EXPLANATORY NOTE

1. Descrierea programului de studii

Studiile superioare de master (Ciclul Il), vine sd completeze cunogtinlele gi competenfele oblinute
la Licen![ (Ciclul I). Programul de master Drept penal este in corespundere cu Nomenclatorul
domeniilor deformare profesionald Si al specialitdyilor in invdldmantul superior (din28.06.2017) fiind
adaptat cerinlelor pielii rnuncii, Astfel, Programul de master confine toate elementele proiective: plan de
inv[!6mAnt; gi curricula disciplinelor, calendarul academic, orarul lecliilor.
Programul de master Drept penal (90 credite) este racordat la Cadrul Nalional al Calificdrilor. in
acest sens, Planul de invd{imAnt la master Drept penal (90 credite), Curricula disciplinelor, modalitatea
de evaf uare a masreranzilor etc. sunt intocmite in corespundere cu Cadrul Na{ional al Calificarilor ce
reprezintd instrumentul pentru recunoagterea calificirilor in plan nalional gi internalional.
Scopul Programului de Master (90 credite) este formarea specialigtilor in domeniul justiliei
penale, precum gi oferirea oportunitdlilor de instruire profesionigtilor care activeazd, in sistemuljustilie
din Republica Moldova. Programul de Master - Drept Penal (90 credite) - oferd posibilitatea studierii
aprofundate a unor institulii de drept penal, a unorcategorii de infracliuni, precum gi a unordomenii noi
in sfera dreptului penal gi a crirninologiei. Absolvenlii acestui program au posibilitatea sI foloseascd
cunogtin{ele gi abilitalile oblinute pentru a se angaja in cdmpul muncii, pentru a fi promova{i sau pentru
a urrna o specializare mai ingustd in sl'era lor de activitate. De asemenea, ei pot urma studii de doctorat
in domeniul justiliei penale gi criminologiei.
Abordarea pedagogica in cadrul Programului de Master se bazeazd pe folosirea metodelor de
invifare problematizate gi elaborarea proiectelor de grup pentru facilitarea oblinerii abilitililor necesare
unui specialist in domeniuljustitiei penale.
l. Study Programme Description
Master Propyant (Circle II) is complimenting the knowLedge and competences acquired at
Bachelor (Circle I). The Muster's program in Criminal Lau, is in uccordance with the Nomenclature of
vocational training./ields and specialties in higher education (/ront 28.06.2017) being adjusted to the
demands of the labor market. Thus, the Ma.ster's program contains all the projective elements:
curriculum; the sylLabu,ses and curricuLa, the acodemic calcndar, fhc lcsson schedule.

National Qualffications Framework which is the instrument for the recognition oJ'qualifications at
national and international leveL
The purpose of the Master Program - Criminal Law (90 credits) is to train speciolists in the
criminal .iustice area as well as to o./fer additional training opportunities to the legal professionals
working in Moldovan justice s:ystem. This Master Program aims al in deplh study of particular criminal
law institutions, specific categories of crimes and neu, areas in criminal law and criminologt.
Graduates of this progrom hctve the opportunity to use thcse knou,ledge and ,skills to find a suitable job,
to be promoted in their career or to pursue a naruow specialization in criminaljustice or criminology.
Pedagogical approach consists of problem based learning and group projecls that facilitate the
development of necessary skills.for a criminal justice professional.

Programul de master Drept Penal(90 credite) are ca scop l'ormarea specialigtilor de inaltd
calificare in domeniul dreptului Penal, oblindnd in cadrul programului cunogtinje teoretice gi practice
temeinice despre mecanismele funclion[rii dreptului penal. Mai mult, programul este orientat spre
formarea specialigtilor de facturb noud, capabile si se implice in contextuljuridico-social competitiv gi
dinamic, poseddnd abiliEli de analizd teoreticd gi implicare practicd in solulionarea problemelor din
domeniul dreptului penal.
Absolvenlii Programului de Master profesional Drept penal (90 credite) trebuie sd posede
urmdtoarele competenle genera le'.
l. cunoa$terea aprofundata a terminologieijuridice specifice programului de studii gi teoriilor din
domeniu prin prisrna unor realititijuridice concrete;

2. utilizarea unor rnetode, rnecanisme gi/sau instrunrente inovative in analiza, validarea gi

interpretarea datelor gi infornraliilor din domeniu juridic;

3. solulionarea problemelor.jLrridice noi apdrute, prin aplicarea nomelor de drept nationale,

europene gi internafionale;

4. rezolvarea cu grad de responsabilitate sporit a problemelor teoretice gi practice noi prin

ulilizarea integratb a aparatului conceptual gi metodologic;

5. elaborarea de acte juridice specifice domeniului de studiu gi activitilii practice propuse spre
exercitare;

6. utilizarea adecvatd a linrbajului specific pentru explicarea qi interpretarea unor situalii

standard/tipice gi/sau noi in rnedii profbsionale diferite gi contexte mai largi asociate domeniului;

7. aplicarea nornrelor gi valorilor etice in procesul de studiu gi cercetare precum gi in procesul de

utilizarea corectd a vocabularului.juridic precum gi pentru elaborarea unor argumentdri specifice
dreptului penal:
7. autogestionarea procesului de formare profesionald continud prin previziunea nevoilor de
dezvoltare profesionaldin baza analizei reflexive a propriei activitati;
8. exprimarea viziunilor proprii vis-a-vis de reglementirile in vigoare, de coliziunile existente in
doctrin6, precunt gi l'orrnularea proplrnerilor de lege./brenda in vederea perfec(iondrii cadrului
legal existent;
9. realizarea in ternreni a sarcinilor profesionale, valabile pentru piala muncii, cu respectarea

Criminal law Master Program (90 credits)has the purpose to train .specialists in criminal justice
field delivering theoretical and praclical knov,ledge on the func'tioning of crininal law mechanisms.
Moreover, the program i.s aimed al training specialists c2f'neu, type, able to engage in legal and social
context oJ a competitive and dynamic, possessing the skills of theoreticul analysis and practical
involvement in solving issues in criminal law.
Gradates of the Master Program Criminal Law (90 credits) should have the following general

dinamic in contextul .juridico-social, care sd posede abilitati gi competenfe de analizd teoreticd gi de
implicare practicd in soluliorrarea diverselor problenre in domeniul justiliei penale gi in domenii

- modernizarea conrinud a procesului de formare profesionald in contextul incertitudinii, flexibilitdlii
piefei muncii gi stinrularea rnotiva{iei beneficiarilor fa{d de diverse profesii/activit6!i care se inscriu
in domeniul profesional format.
In vederea asigurbrii sustenabilitdlii Prograrnurlui de Master Drept penal, obiectivele acestuia sunt
coroborate cu strategiile na{iorrale. realitalile gi tendinlele dirr dorneniu justilie penale gi Planului
strategic de dezvoltare a USM gi a strategiiloreducalionale ale fracultdtiide Drept.

To assure the sustainability of the Master Progyam Criminal Law, its objectives are coruoborated
with national strategie,s, realilies und tendencies in the criminal .justice Jield and Moldova State
University Stralegic Developntenl Plan as u,eLl as educalional strategies of Law Faculty.

4. Racordarea programului de studii gi a confinuturilor din Planul de invifdmflnt la tendinfele

internationale in domeniu.
Planul de invdldrnAnt la Programul de master Drept penal este comparabil cu cele din fard gi de
peste hotare. De exemplu, Planurile de invdldmAnt la programele de master $tiinle penale aplicat in
unele universitili din RornAnia (ur@, www.drept.unibqc.ro, www.laws.uaic.ro)
con{in atAt discipline din dreptul material cat $i din dreptul procesual, pe cAnd Programul de master
Drept penal al Facultalii de Drept, USM se axeazl. doar pe disciplinele dreptului material, datorAndu-se
existenlei in cadrul Facultdtii de Drept a Programului de master Proces penal gi criminalistic5. Cu
referire la disciplinele dreptului rnaterial nrenliondrn o similitudine intre ele, identificdnd discipline
asemdnltoare cum ar fi: Drept penal european, Drept penal internafional, Drept penal comparat,
Respectarea drepturilor omului in dreptul penal (Conven{ia epropeand a drepturilor omului.
Jurisprudenta CEDO), etc.

4. The Conformity o.f the study pntgram and the contents of lhe Education Plon to the internutional
trends in the.field
The Educational Plan.for lhe Master',s Degree Program in Criminal Law is comparable to those
in the country and ahroad. For example, the Educational Plans,for the Master's programs in Criminal
Sciences applied in some universities in Romania (www.univ-danubius.ro, www.drept.unibuc.ro,
www.law:s.uaic.ro) contain both disciplines of material law and.from the procedural law, while the
Criminal Law Master Progyam oJ-the Faculty o.f Law of the USM it is .focused only on the disciplines of
material law, due to the existence u,ithin the Law Faculty of the Criminal Process and Criminalistics
Master Program. Regar.ding lhe disciplines of material law, u,e mention a similarity between them,
identifying similar disciplines such as: European Criminal Law, International Criminal Law,
Comparative Criminal Law, Re,spect,fbr Human Rights in Criminal Law (in the light oJ the European
Convention on Human Rights and ECTHR case law) etc.

5. Evaluarea agteptirilor sectorului economic Ai social (studierea cerinfelor Cadrului Na(ional al

Calificirilor, precum gi al celui european; studierea figelor de posturi din institu{iile poten{ial
angajatoare, evaluarea pie{ei prin metoda chestionarelor etc)
Programul de Master Drept penal (90 credite) este elaborat astfel incAt, disciplinele corespund
specialit[1ii distinse din Nomenclatorului domeniilor de formare profesional5 Ei al specialitdlilor, fiind
adaptate cerinlelor pielii rnuncii, dar gi la Planul-Cadru pentru studii superioare de licenf[ (ciclul I), de
master (ciclul II) 9i integrate din 10.02.2020. Planul de invd{[mdnt este elaborat in concordanld cu
finalit6lile de studiu exprimate in competen{e generice gi specifice, prevdzute in Cadrul Nalional al
Calificdrilor pe domenii de formare profesionald/domenii de cercetare/programe de studii.
Monitorizarea gi revizuirea ofertei educalionale gi a programului de master se realizeazl in
conformitate cu Regulamentul privind inilierea, aprobarea, monitorizarea qi evaluarea periodica a
programelor de studii, aprobat de senatul USM la 25.02.2014 (redactat la 28.11.2017). Programele de
studii universitare sunt supuse unui proces de monitorizare continuu gi evalulrii periodice in vederea
menlinerii gi imbunltatirii calitAlii lor. Responsabilitatea pentru monitorizarea gi imbunitd{irea continud
a prograrnelor de studii este delegatS'echipei manageriale: decanat, Comisia de asigurare a calitdlii,
Departamentul Drept penal - la nivel de f'acultate gi Prorectorului pentru activitatea didacticd
Consiliului Calit6lii- la nivel de universitate.
In plus, tocmai pentru a rbspunde necesit[1ilor actuale ale societdfii in domeniu justiliei penale,
Programuf de master este proiectat gi in baza Strategiei de reformare a sectorului de justilie pentru anii
2011-2016, prelungitd prin Hotdrarea Parlamentului nr.259 din 08.12.2016 cu privire la asigurarea
continuitdlii reformelor in sectorul .iustiliei, pand la 3 I. I 2.201 Z. cu continuitate fireascd in Strategia de
dezvoltare a Sectorului de Justilie 2019-2022. Astfel, din cei 7 piloni ai Strategiei,3 se regdsesc in
oferta educalionald a Planului de inva{dmdnt al Programului de master, cu abordare tangentiali sau chiar
aprofundatd (ln particular: Pilonul IV - Integritatea actorilor sectorului .iustiliei este cercetat in cadrul

Programul de master Drept penal propune oportunit[!i atractive gi provocatoare de carier[ care

motive, se confruntd cu riscul excluderii de pe piaJa forJei de munc[. In acest sens, Departamentul Drept

5. Evaluation of the expectations of the economic and social sector (studying the requirements of the
National Quulifications Framework, as well as lhe European one; studying the job descriptions of the
potential employers' institutions, evaluating the market lhrough the questionnaire method etc.)
Criminal Law Master Progrom consist,s of disc'iplines designed in accordance with the
Nomenclature of profes.sional training and specialties antl adjusted to labor markets demands and
Frameu,ork Plan on bachelor (Cycle I), master (2nd cycle) programs and integrated studies efective as
of 10.02.2020. The training plan is developed in accordance with general and specific competences
stipulated in the National Qualification Framework regarding areas.for professional training/research
are as/tr aining pro gr am s.
Monitoring and revieu, of the educational offer and training program is done in accordance with
the Regulation on initiation, approval, monitoring and periodical assessment of training programs,
approved by MSU Senate on February 25 2011. UniversiQ lraining programs are constantly monitored
and periodically assessed to assure and improve their quality. The responsibility to monitor and assess
training programs is delegated to management team: dean's ffice, Quality Assurance Commission,
Criminal Law Department - Faculty level and Deputy Rector who covers didactic activity and Quality
Council - university level.
In addition, namely to meet the current needs of the company in the field of criminal justice, the
Master's program is also designed on the basis of the Strategy for re.forming the justice sector for the
years 2011-2016, extended by the Parliament Decision no.259 of 08.12.2016 on ensuring continuity
reforms in the justice sector, until 31.12.2017, with continuilt in the Strategt,.for the development o.f the
Justice Sector 2019-2022. Thus, out of the 7 pillars of the Strategl,t, 3 are included in the educational
offer of the Master Plan cuwiculum, with a tangential or even in-depth approach (In particular: Pillar
IV - Integrity of the aclors of the justice sector is investigated u,ithin the discipline Crimes that affect
service activity; Pillar V - The role ofjustice in economic development is addressedwithin lhe discipline
Economic offenses; Pillar VI - Respecl.for human rights in lha justice sector with an approach within
the discipline "Human Rights' protection in The Substantive Criminal Law").
Master Program Criminal Law i.s constantly revised and updated to assure its cognitive and
professional relevance according to the provisions o.f the European Qualification,g Framework and
National Qualifications Framework that aimed at obtaining the 7 level o.f qualification.
The Master in Criminal Law program o.ffers attractive and challenging career opportunities that
equally attract men and women, people u,ith high potential and those who, for whatever reason, face the
risk of being excludedfrom the labor market. In this respect, the Criminal Law Department is constantly
redefining its role and place within the national higher education system and is trying to become more
and more competitive on the educational offer market.
In another context, the economic impact is distinguished from the disciplines introduced in the
Educational Plan that offers graduates thejob placement and the real .:;ector.

dezvoltare gi studenfi. Oferla educa!ionalI este elaboratd avAncl la bazd agteptdrile din partea
masteranzilor, a angajatorilor, a comunitdlii, precum gi congruenta ofertei ., cerinlele mediu
concurenJial al instituliile de invdlbmdnt superior universitar gi postuniversitar; creqterea/menfinerea
numdrului de masteranzi care aleg oferta educalional6 a Depafiamentului Drept penal.
La dezvoltarea programului s-au luat in calcul: obiecliile Comisiei de evaluare a procesului
didactic la Facultatea Drept;opiniile masteranzilor extrase din analiza Chestionarelor; consultarea
beneficiarilor din mediul juridic (Ministerul Justiliei al RM, Curtea Supremi de Justilie a RM,
Procuratura GeneralS a RM, Uniunea Avocalilor din Moldova).

Program de Master Drept Penal (90 credite) este destinat absolvenfilor facult[1ilor de drept,
precum gi profesionigtilor din acest domeniu. Prograrnul include discipline care contribuie la
specializarea jurigtilor in dorneniuljustiliei penale pentru c6, oferd oporlunitatea studierii celor mai noi
institulii din acest domeniu. De asemenea, acest program reprezintd modalitate de profesionalizare
pentru asistenJii judiciari, procurori, avoca{i, judecdtori, ofi1eri de urmdrire penalS gi de investigalie,
colaboratori ai Ministerului Afacerilor Interne, Ministerului Justiliei, etc. Acest program promoveazd o
abordare practicd a tuturor problemelor discutate gi incurajeaz[ studenlii s6-qi imbun[tdleascd abilit[file
de cercetare gi lucru individual sau de grup. Astfel, Programul de Master pune accent pe dezvoltarea

professionals. This progronx consisls of disciplines that facilitate the specialization of lawyers in
criminal justice Jield as its offers the opportunity to learn ctbout lhe newest criminal justice institutions.
This program also is a good v,ay o.f professionalization for court clerks, prosecutors, defense attorneys,
judges, criminal investigators and inve.stigative fficers as well as employee of Ministry of Interior and
