cadrului
legal existent;
g. realizarca in termeni a sarcinilor profesionale, valabile pentru piafa muncii, cu respectarea
principiilor eticii juridice, manifestand atitudine riguroasi gi responsabill, in condilii de
eficien![ gi eficacitate.
2. The knowledge, skills and competences provided by the study program (Knowledge; Abilities;
Skills)
Criminal law Master Program (90 credits) has the purpose to train specialists in criminal
justice fietd detivering theoretical and practical knowledge on the functioning of criminal law
mechanisms. Moreover, the program is aimed at training specialists of new type, able to engage in
legal and social context of a competitive and dynamic, possessing the skills of theoretical analysis
and practical involvement in solving issues in criminal law.
Gradates of the Master Program Crim-inal Law (90 credits) should have the following general
competences;
1.to possess depth knowledge of the specific legal terminology and theories based on concrete
real examples;
2. to use innovative methods, solutions, mechanisms and/or tools to analyze, validate or
interpret the legal data and information;
3. to apply national, Ei.ropean and international legal norms while solving newly occurred
Iegal issues;
4. to solve with maximum diligence new theoretical and practical issues using integrated
concepts and methodolog,t ;
5. to draft legal documents specific for the area of study and to perform proposed practical
activities:
6. to use adequately specific language to explain and interpret standard/ typical/or new
situations occurred in the professional environment or in larger context associated with the
main area of study;
7. to apply ethical norms and values in the study and research processes as well as in the
process of projecting activities;
8. to self-manage continues education process based on foreseeable professional development
needs identified based on the reJlexive analysis of own activity'
Graduates should have the following specific competences:
1. to possess depth knowledge and to develop legal terminology specific for the Criminal Law
Master Program as well as to possess the legal theories created based on the contemporary
penal policy of the state,'
2. to use innovative methods, solutions, mechanisms and/or tools to analyze, validate or
interpret the data and information specific for criminal iustice;
3. to apply national, European and international legal norms while solving newly occurred
Iegal issues,'
4. to explain and to interpret the legal situations specific to the professionalization directions oJ
the master's program Criminal law trough the relevant national and international case law;
.5. analysis of the national jurisprudence uniformity in penal matters and identification of
judiciary ewors regrading application of criminal ltrw norms;
6. to use conect and integrated legal terminologt for explaining and interpreting typical and/or
new situations occurred in criminal justice as well as for reasoning criminal law solutions;
7. to self-manage continues education pyocess based on foreseeable professional development
needs identified based on the reflexive analysis of own activity;
8. to express personal views regrading current legal provisions and existing collisions in the
criminal law theory, as well as to draft lege ferenda proposals to improve the existing legal
framework,'
g. to perform timely professional tasks, available for labor market, respecting legal ethics
principles, with due diligence, ffitely and fficiently.

Obiectivele programului de studii:
- transmiterea unor cunogtinle teoretice gi practice de calitate secundatl de achizi(ionarea de
competenle;
- formarea specialigtilor de inaltd calificare de facturd nou6, capabili sd se implice competitiv 9i
dinamic in contextul juridico-social, care sI posede abilit{i gi competen[e de analizd teoretic[ 9i
de implicare practicd in soluJionarea diverselor probleme in domeniul justi{iei penale 9i in
domenii conexe;
- modernizarea continu6 a procesului de formare profesional[ in contextul incertitudinii,
flexibilitdlii piefei muncii gi stimularea motivafiei beneficiarilor fa16 de diverse profesii/activit6li
care se inscriu in domeniul profesional format.

sunt coroborate cu stiategiile nalionale, realit[1ile qi tendin{ele din domeniu justilie penale 9i Planului
strategic de dezvoltare a USM gi a strategiilor educafionale ale Facult6lii de Drept.

3. The objectives of the study program, including theii cowespondence to the purpose of the
U niversity (Obj ectives ; Compliance)
The objectives of the study program:
- to transmit theoretical and practical knowledge of secondary quality by acquiring competences;
- to train highly qualified specialists of a new type, capable of involvement competitive and
dynamic tegal and social context, which possess skills and competencies of theoretical analysis
and practical involvement in solving various problems in criminal justice and related matters,'
- to modernize the continuous process of training in the context of uncertainty, labor market
flexibility /
and boost motivation beneficiaries to various professions activities falling in
professional field.
To assure the sustainability of the Master Program Criminal Law, its obiectives are
corroborated with national straiegies, realities and tendencies in the criminal iustice field and
Moldova State (Jniversity Strategic Development Plan as well as educational strategies of Law
Faculty.

4. Racordarea programului de studii gi a con{inuturilor din Planul de inv[{imint la

tendin{ele internafionale in domeniu.
 Planul de invdfdmAnt la Programul de master Drept penal este comparabil cu cele din lard gi de
peste hotare. De exemplu, Planurile de invdf[mAntla programele de master $tiinye penale aplicat in

confin atAt discipline din dreptul material cat qi din dreptul procesual, pe cAnd Programul de master
Drept penal al Facultdlii de Drept, USM se axeazd doar pe disciplinele dreptului material, datorAndu-
se existenlei in cadrul Facultilii de Drept a Programului de master Proces penal gi criminalisticd. Cu
referire la disciplinele dreptului material menliondm o similitudine intre ele, identificdnd discipline
asem[ndtoare cum ar fi: Drept penal european, Drept penal internafional, Drept penal comparat,
Respectarea drepturilor omului in dreptul penal (Convenfia europeand a drepturilor omului.
Jurisprudenla CEDO), etc.

4. The Conformity of the study program and the contenls of the Education Plan to the
international trends in the Jield
The Educational Plan for the Master's Degree Program in Criminal Law is comparable to
those in the country and abroad. For example, the Educational Plans for the Master's programs in
Criminal Scienies applied in some universities in Romania (www.univ-danubius.ro,
www.drept.unibuc.ro, www.laws.uaic.ro) contain both disciplines of material law and from the
procedural law, while the Criminal Law Master Program of the Faculty of Law of the USM it is
focused only on the disciplines of material law, due to the existence within the Law Faculty of the
Criminal Process and Criminalistics Master Program. Regarding the disciplines of material law, we
mention a similarity bet'vveen them, identfying similar disciplines such as: European Criminal Law,
International Criminal Law, Comparative Criminal Law, Respectfor Human Rights in Criminal Law
(in the light of the European Convention on Human Rights and ECTHR case law) etc.

5. Evaluarea aqteptirilor sectorului economic Ai social (studierea cerinfelor Cadrului Nafional

al Calificirilor, precum qi al celui european; studierea fiqelor de posturi din institu(iile
poten{ial angajatoare, evaluarea piefei prin metoda chestionarelor etc)
Programul de Master Drept penal (90 credite) este elaborat astfel incdt, disciplinele corespund
specialit[1ii distinse din Nomenclatorului domeniilor de formare profesional[ gi al specialitdlilor,
fiind adaptate cerinfelor piefii muncii, dar gi la Planul-Cadru pentru studii superioare de licenfd
(ciclul I), de master (ciclul II) qi integrate din 10.02.2020. Planul de invd{imdnt este elaborat in
concordanli cu finalitdlile de studiu exprimate in competenle generice gi specifice, previzute in
Cadrul Nafional al Calificirilor pe domenii de formare profesionali/domenii de cercetare/programe
de studii.
Monitorizarea gi revizuirea ofertei educafionale gi a programului de master se realizeazd in
conformitate cu Regulamentul privind inilierea, aprobarea, monitorizarea gi evaluarea periodica a
programelor de studii, aprobat de senatul USM la 24.02.2014 (redactat \a28.12.2017). Programele de
studii universitare sunt supuse unui proces de monitorizare continuu gi evaludrii periodice in vederea
menfinerii gi imbundtlfirii calitSfii lor. Responsabilitatea pentru monitorizarea gi imbun[tdtirea
continud a programelor de studii este delegatd echipei manageriale: decanat, Comisia de asigurare a
calitilii, Departamentul Drept penal - la nivel de facultate gi Prorectorului pentru activitatea
didacticd, Consiliului Calit6tii - la nivel de universitate.

anii 2011-2016, prelungitd prin Hotdrdrea Parlamentului nr.259 din 08.12.2016 cu privire la
asigurarea continuitdlii reformelor tn sectorul justiliei, pdnd la 3L12.2017, cu continuitate fireascd
inStrategia de dezvoltare a Sectorului de Justilie 2019-2022. Astfel, din cei 7 piloni ai Strategiei,3
se regdsesc in oferta educafionald a Planului de invdfdmAnt al Programului de master, cu abordare
tangenlial[ sau chiar aprofundat[ (In particular: Pilonul IV - Integritatea actorilor sectoruluijustiliei
este cercetat in cadrul disciplinei Infracliuni care aduc atingere activitd[ii de serviciu; Pilonul V -

5. Evalualion of the expectations of the economic and social sector (studying the requirements of
the National Quatifications Framework, as well as the European one; studying the iob
descriptions of the potential employers' institutions, evaluating the market through the
questionnaire method etc)
Criminal Law Master Program consists of disciplines designed in accovdance with the
Nomenclature of professional training and specialties and adiusted to labor markets demands and
Framework PIan onbachelor (Cycle I), master (2nd cycle) programs and integrated studies effective
as of 10.02.2020. The training plan is developed in accordance with general and specific
competences stipulated in the National Qualification Framework regarding areas for professional
fr aining/re se ar c h ar e a s/tr aining pro gr ams.
Monitoring and review of the educationat offer and training program is done in accordance
with the Regulition on initiation, approval, monitoring and periodical assessment of training
programs, approved by MSU Senate on February 24, 2014 (edited on 28.12.2017). University
training programs are constantly monitored and periodically assessed to assure and improve their
quality. The responsibility to monitor and assess training programs is delegated to management
i"o-i dean's offi"r, Quatity Assurance Commission, Criminal Law Department - Faculty level and
Deputy Rector who covers didactic activiQ and Quality Council - university level.
In addition, namely to meet the curuent needs of the company in the field of criminal iustic.e,
the Master's program is also designed on the basis of the Strateg,t for reforming the iustice sector for
the years 20ll-2016, extended by the Parliament Decision no.259 of 08.12.2016 on ensuring
coniinuity reforms in the justice sector, until 31.12.2017, with continuity in the Strateg,t for the
developmeniof the Justice Sector 2019-2022. Thus, out of the 7 pillars of the Strateg,t,3 are included
in the educational offer of the Master Plan curriculum, with a tangential or even in-depth approach
(In particular: Pillar IV - Integrity of the actors of the justice sector is investigated within the
disiiptine Crimes that affect serv.ice activity; Pillar V - The role of iustice in economic development
is addressed within thi discipline Economic offenses; Pillar VI - Respect for human rights in the
justice sector with an approach within the discipline "Human Rights' protection in The Substantive
Criminal Law").
Master Program Criminal Law is corntantly revised and updated to assure its cognitive and
professional

releiance according to the provisions of the European Qualifications Framework and
Qualifications Framework that aimed at obtaining the 7 level of qualification.
The Master in Criminal Law program offers attractive and challenging career opportunities
that equally attract men and women, people with high potential and those who, for whatever reason,

face the risk of being excluded from the labor market. In this respect, the Criminal
is constantly iedefiitng its role and place within the national higher education system and is trying
to become more and more competitive on the educational offer market.

6. Consultation of partners in the elaboration of the study program (employers, teachers,

graduates, students)
The Master Program is initiated, approved, monitored and periodically evaluated by the
Criminal Law Department of the Law Faculty in consultation with potential employers, development
partners and students. Educational offer is drafted base on expectations of students, employers,
community and in accordance with the community request, creation of a competitive environment for
universities, increase or maintenance of the number of students who choose Criminal Law
Department's ofer.
The Master Program was developed based on the following: objections of the Qualiry Assurance
Commission at the Law Faculty; students opinions collected base on a survey; the opinions of the
beneficiaries from the legal environment (General Prosecutor's Office of the Republic of Moldova
(notice of 02.02.2021), Union of Lawyers of the Republic of Moldova, Bar of the Chisinau Court of
Appeal (notice of 12.02.2021; Court Administration Agency Q,{otice of 15.02.2021); ABI ROLI
Moldova (Notice of 24.01.2021).

Program de Master Drept Penal (90 credite) este destinat absolvenlilor facultililor de drept,
precum gi profesioniqtilor din acest domeniu. Programul include discipline care contribuie la
specializarea juriqtilor in domeniul justiliei penale pentru c[ oferd oportunitatea studierii celor mai
noi institulii din acest domeniu. De asemenea, acest program reprezintd modalitatede
profesionalizare pentru asistenfii judiciari, procurori, avocali, judecdtori, ofi1eri de urm[rire penald qi
de investigalie, colaboratori ai Ministerului Afacerilor Interne, Ministerului Justifiei, etc. Acest
program promoveazi o abordare practicd a tuturor problemelor discutate qi incurajeazl studen(ii s6-gi
imbundt6leasc6 abilit6lile de cercetare gi lucru individual sau de grup. Astfel, Programul de Master
pune accent pe dezvoltarea abilitdtilor practice gi a celor de scriere gi argumentare juridicd ale
profesioniqtilor in domeniul dreptului.

7. The relevance of the study program for the labor market

Master Program Criminal Law (90 credits) is designed for law faculties graduates and for
legal professionals. This program consists of disciplines that facilitate the specialization of lawyers
in criminal justice fietd as its offers the opportunity to learn about the newest criminal iustice
institutions. This program also is a good way of professionalization for court clerks, prosecutors,
defense attorneys, judges, criminal investigators and investigative fficers as well as employee of
Ministry of Interior and Ministry of Justice. This program encourages the practical approach of all
discussed issues and facilitates the improvement of students' research skills and ability to work
individually or in groups. Thus, this Master Program aimed at developing lawyering skills as well as
legal writing and reasoning sfrills of legal professionals.

The Master's program in Criminal Law ensures the possibility of continuing the studies at the
cycle III: Doctorate in the field of Law training and in other fields, both within the State University
of Moldova, other universities in the country, as well as at universities abroad.
Likewise, it is worth highlighting the need for continuity of studies in order to exercise the
profession of Judge and Prosecutor; however, in this case it is absolutely necessaty to hold a
master's degree (the Regulations for admission to the National Institute of Justice).
