NOTA EXPLICATIVA
1. Descrierea programului de studii (prezentarea succinti a profilului specialititii, precum $i a
domeniului de formare profesionall ;i domeniului general de studiu).
Scopul specialitAlii Drept este de a realiza o formare profesionala eficientd in domeniu, creand premise
sigure de integrare socio-profesionala de succes a persoanelor specializatein drept in cadrul sistemului de
drept din Republica Moldova, precum Ei posibilitatearealizdrii profesionale peste hotarele !6rii.
Specialistul in domeniul jurispruden{ei (licenliat in drept ) poate sa-gi desfrgoare activitatea sa profesionald
in diverse domenii - drept civil, penal. financiar, bancar, criminalisticS, psihologie juridicd, protecfia
drepturilor omului etc., linAnd cont de specialitatea nominalizatA.
Specialitatea Drept formeazd speciali$ti in domeniul jurisprudenfei, oferind o viziune de ansamblu,
cuno$tinfe teoretice despre mecanismele func(ionarii dreptului gi abilitali practice in aplicarea acestora.
Programul de formare profesionala iniliald pentru Ciclul I este fundamentat de planul de invdfdmint, care
cuprinde urmdtoarele eomponente: a) Discipline care dezvoltd competen(e generale instrumentale,
interpersonale gi sisternice prin studierea disciplinelor socioumanistice. codiflcate prin G gi U in planul de
invaf[mint: Istoria dreptului romAncsc; F'ilclsofia dreptului: -l'ehnologii infornra(ionale de comunicafie;
Limba str[ina; Cultura fizicd, etc. Discipline care asigura pregdtirea teoreticS fundamentald, codificate
prin F: Teoria generald a dreptului, I)rept privat rolnan, Drept civil, Drept penal, Drept procesual penal,
Drept procesual civil, Drept constitulional; b) Discipline care asigura pregatirea de specialitate, codificare
prin S: Drept administrativ, Drept interna{ional public, Drept varnal, Drept internalional privat, Dreptul
afacerilor, Drept fiscal, Criminalislica, Crimir-rologia, Dreptul conrerlului internafional, Dreptul
proprietalii inte.lectuale. Dreptr,rl mr-rncii etc.

Finalitalile de studiu ale planului sunt:

profesionale, cu respectarea principiilor eticii activitatii $tiintifice, aplicarea riguroasd a regulilor de citare
gi respingerea plagiatului;
3. cdutarea, identificarea qi utilizarea unor metode gi tehnici eficiente de invafare; con$tientizarea
motivaliilor extrinseci gi intrinseci ale invalarii continue
4. utrhzarea eficientd a resurselor de comunicare gi a surselor de infon-nare,a surselor de formare
profesionald asistat6, atit in limba romAnd. cit gi intr-o limba de circula[ie internajionald.

La frnahzarea studiilor superioare de licenld (ciclul I) studentul trebuie sd posede urmdtoarele

competen{e profesionale:
l. Cunoagterea conceptelor. teoriilor. paradigmelor gi metodologiei din domeniul juridic;
2. Utrlizarea cunogtinfclor in culegcrea datelor gi informatiilor referitoare la probleme concrete de
drept;
3. Aplicarea legislaliei Republicii Moldova, a altor instrumente juridice europene gi internalionale;
4, Aplicarea tehnicilor gi instrumentelor specifice din domeniul juridic in solulionarea problemelor de
ordin practic;
5. Exprimarea viziunilor proprii fala de reglementdri sau coliziuni de drept;
6. Utilizarea de tehnici, metode qi procedee in vederea formulirii soluliilor interpretative ale normelor
juridice;
7. Formularea propunerilor in vederea perfeclionarii cadrului legal existent;
8. Indeplinirea la termen, riguroasi gi responsabil[, in condilii de eficienla qi eficacitate, a sarcinilor
profesionale, cu respectarea principiilor eticii juridice;
9. Utilizarea eficienta a resurselor de comunicare. a surselor de fbrmare profesionald asistatf,, atdt in
limba romdn6, cdt gi intr-o limba de circulalie internalionald.

3. Obiectivele programului de studii, inclusiv corespunderea acestora misiunii universiti{ii;

Specialitatea de Drept urmdregte realizarea obiectivelor prin:
1. Formarea competenlelor profesionale ale absolventului in baza pregdtirii teoretice gi practice in
domeniul dreptului.
2, Formarea abilitalilor de cercetare in domeniul jurisprudenlei in baza componentei gtiinlifice. in
acest sens se urmdregte pregdtirea specialistului in scopul investigdrii problemelor contradictorii din
jurisprudenld.
3. Asigurarea condiliilor de dezvoltare multilaterald a viitorului specialist, formarea poziliei civice gi
dimensiunii etice a personalitalii.
Obiectivele reiese din Planul Strategic al Universit[lii de Stat din Moldova 2016-2020 aprobat de Senatul
USM la 22 decembrie 2015.
4. Racordarea programului de studii gi a con{inuturilor din Planul de invd(imint la tendin{ele
interna{ionale din domeniu;
Planul de invdldmAnt de la specialitatea Drept este racordat modelelor cle intruire .juridicd din statele
Uniunii'Europene, fdrd a ignora experienla statelor CSL Astl'el, simbioza intre disciplinele fundamentale
gi a celor moderne, utilizarea tehnicilor clasice de instruire cu cele la distan{a, funcfionarea filierelor ango
qi francofone, precum Ei instruirea in limba rusd pernrit studenfilor implicarea in studii comparate gi a
mobilitSlilor academice.
Pentru a rdspunde solicitdrilor angajatorilor gi in general a pielii muncii Planul de invdlamint la
specialitatea ,,Drept" a fost racordat cerinlelor Procesului de la Bologna gi a fost elaborat {inindu-se cont
de experienla universitalilor de prestigiu in domeniu din Europa gi SUA.

5. Evaluarea aqteptirilor sectorului economic qi social (studierea cerin{elor Cadrului Na{ional al

Calific5rilor, precum gi al celui european; studierea fiqelor de posturi din institu{iile potential
angajatoare, evaluarea pie{ei prin metoda chestionarelor etc.);
In funcfie de cerinlele Cadrului Nafior-ral qi European al Calificdrilor facultatea de drept identifici
cerinlele angajatorilor publici qi priva{i f,a{a de tinerii speciali;ti, defindtori de licenla in Drept. Astfel, se
actualizeazd curricula universitard gi sarcinile practice in procesul de instruire.
Analiza mediului extern se referd la evaluarea contextului economie, socio-eultural gi a pie{ei potenfiale a
muncii pentru identificarea nevoii de instruire gi formare profesionald, a serviciilor educalionale oferite de
USM, comparabile cu cele oferite de alte universitati din fara gi din strhindtate. Se au in vedere 9i
recomanddrile gi reglement[rile specifice domeniului, elaborate de organisme nalionale sau europene.
Analiza mediului intern se referd la evaluarea ofertei existente de programe de studii, a obiectivelor
strategice gi de resursele disponibile ale USM.

6. Consultarea partenerilor in procesul de elaborare a programului de studii (angajatori, profesori,

absolven{i, studenfi etc.);
Procesul de consultare cu angajatorul cuprinde urmdtoarele direclii:
- elaborarea gi perfeclionarea programelor de studii in concordan{5 cu cerinlele inaintate de angajator;
-incheierea acordurilor cu institu{ii gi organizalii din domeniul dreptului privind pregdtirea specialigtilor
cu indicarea cerinlelor fafa de abilitatile profesionale ale studenfilor;
- incadrarea rcprezentanlilor organelor de drept in evaluarea cunogtinlelor gi abilitagilor absolvenlilor in
timpul suslinerii examenelor gi a tezei de licenld;
- coordonarea rezultatelor cercetirilor gtiinlifice cu instituliile gi organiza\iile de profil gi oblinerea
avizelor;
- conlucrarea in vederea organizdrii stagiilor de practicd la Studii superioare de licenld, Ciclul I. in acelagi
timp, parteneriatul intern este foarte imporlant. La Studii superioare de licenfa, Ciclul I procesul de
consultare are loc in cadrul elaborarii gi perfec{ionarii programelor de studii (forma expertizei), in cadrul
organizdrri practicii de iniliere, de specialitate gi de licen![ (forma acordurilor corespunzatoare), in timpul
suslinerii examenelor de licenla Ei a tezei de licen![ (forma participativd) gi elaborarea unor programe de
studii cu destinafie speciala la solicitarea angajatorilor.

7. Relevanfa programului de studii pentru pia{a for{ei de muncd;

Cadrul normativ existent, care stabileEte statutul, modul de organizare gi funclionare aprofesiilorjuridice,
prevede ca exigen!6 profesionald de accedere in funcfie studiile juridice cel pu{in la nivelul Licentei in
drept.
Pentru alte funclii atAt in domeniul public, cdt Ei in cel privat licen{a in Drept este un mare avantaj.

8. Posibiliti{ile de angajare a absolven{ilor;

Specialigtii instruili la specialitatea sus numitd, definatori ai diplomei de licenfi in drept pot activa in
cadrul instanlelor judecdtoregti, organelor procuraturii, avocaturii, Ministerului .lustiliei, Ministerului
Afacerilor Interne, direcliilor gi secfiilor juridice ale autoritdJilor administrafiei publice centrale gi locale,
ale instituliilor, organizaliilor, intreprinderilor publice gi private. Curlii Constitulionale, aparatului
Avocalilor parlamentari, instituliilor de expertiza judiciara; organizafiilor non-guvernamentale de triere gi
mediere, a litigiilor; organizaliilor non-gLrvernamentale specializate in apdrarea drepturilor omului;
organelor Republicii Moldova peste hotare; organizaJiilor guvernamentale internalionale gi regionale,
precum gi in oricare alte domenii care necesitd protejarea, supravegherea, respectarea drepturilor,
libertdfilor gi intereselor persoanelor sau a valorilor ocrotite de lege

Realizarea finalitalilor Ciclului I de studii in domeniul de formare profesionald Drept permite accesul la
studii de master de profesionahzare in acelag domeniu, cu diferite planuri de instruire in funclie de
specializare gi evaluarea necesitdlilor de aprofundare a cunoqtinlelor Ei a abilitdlilor practice pentru
diferite profesii j uridice.
Diploma de licenld in drept permite accesul la studii de masterat in alte domenii de formare profesionalf,
cu condilia realizdrii prerech izitului stabi I it.

1, Description of the Study Program (the brief presentation of the Specialty Protile as well as of
clomain of the professionul training and domain of general studying)
The purpose of the Specialty of Law is to accomplish an fficient professional training in domain being
created certain and unweaving assertions of successful social and professional integration of legal
professionals in the realm of legal system of the Republic of Moldova, as well as possibility of
pr ofe s s ional r e al izat ion abr o ad.
The legal professional (Licentiate .in [,oyt) can carry out his/ her pro.fessional activities in different
domains, such as Civil Lau,, Penal Lau,, Financial Lau,, Banking Lau,, Forensic Science, Legal
Psychology, Human Rights Protection etc., taking into con.gideration his/her specialty.
In the realm of Law Specialty there are underlaken training aclivities in domain of ,lurisprudence by
creation of a general vision, theoretical knowledge about mechani.gm,s of lau, .functioning and practical
skills during its fuffillment. The Program of Initial Professional T'raining.for the Cycle I is founded on the
University Syllabus which includes the.following part.s: a) Legal disciplines which develop instrumental
general, interpersonal and systemic contpetences by means of studying of social disciplines codffied by G
and U in the University Syllabu.s: History of Romanian [,aw: Philosophy of Lau,; Informational
Technologies of Communication; Foreign Language; Physical Training etc. Academic disciplines which
accomplish the fundamental theoretical training codified by F-, are the.following: General Theory of Law,
Romon Private Law; Civil Law: Penal Law; Lav, of Criminal Procedure; Law of Civil Procedure,'
Constitutional LcM. Academic disciplings which accomplish professional training in Law Specialty are
codified by S: Administrative Law; International Public Law; Customs Law; International Private Law;
Business Law, Tax Law, Forensic Science: Criminology; International Business Law; Intellectual
Property Law; Labor Law etc.
