1) Marben, a 16-year-old high school student stabbed his classmate Toto who is his rival for a girl named
Juliana using a newly sharpened Mongol 2 pencil. This happened after their class in Araling Panlipunan
with Ma’am Kriz Cogito (Marbens’ Tita) at the school playground. Who may be held liable? Provide a legal
basis.
In this scenario the teacher becomes liable for the students doing basing the ARTICLE 2180 OF THE
NEW CIVIL which entails that whenever that the student who commit the act is still in the custody of the
teacher or still in the school premises when the act was done. Therefore, the teacher is liable in this situation.
2) Joel, a teacher in his prime years loaned a huge sum from Marites. Joel defaulted in his payments and the
obligation has become due and demandable. Despite several demands, Joel fell silent and cut his
communications to Marites. Marites heard some rumors and hearsays with her friends and neighbours that
joel already paid his loan and he called Marites “Laug ug baga ug nawong.” Marites then went to the Joel’s
school and attacked Joel while he was on his way home. Can Joel be considered as a person in authority?

According to the (Article 152 of the revised penal code which determines the person in authority and in
Article 148 and article 151 – which says that any individual charged or considered as person in authority
must be in actual Performance of his/ger duty) so which means in Joel’s situation which he is no longer
performing his duty when the conflict happens and also he is no longer on the school grounds which means
at a time that act or marites attacked joel, Joel is not vested by the article 152 of the revised penal code and
confirmly a Civilian individual. Therefore, joel is not a person in authority when the scandal happens.
3) After things have returned back to normal and COVID-19 was no longer a threat, Mrs. Destacasingco, the
adviser for BSED SocStud III organized an Educational Tour to Bantayan Island. Along the road, the left
from tire exploded. The bus fell into a ravine that resulted to the death of one of her students Jay Sean and
physical injuries of five of her students. All students has sustained trauma to the accident. Is Mrs.
Destacasingco liable? Yes or no? How about the school and the bus driver? Cite your legal basis.
According to the Article 219 and article 219 of Special Parental Authority Under the family Code-
the school, administrators, teachers or the institution is liable when there’s something happens to
the students’ even if they are in the school grounds as long as they are included in the school’s
organized program such as educational tours that is being tackled in this scenario and as Mrs.
Destacasingco is part of the institution therefore, she is subsidiarily liable for the unintended
accident.
